AN ORDINANCE OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING
MIAMI BEACH CITY CODE CHAPTER 9B, ENTITLED
"CODE ENFORCEMENT" BY ABOLISHING THE CITY' S
CODE ENFORCEMENT BOARD AS OF APRIL 16, 1994,
AND PROVIDING THAT THEREAFTER ANY OF THE
BOARD' S CASES WHICH ARE STILL OPEN SHALL BE
ASSIGNED TO THE CITY'S SPECIAL MASTERS;
PROVIDING FOR REPEALER, SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS, on December 26 , 1992 the Mayor and City Commission of
the City of Miami Beach enacted Ordinance No. 92-2828 providing
that after February 1, 1993 new cases involving violations of the
City' s codes and ordinances would be adjudicated by the City' s
special masters, and that the City' s Code Enforcement Board would
retain jurisdiction over its existing cases and unsatisfied liens;
and
WHEREAS, many of the Code Enforcement Board cases which were
open as of February 1, 1993 are now closed and only a small number
of cases remain open; and
WHEREAS, it would be more economical and efficient to abolish
the Code Enforcement Board and assign the remaining open cases
previously heard by the Board to the City' s special masters, on a
rotation basis .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA:
Section 1 . Amendment of City Code Section 9B-5 .
That Section 9B-5 of Miami Beach City Code Chapter 9B,
entitled "Code Enforcement" is hereby amended to read as follows :
Sec. 9B-5 . Code Enforcement Board; organization.
abolished.
As of April 16 , 1994 , the Code Enforcement Board is
abolished and any cases under the Board' s jurisdiction which remain
open as of that date shall be assigned to the City' s Special
Masters on a rotation basis . After April 16, 1994 all references
to the Code Enforcement Board contained in this Chapter shall be
deemed to pertain to the City' s Special Masters . shall be
authorized to cnforcc the City' s codes and ordinances including
hcrcaftcr granted by the Miami Beach City Commission, Zoning Board
of Adjustment, Planning Board, Property Maintenance Standards
App ale Board or other like Boards . After February 1, 1993 , thc
Codc Enforcement Board Shall cease to h ar new casco; however, the
Board which remain open and over all unsatisfied liens impooed by
(7) members appointed by a majority vote of thc City Commission for
three (3) year terms . Membcr3 of the Codc Enforccmcnt Board shall
be rccidcnt3 of the City of Miami B ach.
Appointments shall be made on the basis of experience or
interest in the field of zoning and building control . The
include an architect, a businessman or businesswoman, an engineer,
a general contractor, a subcontractor, and a rcaltor but shall not
(b) Members of the current code enforcement board appointed
under former city code chapter 9B shall serve out the remainder of
their current terms . Upon expiration of said terms, subccquent
appointments for three years shall be made . Any member may be
reappointed by the city commission. Appointments to fill a vacancy
shall be for the remainder of the unexpired term. Any member who
without prior approval of the chairman shall automatically forfeit
his appointment, and the city commission shall promptly fill such
vacancy for the remainder of the term.
Section 2 . Repealer.
All ordinances or parts of ordinances in conflict herewith be
and the same are hereby repealed.
Section 3 . Severability.
If any section subsection, clause or provision of this
Ordinance is held invalid, the remainder shall not be affected by
such invalidity.

Section 4 . Effective Date.
This Ordinance shall take effect on the 16th day of
April , 1994 .

SUBJECT: ORDINANCE ABOLISHING THE CODE ENFORCEMENT BOARD
RECOMMENDATION:
The Administration and the City Attorney recommend that the City
Commission adopt the attached Ordinance abolishing the Code
Enforcement Board as of April 15, 1994 and transfer any remaining
old cases and lien settlements relating to such cases to the City's
Special Master System.
BACKGROUND:
Mayor Gelber had requested that the City Attorney's Office draft
the aforementioned Ordinance abolishing the City's Code Enforcement
Board. On December 26, 1992 the City Commission enacted Ordinance
No. 92-2828 which provided that, after February 1, 1993 the Board
would not hear new cases but would retain jurisdiction over its
existing cases and unsatisfied liens. Since February 1, 1993 new
cases involving violations of City Code have been heard by the
City's special masters. The Code Enforcement Board has met
approximately every other month to settle fines and liens relating
to old cases. The attached Ordinance would abolish the Code
Enforcement Board as of April 15, 1994, and transfer any remaining
old cases and lien settlements relating to such cases to the City' s
Special Master System.

ANALYSIS:
The transition from a Code Enforcement Board system to a Special Master
System has been gradual beginning on February 1, 1993 , when the Special
Masters began hearing all new code violation cases. The Special Master
System has proven to be the more efficient and expeditious system.
Additionally, the use of Special Masters who do not own properties in Miami
Beach or have political or social ties to the Miami Beach community has
helped to free the system of any appearance of conflicts of interest and has
resulted in an impartial professional method of adjudicating code violations.
Many of the Code Enforcement Board's cases which were still open due to non-
compliance are in compliance and remaining open cases and settlements
regarding unpaid fines or liens on such cases may be resolved by a Special
Master; therefore, it would be most efficient to abolish the Board and
transfer any such open cases and settlements to the Special Master System.
CONCLUSION:
The Administration and the City Attorney recommends that the City Commission
adopt the attached Ordinance.
