AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE
CHAPTER 2 , SECTION 2-6, ENTITLED "ENUMERATION OF
ORGANIZATIONAL UNITS"; SAID AMENDMENT PROVIDING FOR THE
CREATION OF: THE SANITATION DEPARTMENT; THE CONSTRUCTION
AND FINANCIAL MANAGEMENT DIVISION WITHIN THE PUBLIC WORKS
DEPARTMENT; THE ADMINISTRATION DIVISION WITHIN THE
DEPARTMENT OF GENERAL SERVICES; THE ADMINISTRATION
DIVISION WITHIN THE DEPARTMENT OF RECREATION, CULTURE,
AND PARKS; THE REDESIGNATION OF: THE CODE ENFORCEMENT
DIVISION WITHIN THE BUILDING SERVICES DEPARTMENT; THE
LEGAL DEPARTMENT AS THE OFFICE OF THE CITY ATTORNEY; AND
THE PERSONNEL DEPARTMENT AS THE HUMAN RESOURCES
DEPARTMENT; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, there currently exists various organizational units
and departments in the City, and there is a need to make
modifications to the existing Administrative structure; and
WHEREAS, the following changes reflect the current state of
such units .
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
that the City of Miami Beach, Florida:
SECTION 1 : That Section 2-6 of Miami Beach City Code Chapter
2 , entitled "Administration" is hereby amended to read as follows
Sec. 2-6. Enumeration of organizational units.
The administrative or organizational units of the City
which are hereby created shall be as follows:

SECTION 2 . REPEALER
All ordinances or parts of Ordinances in conflict herewith be
and are hereby repealed.
SECTION 3 . SEVERABILITY
If any section, subsection, clause or provision of this
Ordinance is held to be invalid, the remainder shall not be
affected by such invalidity.
SECTION 4 . EFFECTIVE DATE
This Ordinance shall take effect on October 1, 1993 after its
adoption on 22nd day of September, 1993.

RECOMMENDATION
The Administration recommends that the City Commission adopt on
second and final reading, the attached Ordinance amending Miami
Beach City Code Chapter 2 Section 2-6, entitled "Enumeration of
organizational units" providing for the creation of a Sanitation
Department; a Construction and Financial Management Division within
the Public Works Department; the Administration Divisions within
the Departments of General Services, and Recreation, Culture, and
Parks; and the redesignation of the Code Enforcement Division
within the Building Services Department, the Legal Department, and
the Personnel Department.
First reading of the ordinance was held on September 8, 1993. It
should be noted that adoption of this ordinance is crucial to the
implementation of the Fiscal Year (FY) 1993-94 Budget.
BACKGROUND
Several organization wide changes have been recommended in the FY
1993-94 Proposed Budget, a summary of which follows:
• Creation of a Sanitation Department is necessary to
accomplish the goals established for a "cleaner City. "
• Formation of the Construction and Financial Management
Division within the Department of Public Works responds
to the recognized need to accurately monitor and manage
all construction projects to eliminate unnecessary cost
overruns.

• Establishment of Administration Divisions within the
Departments of General Services, and Recreation, Culture,
and Parks is needed to properly reflect the
organizational structure and appropriations assigned to
these divisions.
• Redesignation of the Code Enforcement Division to the
Code Compliance Division is proposed as it more
accurately depicts this function.
• Redesignation of the Legal Department to the Office of
the City Attorney responds to a request from the City
Attorney. This title is consistent with other Charter
Officer departments.
• Redesignation of the Personnel Department to the Human
Resources Department is recommended as it portrays the broad
range of services provided to employees, retirees, and
applicants.
PROCEDURE
Miami Beach City Code, Chapter 2 Section 2-6 provides for the
enumeration of organizational units, administrative officers,
agencies and their units.
In order to accurately reflect proposed structural changes to the
organization, it is appropriate that Chapter 2 Section 2-6 of the
Code be amended such that it will coincide with the beginning of
the budget year on October 1, 1993 .
