AN ORDINANCE OF THE CITY OF MIAMI
BEACH, FLORIDA AMENDING ORDINANCE
NO. 1891, THE SAME BEING THE
COMPREHENSIVE ZONING ORDINANCE AND
THE MAPS ATTACHED THERETO BY
EXCLUDING A CERTAIN PARCEL OF LAND
FROM RM -100 MULTIPLE FAMILY MEDIUM
HIGH DENSITY DISTRICT AND INCLUDING
THE SAME IN THE C-4 BUSINESS DISTRICT;
REPEALING ALL ORDINANCES IN CONFLICT
THEREWITH; AND PROVIDING FOR AN
EFFECTIVE DATE. (Moulin Rouge -280 41st St.)
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1: That the following parcel of land:
Lot 29; Block 3; Flamingo Terrace Subdivision; According to the Plat
thereof as recorded in Plat Book 10, at Page 3 of the Public Records of
Dade County, Florida; Less the Following: The northerly seven and one-
half (7%2) feet of said Lot 29, and also that portion of the said Lot
Twenty-nine (29), bounded as follows: Commence at the northeasterly
corner of said Lot Twenty-nine (29); thence run in a westerly direction
along the northerly line of said Lot Twenty-nine (29) a distance of sixty-
five (65) feet to a point; thence deflecting to the left ninety (90) degrees
running in a Southerly direction seven and one-half (7%2) feet to the point
of beginning of tract of land herein described. From said point of
beginning run in an easterly direction along a line parallel to the
northerly line of said Lot Twenty-nine (29) for a distance of sixty-five
(65) feet, more or less to a point on the easterly line of said Lot Twenty-
nine (29) to a point, which is fifteen (15) feet southerly of the northerly
line of Lot Twenty-nine (29), measured at right angles to said northerly
line of Lot Twenty-nine (29); thence westerly along a line for a distance
of sixty-five (65) feet, more or less, to the point of beginning; as said lot,
block and subdivision are shown on Plat recorded in Plat Book 10, Page 3,
of the Public Records of Dade County, Florida, and
be and the sarne is hereby excluded from the RM -100 Multiple Family Medium High
Density District and included in the C-4 Business District as said districts are defined and
set forth in Zoning Ordinance No. 1891. The Area District for this parcel, which
determines front and rear yard setback, is to remain MF -8.
SECTION 2: All Ordinances or parts of Ordinances in conflict herewith be and the
same are hereby repealed.
SECTION 3: SEVERABILITY. If any section, sub -section, sentence, clause, phrase, or
portion of this Ordinance is, for any reason, held invalid or
unconstitutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and such
hold shall not affect the validity of the remaining portions of this
Ordinance.
SECTION 4: EFFECTIVE DATE
ATTEST:
This Ordinance shall take effect 10 days after adoption, on
July 31 , 1982.
