RESOLUTION NO. 18+3
RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, GRANTING TO JAMES
R. REID, HIS HEIRS, ADMINISTRATORS, EXECU-
TORS AND ASSIGNS AN EASEMENT OF USE AND OC-
CUPANCY IN AND TO THOSE CERTAIN STREETS
KNOWN AS OCEAN DRIVE FROM INLET BOULEVARD
TO THE NORTH LINE OF BLOCKS FIVE (5 ) AND
SIX (6) , SOUTH BEACH PARK, AND IN AND TO
HARLEY AVENUE FROM COLLINS AVENUE TO REID
PLACE, SOUTH BEACH PARK.
WHEREAS, JAMES R. REID, owner of Blocks Two (2) , Three
(3 ) , Five (5) and Six (6) of SOUTH BEACH PARK, City of Miami
Beach, Florida, has filed a request with this Council asking
that Ocean Drive from Inlet Boulevard to the North line of
the said Blocks Five (5) and Six (6) , and Harley Avenue from
Collins Avenue to Reid Place; be temporarily closed, and that
he be given the right of use and occupancy thereof for a per-
iod not to exceed Fifteen (15) years from this date , for the
purpose of erecting, operating and maintaining thereon an
amusement center, and,
WHEREAS, it appears that the said James R. Reid is the
sole owner of all the said Blocks Two (2) , Three (3 ) , Five
(5) and Six (6); that a petition has been filed with this
Council, signed by many adjacent business men, property own-
ers and residents, stating that they believe it to be to the
best interest of the City of Miami Beach, that said request
be granted; that other streets will afford ample facilities
for traffic and for the convenience of the public; and that
it is to the best interests of the City of Miami Beach, and
especially of this particular locality that said request be
granted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, THAT THE SAID James R. Reid,
his heirs, administrators, executors and assigns be and they
are hereby granted an easement of use and occupancy in and to
those certain streets known as Ocean Drive from Inlet Boule-
vard on the South to the North line of Blocks Five (5) and
Six (6) of said South Beach Park, and in and to Harley Avenue
from Collins Avenue to Reid Place in said South Beach Park,
for a period of not to exceed Fifteen (15) years from this
date, for the purpose of erecting, maintaining and operating
thereon an amusement center,
PROVIDED, HOWEVER, that said amusement center shall have
been erected at a cost of not less than One Hundred Thousand
( 100,000.00) Dollars and shall have been in operation not
later than January 1st, 1930, and,
PROVIDED FURTHER, that should said amusement center be
abandoned or not operated or maintained for a period of One
(1) year, during the period of not to exceed Fifteen (15)
years, for which this easement is granted, then and in that
event , said Grantee shall be deemed to have forfeited all
rights to said easement which shall thereupon become null and
void, terminated and of no effect.

that upon said termination, said streets shall be restored

grantee, at his expense, to said city in the same condition
in which they now are and all obstructions removed,
