Ordinance 91-2762 ORDINANCE NO. 91-2762 AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE CHAPTER 14A, ENTITLED "WASTE REMOVAL", AMENDING SECTION 14A-3, ENTITLED "GARBAGE COLLECTION SERVICE - MANDATORY" BY PROVIDING THAT OWNERS OF TOWNHOUSES MAY ELECT TO HAVE THEIR GARBAGE COLLECTED BY FRANCHISE WASTE CONTRACTORS INSTEAD OF BY THE CITY; AMENDING SECTION 14A-28, ENTITLED "SCHEDULE OF FEES FOR CITY COLLECTION AND DISPOSAL OF GARBAGE AND TRASH" BY REVISING THE FEES CHARGED BY THE CITY FOR COLLECTION AND DISPOSAL OF GARBAGE 2ND TRASH FROM SI:GLE-FAMILY RESIDENCES, TOWNHOUSES, DUPLEXES, APARTMENTS AND CONDOMINIUMS WITH LESS THAN NINE DWELLING UNITS WHICH UTILIZE CITY GARBAGE AND TRASH COLLECTION SERVICE; PROVIDING FOR SEVERABILITY; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Administration has advised the City Commission that private waste contractors franchised by the City can provide satisfactory and efficient garbage and trash collection and disposal service for townhouses within the City of Miami Beach; and WHEREAS, the City Commission wishes to provide each townhouse owner within the City with the .ppui t unity to elect to utilize either City or private garbage and trash collection and disposal services; and WHEREAS, the Administration has advised the City Commission that fees charged to the City by Metropolitan Dade County in connection with the dumping of garbage and trash collected by the City are being increased by $12 . 00 per ton as of October 1, 1991; and WHEREAS, the Administration has recommended to the City Commission that the increase in dumping costs be passed through to City residents generating garbage and trash which is collected for disposal by the City; and WHEREAS, the City Commission believes that the provisions contained herein will serve the health, safety and welfare of the residents of the City of Miami Beach, Florida. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: (c) Apartments, Condominiums $22 . 41 $20. 91 with less than nine Dwelling Units per month per Dwelling Unit The charges, rates and terms for Commercial Establishments will be established and agreed to by contract between the Licensee and Hotel, Rooming House, office, Restaurant or other Commercial Establishment. The City Manager, shall have the authority to adjust base fEcas upwards or downwards, as the case may be, wYiere, in particular instances, the accumulation of refuse exceeds or falls below that for which the base fee is established. Section 3. Severability. If any section, sentence, clause or phrase of this Ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portion of this Ordinance. Section 4. Repealer. All ordinances or parts in conflict herewith be and the same are hereby repealed. Section 5. Effective Date. This Ordinance shall take effect ten (10) days after its adoption on the 19th day of October , 1991. Staff has reviewed this matter and recommends the amendment as requested be approved. As indicated in the attached notification dated August 1, 1991, Miami-Dade will increase disposal charges from $33 per ton to $45 per ton maintaining the additional $9 . 00 transfer station surcharge. You' ll note the letter indicates an average $10 per ton increase which includes provisions for yard waste, however the real increase for regular garbage disposal is $12 per ton. The City provides services to approximately 8, 506 residential units and picks up approximately 1, 000 tons per month. This equates to a cost increase of slightly less than $1. 50 per residential unit per month. ADMINISTRATION RECOMMENDATION: The Administration recommends adoption of the attached ordinance for a garbage disposal rate increase sufficient to cover the Metro-Dade increase effective October 1, 1991, and providing an option for town house owners to utilize either City or private garbage collection services. That Section 14A-3 of Miami Beach City Code Chapter 14A, entitled "Waste Removal" is hereby amended to read as follows: Sec. 14A-3. Garbage collection services - mandatory. A. Each occupied Dwelling or Commercial Establishment in the City of Miami Beach is required to have a Garbage collection service, City or private, and Garbage Facilities approved by the City Manager. B. Collection by City. Except as provided elsewhere herein, all Garbage, Trash or Waste generated by Single Family Residences and Multi Family Residences of eight (8) units or less shall be collected, conveyed and disposed of by the City. Such service shall be accomplished by use of City employees, by use of the services of Single Family Waste Contractors or by a combination of both methods. C. Collection by private collectors. All Garbage, Trash, or Waste accumulated in the City by Commercial Establishments, industrial uses, Hotels, Rooming Houses and by Owners, Occupants, or residents of Multi Family Residences of nine Dwelling Units or more shall be collected, conveyed and disposed of by Franchise Waste Contractors licensed pursuant to section 14A-16 of this chapter. Owners and Operators of Townhouses and Multi Family Residences of eight Dwelling Units or less may alternatively elect to use a Franchise Waste Contractor instead of collection by the City; such Owners or Operators shall notify the City Manager in writing of said election.
