AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA, AMENDING SECTION 8-3 OF THE MIAMI
BEACH CITY CODE , PROVIDING FOR CHANGES IN
BUILDING INSPECTION AND PERMIT FEES;
PROVIDING FOR SEVERABILITY; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1:
That Chapter 8 of Section 8-3 of the Miami Beach City Code be
and the same is hereby amended to read as follows:
SEC. 8-3. Schedule of permit fees.
Permit fees of the building inspection division of the city
are hereby levied and imposed as follows:
(a) DOUBLE FEES:
When work for which a permit is required is commenced prior
to the obtaining of a permit, the fee as speelfled herels; may be

twenty five :cellars f2s799}7 The permit applicant may be required
to pay one hundred dollars ($100. 00) plus a double permit fee. In
no event shall the applicant pay less than one hundred thirty
dollars ($130 . 00) .
The payment of sueh double the required fee shall not relieve
any person, firm or corporation from fully complying with all of
the requirements of all applicable regulations and codes, nor
shall it relieve them from being subject to any of the penalties
therein. The double fee requirements shall be applicable to all
seetless of the bu41d4ng ellvlslen. the Department of Development
Services as noted herein.

(b) REINSPECTION FEES:
When extra inspection trips are necessary due to (1) weeng
incorrect address being given on call for inspection, (2) prior to

rejection of work due to faulty construction (3) work not being
ready for inspection at time specified, (4) failure to call for
final or other inspections, (5) required corrections not being
made or completed at time specified, a fee of twenty-five dollars
($25.00) for each re-inspection may be charged to the permit
holder in the trade concerned. If it is determined by the field
inspector concerned, that the job has the same problem after the
re-inspection fee is assessed and paid, then a second re-
inspection fee of fifty dollars ($50 . 00) shall be charged. The
re-inspection fee requirement shall be applicable to all divisions
of the Building Division.
The payment of re-inspection fees may be required before any
further permits will be issued to the person or firm owing same,
and further inspections may be refused until payment of re-
inspection fees have been made.
Re-inspection of existing buildings by all divisions to determine
compliance with the South Florida Building Code, but not annual
inspections as required by 305.1 (d) , each inspection .

(1) LOST AND REVISED PLANS FEE
(a) Lost Plans: When plans for new buildings and additions are
lost by the owner or contractor, a recertification fee will be
required to review, stamp and approve a new set of plans as a
field copy. Such fee shall be based on 10 percent (10%) of the
original building permit fee, with a minimum fee for Group (Single
Family Residence) of twenty-five dollars ($25. 00) , and a minimum
fee for all others of fifty dollars ($50 . 00) .
(b) Revised Plans Processing Fee: Charge for plans processing of
major revisions to plans which previously were processed and
permitted; such fee to be based on 30 percent (30%) of the
original building permit fee, up to a maximum charge of $150 .00
(minimum fee applies) .
(c) Lost Permit Card Fee: Charge for the loss of a permit

inspection record (and after a permit has been issued) . A
replacement fee of $10 .00 for the loss of each card shall be
charged.
(2) SPECIAL PROJECTS FEE
A fee equal to actual staff time and related costs shall be
assessed for special projects requiring research by the department
in order to answer questions proposed by developers, attorneys,
realtors, etc. , in connection with the use and development of
properties, or to determine if any existing violations are on the
property through a review of departmental records. Such special
fees will be levied only for requests outside the scope of normal
departmental work. A minimum, fee of $20 . 00 shall be charged.
(3) "UP FRONT" PROCESSING FEE
When the building permit application is received, the applicant
shall pay an "up front" processing fee equal to $1.50 for each 100
sq. ft. or fractional part thereof, or $2 . 00 for each $1,000 . 00 of
estimated valuation or fractional part thereof, whichever is
greater.
This processing fee is not refundable, but shall be credited
toward the final building permit fee. "Up-front" processing fee,
after it is calculated, shall be rounded up to the next nearest
$5.00 , minimum fee $25 . 00.
EXISTING SECTION 8-3 (c) IS HEREBY REPEALED AND AMENDED TO READ AS
FOLLOWS:
(c) REFUNDS , TIME LIMITATION, CANCELLATIONS
The fees charged pursuant to this schedule provided the same are
for a permit required by Section 301. 1 of the South Florida
Building Code, may be refunded by the Building Official, subject
to the following:
(1) No refunds shall be made on requests involving
(a) permit fees of $50 . 00 or less or
(b) permit revoked by the Building Official under authority
granted by the South Florida Building Code, or permits

cancelled by a court order, or
(c) permits which have expired; or
(d) permits under which work has commenced as evidenced by
any recorded inspection having been made by the department.
(2) A full refund shall be granted to a permit holder who;
(a) takes out a permit covering work outside the
jurisdictional inspection area.
(3) A full refund less $50 . 00 or 30% of the permit fee, whichever
is greater, rounded to the nearest dollar , shall be granted
to a permit holder who;
(a) requests a refund, provided; (aa) that the permit holder
makes a written request 'prior to the permit expiration date;
and (bb) that the permit holder submits with such request the
applicant' s validated copy of such permit; and (cc) that no
work as evidenced by any recorded inspection has commenced
under such permit.
(4) Where there is a change of contractor involving a permit for
which a fee of more than $50 .00 was paid to the department;
(a) the original permit holder; (aa) is not entitled to any
refund if the permit has expired or if work, as evidenced by
any recorded inspection, has commenced under such permit; or
(bb) is entitled to a full refund where the permit has not
expired and no work, as evidenced by any recorded inspection
has commenced.
(b) the second permit holder; (aa) shall pay a full fee if
the original permit has expired; or (bb) shall pay only
$75 .00 to cover the cost of transferring the date from the
original to the second permit and processing the second
permit in instances where work, as evidenced by any recorded
inspection has commenced under the original unexpired permit;
or (cc) shall pay a full fee plus $75.00 to cover the
transferring and reprocessing costs where no work, as
evidenced by any recorded inspection has commenced under the

original unexpired permit.
(5) A fee of $30.00 shall be paid by the permit holder who
submits a written request for a permit extension as
authorized under Section 304 .3 (b) of the South Florida
Building Code.
(6) Where a permit has become null and void pursuant to paragraph
304 . 3 (a) of the South Florida Building Code, and no work, as
evidenced by at least one recorded inspection has been made
by the department, a credit of fifty percent (50%) of the
original permit covering the same project and involving the
same plans, provided that the complete re-application is made
within six (6) months of the expiration date of the original
permit, and provided that no refund has been made as provided
in this section. The permit re-application must be submitted
with the plans and the applicant ' s validated copy of the
original permit. The amount of this fee shall be at least
equal to or higher than the minimum fee for the trade
concerned.
(7) The Building Official is authorized to charge the fees which
were in existence prior to the effective date of this amended
fee schedule for those sub-contract permits; i .e. ,
electrical, plumbing, mechanical, etc. Where the master
building permit was issued prior to the effective date of
this amended fee schedule, and where written evidence such as
a signed and dated copy of the sub-contract was entered into
prior to the effective date of this amended fee schedule.

(h) PREMISE PERMIT FEES:
The Premise Permit is adopted as outlined
in the South Florida Building Code, Chapter
3 , Section 301. 3 and the following annual
fees are:
(1) CALCULATION OF THE INITIAL PREMISE
PERMIT FEE: Each firm or organization which
obtains an annual premise permit shall include
in their application for such permit the total
number of maintenance personnel including helpers
and trainees thereunder assigned to building,
electrical, plumbing or mechanical work.
The premise fee shall be computed by multi-
plying the total number of such employees
times twenty-five dollars ($25.00) . The mini-
mum premise permit fee shall be five hundred
dollars ($500 . 00) .
(i) CERTIFICATE OF USE AND OCCUPANCY:
In order to obtain a certificate of use and
occupancy as required by Ordinance No. 1891,
City of Miami Beach, the following original
fees shall be paid for the purpose of defraying
the costs of the original necessary zoning
inspection; and the annual renewal fees, as
set forth herein, shall be paid to defray the
cost of periodic zoning inspection that is
necessary due to the nature of the use in order
to determine that the use is being maintained in
compliance with zoning requirements as well as

conditions or restrictions prescribed by zoning
resolutions and the chapter . The renewal fee is

Section 2 : SEVERABILITY.
If any section, sub-section, sentence, clause, phrase or
portion of this Ordinance is , for any reason, held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions of this Ordinance.
Section 3 : REPEALER.
That all Ordinances or parts of Ordinances in conflict
herewith be and the same are hereby repealed.
Section 4 : EFFECTIVE DATE.
This Ordinance shall take effect on October 1st
1984 .
