AN ORDINANCE OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING
THE MIAMI BEACH CITY CODE CREATING CITY CODE
CHAPTER 15B ENTITLED "HEALTH ADVISORY BOARD"
BY ESTABLISHING SAID BOARD, PROVIDING FOR
COMPOSITION OF BOARD, PROVIDING FOR CITY
MANAGER APPOINTMENT, AND PROVIDING FOR TERM OF
SERVICE; PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEALER; AND PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1.
The Miami Beach City Code is hereby amended by the creation of
City Code Chapter 15B entitled "Health Advisory Board" , said
Chapter to read as follows:
Chapter 15B. "Health Advisory Board".
Section 15B-1. Purpose. There shall be a Health
Advisory Board that will hold regular meetings to review
and advise the Administration and the Commission of all
matters that relate to the health, welfare, and safety of
the citizens of Miami Beach.
Section 15B-2 . Composition; Appointments; and Term of
Office. The composition of the Board shall consist of
Administrators of local hospitals, an administrator from
an ACLF, a representative from the nursing profession,
two (2) citizens who are health providers, and three (3)
consumers. There shall be ex officio a representative
from the Social Services Department, a representative
from the Police Department, and a representative from the
Fire Rescue Department. These appointments shall be made
by the City Manager for a period not to exceed two (2)
Years.
SECTION 2 . REPEALER
All ordinances or parts of ordinances in conflict herewith be
and the same are hereby repealed.
SECTION 3 . SEVERABILITY
If any section, sentence, clause or phrase of this ordinance
is held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the validity
of the remaining portions of this ordinance.
SECTION 4 . EFFECTIVE DATE
This ordinance shall take effect ten (10) days after its
adoption, on December 10, 1993 .

SUBJECT: HOUSEKEEPING: CREATION OF MIAMI BEACH CITY CODE CHAPTER
15B INCORPORATING "HEALTH ADVISORY BOARD" PROVISIONS
Pursuant to the November 2 , 1993 Special Election of the
City of Miami Beach, the City's electorate approved a ballot
question transferring Charter provisions governing the City of
Miami Beach Health Advisory Board into the Miami Beach City Code.
Accordingly, the attached Ordinance has been prepared as a
housekeeping matter for purposes of effectuating the referendum
directive of removing Health Advisory Board language out of the
Charter and placement thereof into the Miami Beach City Code. The
Health Advisory Board sections shall be codified in a newly-created
Code Chapter 15B.
Once the attached Ordinance is passed on second reading,
the Administration will be proposing further changes to newly-
created Chapter 15B including the following amendments:
- Designating Chapter 15B's body as a "Health
Advisory Committee" ;
- Authorizing the Committee to review health-related
matters of City of Miami Beach government;
Limiting membership to (2) concurrent terms; and
- Providing for a nine (9) membership Committee
encompassing: three (3) members from administrators
from local hospitals; one (1) member from an ACLF;
one (1) member from the nursing profession; two (2)
members from health insurance providers; and two
(2) consumers.
There will also be ex officio representation of the Florida
Department of Health and Rehabilitative Services, South Florida
Health System Agency and of City of Miami Beach Police and Fire
Rescue Departments.
