AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA, AMENDING CHAPTER 17B OF THE CODE OF
THE CITY OF MIAMI BEACH, ESTABLISHING THE
CITY'S MINIMUM HOUSING AND COMMERCIAL PROPERTY
STANDARDS BY ADDING A NEW SECTION 17B-29 . 1
PROVIDING FOR THE MINIMUM HOUSING STANDARDS
FOR ADULT CONGREGATE LIVING FACILITIES
(ACLF'S) SITUATED IN MIAMI BEACH; PROVIDING
THAT ALL FACILITIES HOLDING H.R.S . LICENSES AS
ACLF'S UPON THE EFFECTIVE DATE OF THIS
ORDINANCE MUST COMPLY WITH THIS ORDINANCE
WITHIN TWELVE MONTHS OF THE EFFECTIVE DATE;
PROVIDING FOR SEVERABILITY; PROVIDING FOR THE
REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1:
That Chapter 17B of the Code of the City of Miami Beach, Florida,
pertaining to the Minimum Housing and Commercial Property
Standards of the City of Miami Beach be, and the same is hereby
amended by adding the following Section 17B-29.1 setting forth
the minimum housing standards for Adult Congregate Living Facili-
ties (ACLF ' s) situated in Miami Beach:
Section 17B-29 .1 . Adult Congregate Living Facilities.
(1) In addition to the minimum housing standards set forth
in this chapter , Adult Congregate Living Facilities must
comply with the following requirements, which shall con-
trol in case of conflict.
(a) Facilities must be in conformance with all provisions of
the South Florida Building Code, Fire Code, and the HRS
Fire Safety Standards for adult congregate living facil-
ities.
(b) All facilities, with enclosed hallways , shall have
sprinkler systems in hallways and bedrooms.
(c) Smoke detectors are required in each bedroom.
(d) All bedroom, dining and indoor recreation areas shall be
heated and air-conditioned.
(e) All facilities of more than two floors shall have an
elevator large enough to carry a stretcher .
(f) Each bedroom and bathroom shall have emergency call
buttons.
(g) A bathroom shall be provided for each two ACLF units.
(h) Units including bedrooms, bathrooms and closets shall be
a minimum of 200 square feet for the first two occupants
in each unit; for each additional person, another 100
square feet shall be added excepting facilities with
valid City and H.R.S . licenses as ACLF' s as of the
effective date of this ordinance.
(i) Communal areas for eating and recreation shall each be
no less than 20 square feet per person and may be
contiguous to one another .

(j ) Facilities must be in conformance with H.R.S .
guiidelines regarding availability of staff personnel on
the premises.
(2) All facilities holding H.R.S. licenses as ACLF' s when
this ordinance becomes effective must comply with all
provisions of this Ordinance within twelve (12) months
of the effective date.
SECTION 2: SEVERABILITY.
If any section, sub-section, sentence, clause, phrase or other
portion of this ordinance is, for any reason, held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct, and independent pro-
vision, and such holding shall not affect the validity of the
remaining portions of this ordinance.
SECTION 3 : REPEALER.
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.

SECTION 4 : EFFECTIVE DATE.
This ordinance shall take effect ten (10) days after adoption in
accordance with law.
