AN ORDINANCE OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING
MIAMI BEACH CITY CODE CHAPTER 2 , ARTICLE III
THEREOF ENTITLED "STANDARDS OF CONDUCT FOR
CITY OFFICERS AND EMPLOYEES" BY CREATING CITY
CODE SECTION 2-43 . 1 ENTITLED "RESTRICTION ON
APPOINTMENT AND EMPLOYMENT OF CITY COMMISSION
RELATIVES" BY ESTABLISHING AN ANTI-NEPOTISM
POLICY OF THE CITY PROVIDING THAT NO RELATIVE
OF ANY MEMBER OF THE MIAMI BEACH CITY
COMMISSION MAY BE APPOINTED, EMPLOYED,
PROMOTED, OR ADVANCED IN OR TO A POSITION
WITHIN THE CITY OF MIAMI BEACH IF THE CITY
COMMISSION EXERCISES "JURISDICTION" OR CONTROL
OVER SAID APPOINTMENT, EMPLOYMENT, PROMOTION,
OR ADVANCEMENT; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEALER; AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1.
Miami Beach City Code Chapter 2 Article III thereof entitled
"Standards of Conduct for City Officers and Employees" is hereby
amended by the creation of Section 2-43 . 1 entitled "Restriction on
Employment and Appointment of City Commission Relatives" , said
section to read as follows:
Section 2-43 . 1 "Restriction on Employment and
Appointment of City Commission Relatives"
( 1) No relative of any member of the Miami
Beach City Commission may be appointed,
employed, promoted, or advanced in or to a
position in the City of Miami Beach if the
City Commission exercises jurisdiction or
control over said appointment, employment,
promotion, or advancement .
(2) "Relative" shall be defined as an
individual who is related to any member of the
Miami Beach City Commission as father, mother,
son, daughter, brother, sister, uncle, aunt,
first cousin, nephew, niece, husband, wife,
father-in-law, mother-in-law, son-in-law,
daughter-in-law, brother-in-law, sister-in-
law, step father, step mother, step son, step
daughter, step brother, step sister, half
brother or half sister.
SECTION 2 . REPEALER
All Ordinances or parts of ordinances in conflict herewith be
and the same are hereby repealed.
SECTION 3 . SEVERABILITY
If any section, sentence, clause or phrase of this ordinance is
held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the validity
of the remaining portions of this ordinance.
SECTION 4. EFFECTIVE DATE
This ordinance shall take effect ten (10) days after its adoption,
on March 26 , 1994 .

SUBJECT: ORDINANCE ESTABLISHING ANTI-NEPOTISM POLICY OF THE CITY
OF MIAMI BEACH
Pursuant to City Commission directive of November 17 ,
1993, the attached proposed "Anti-Nepotism Ordinance" was presented
to a joint meeting of the Community Affairs Committee and the Rules
and Special Events Committee. Subsequent to a full discussion
thereon, the joint committees voted on this matter resulting
in a
recommendation that the City Commission adopt the proposed
Ordinance.
