AN ORDINANCE OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING
MIAMI BEACH CITY CODE CHAPTER 2, ENTITLED
"ADMINISTRATION" BY ADDITION OF SECTION
2 . 1 .2 .1 . PROVIDING THAT CITY BOARD OR
COMMITTEE MEMBERS WHO HAVE THREE ABSENCES FROM
DULY CALLED MEETINGS WITHIN A CALENDAR YEAR
WITHOUT SUFFICIENT CAUSE SHALL BE
AUTOMATICALLY REMOVED FROM MEMBERSHIP ON THE
BOARD OR COMMITTEE; PROVIDING FOR REPEALER,
SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, the City Commission believes that in order for City
boards and committees to properly perform their functions and
fulfill their duties, it is necessary that all members of such
boards and committees attend meetings on a regular basis .
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1 . ADDITION OF SECTION 2 . 1 .2 .1 .
That Miami Beach City Code Chapter 2 , entitled
"Administration" is hereby amended by addition of Section 2 . 1 . 2 . 1 .
to read as follows :
2 . 1 .2 .1 . Board and Committee members - Removal for excessive
absences.
a) It shall be a condition of appointment to and
continued membership on city boards and committees that three
absences within a calendar year without good and sufficient
cause therefor by any member of the board or committee from
duly held or called meetings of said board or committee, shall
result in the automatic removal of such member from that board
or committee .
b) Each board and committee shall establish standards
as to what causes for absence shall be deemed good and
sufficient . When a board or committee member has exceeded
three absences without sufficient cause in a calendar year the
City Clerk shall send a letter notifying the member of his/her
removal . Such removal shall create a vacancy in the
membership which shall bee filled in the same manner as the
original appointment , or according to the governing
legislation if an alternative method is provided.
SECTION 2 . REPEALER.
All ordinances or parts of ordinances and parts of resolutions
in conflict herewith be and the same are hereby repealed.
SECTION 3 . SEVERABILITY.
If any section, subsection, clause or provision of this
Ordinance is held invalid, the remainder shall not be affected by
such invalidity.
SECTION 4 . EFFECTIVE DATE.
This Ordinance shall take effect on the 30th day of
April , 1994 .

SUBJECT: ORDINANCE PROVIDING FOR AUTOMATIC REMOVAL OF BOARD AND
COMMITTEE MEMBERS WITH THREE ABSENCES WITHOUT SUFFICIENT
CAUSE FROM MEETINGS WITHIN A CALENDAR YEAR.
Commissioner David Pearlson requested the attached ordinance
which provides that City board and committee members who are absent
from duly called meetings without sufficient cause three times in
a calendar year shall be automatically removed from those boards
and committees . This ordinance repeals and replaces a provision of
current Resolution No. 92-20514 which provided for such removal
only if the three absences were successive. The ordinance will
also repeal and replace similar provisions in other ordinances and
resolutions creating City boards and committees, except that boards
created by the Zoning Ordinance and certain boards created by the
City' s Related Laws will not be affected by this Ordinance . Our
office is working with the Planning Board regarding similar
provisions for Zoning Ordinance boards . We are also determining
what legislation is needed to make this provision applicable to
individual boards created by the Related Laws .
This Ordinance received a favorable recommendation from the
Rules and Special Events Committee.
