AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA AMENDING §20-27, §20-
14(a) AND §20-19(12) OF THE MIAMI BEACH CITY
CODE, PROVIDING FOR SERVICE BY CERTIFIED MAIL OF
NOTICE OF VIOLATION; PROVIDING ANNUAL LICENSE
FEES FOR RESIDENTIAL LANDLORDS AND FOR PARKING
LOTS ACCORDING TO FEE SCHEDULE; PROVIDING FOR
SEVERABILITY; REPEALING ALL ORDINANCES IN CON-
FLICT HEREWITH; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1
Section 20- 14(a) of the Miami Beach City Code is hereby amended to
read as follows:
Sec. 20-14(a). Licensing of Residential Land-
lords
(a) License required; fee:
All persons engaged in the business of renting
three or more dwelling units for residential
purposes, as defined by §83.43(s), Florida
Statutes (1981), shall obtain a license
pursuant to this Article, upon payment of an
annual fee as provided for in Section 20-11 of
this Article of $1257e9. Failure to obtain a
license required by this section shall result in
penalties as specified by this Chapter.
SECTION 2
Section 20-19(12) of the Miami Beach City Code is hereby amended to
read as follows:
Sec. 20-19. Parking lot, definitions, appli-
cability.
(12) Fees. The annual parking lot license fees
shall be x$199-99 as provided for in Section 20-
11 of this Article.
SECTION 3 LEGISLATIVE PURPOSE
Section 20-27 of the Miami Beach City Code is hereby amended to read
as follows:
Sec. 20-27. Notice of violation; emergency ac-
tion.
If the City Manager believes that a li-
censee has engaged or is engaged in conduct war-
ranting the suspension or revocation of a li-
cense, he shall notify the licensee by certified
mail or hand delivery of the violation and pro-
vide a prior administrative hearing pursuant to
§20-22, unless the City Manager finds that an
emergency condition exists involving serious
danger to public health, safety or welfare, in
which case advance notice and hearing shall not
be required. In the case of an emergency sus-
pension or revocation, the licensee shall im-
mediately be advised of the City Manager's
action and afforded a prompt post -suspension or

revocation hearing in accordance with §20-29 of
of this article.
The notice shall be in writing and shall set
forth the particulars of the violation and shall
state the things required to be done to elimi-
nate the violation if any. Service of such no-
tice shall be by certified mail7 or hand deli-
very, addressed to the licensee at his business
address, as disclosed in his application for the
license.
SECTION 4 REPEALER
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 5 SEVERABILITY
If any article, section, subsection, sentence, clause, phrase, or
portion of this ordinance is, for any reason, held invalid or un-
constitutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not effect the validity of the remaining portions
of this ordinance.
SECTION 6 EFFECTIVE DATE
This ordinance shall take effect ten (10) days after adoption in
accordance with law, on September 25 , 1982_
