AN ORDINANCE OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING
COMPREHENSIVE ZONING ORDINANCE NO. 89-2665,
AMENDING SECTION 7, ENTITLED "PARKING
REGULATIONS" , AMENDING SUBSECTION 7-2
ENTITLED "OFF-STREET PARKING REQUIRED" BY
MODIFYING THE PARKING REQUIREMENT FOR SUITES
HOTEL UNITS; PROVIDING FOR INCLUSION IN THE
ZONING ORDINANCE; PROVIDING FOR REPEALER,
SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, Subsection 6-22 of the Miami Beach Zoning Ordinance
defines suites hotel units as those hotel units containing
cooking facilities; and
WHEREAS, suites hotel units, when of a certain size,
generate higher parking demand than other types of hotel units;
and
WHEREAS, the Mayor and City Commission wish to ensure that
there is adequate parking provided for new construction of suites
hotels; and
WHEREAS, an amendment to the existing Zoning Ordinance is
necessary to effectuate this objective.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. That Subsection 7-2 , of Section 7, entitled "Parking
Regulations" of Zoning Ordinance 89-2665 of the City of Miami
Beach, Florida is hereby amended as follows:

1/2 spaces per unit. Required parking for hotel
accessory uses shall be as follows:
a. Retail- Required parking shall be computed
at 1 space per 400 sq. ft. , minus 7 . 5 sq. ft.
per unit.
b. Auditorium, Ballroom, Convention Hall ,
Gymnasium, Meeting Rooms or other similar
places of assembly- Required parking shall
be 1 space per 4 seats or 1 space per 60
sq. ft. of floor area where there is no
seating, minus 1 seat or 15 sq. ft. per unit.
c. Restaurant or other establishment for
consumption of food or beverages on the
premises- Required parking shall be 1 space
per 4 seats minus 1 seat for every 2 units.
d. Required parking for all other uses shall be
as set forth in this Subsection.

These parking requirements for hotel accessory
uses are only applicable to structures that are
being newly constructed or substantially
rehabilitated as hotels.
The Zoning Board of Adjustment may grant a
variance for the total amount of parking required
for a hotel and related accessory uses by up to
20%.
SECTION 2. INCLUSION IN ZONING ORDINANCE NO. 89-2665. It is
the intention of the City Commission, and it is hereby ordained
that the provisions of this ordinance shall become and he made
part of the City of Miami Beach Zoning Ordinance No. 89-2665 as
amended; that the sections of this ordinance may be renumbered or
relettered to accomplish such intention; and that the word
"ordinance" may be changed to "section" or other appropriate
word.
SECTION 3. REPEALER. That all Ordinances or parts of
Ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 4. SEVERABILITY. If any section, subsection, clause
or provision of this Ordinance is held invalid, the remainder
shall not be affected by such invalidity.
SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect
on the 7th day of August 1994 .

RECOMMENDATION
The Administration recommends that the City Commission, upon hold a public hearing, approve on second
reading, the proposed amendment. also be a public hearing. The date should be on July 27, 1994.
BACKGROUND
The City of Miami Beach has historically prohibited the installation of both limited and full cooking facilities
within hotel rooms except for those hotel units that arc of sufficient size to meet the parameters of the
definition within the current Zoning Ordinance as a hotel suite . These suites hotel units were designated for
transient occupants who might require the need for limited or full cooking facilities within their hotel rooms
while visiting within the City. Suites hotel rooms as defined within the current Zoning Ordinance are not
intended to be utilized as a permanent residence and the building within which these units are located is
required to be operated as a hotel with lobby and front desk.
ANALYSIS
The current parking requirement for a suites hotel room is one (1) space per hotel unit as opposed to an
apartment unit which requires one and one half (1.5) parking spaces per apartment unit. Since larger suites
hotel units which have 550 square feet or more of floor area and which contain full cooking facilities
typically generate a higher parking demand than regular hotel units without cooking facilities or smaller
suites hotel units with limited cooking facilities,the proposed amendment is necessary to ensure that adequate
parking facilities are provided for this type of hotel unit. The proposed amendment increases the parking
requirement only for suites hotel units that are 550 sq. ft. or greater in floor area and that have full cooking
facilities to the same requirement for apartment units, (1.5 spaces). This requirement would apply to both
major rehabilitation of existing buildings, as well as for new construction projects.
CONCLUSION
Based on the foregoing, the Administration has concluded that the proposed amendments are necessary to
encourage the construction of required parking spaces for new construction and major rehabilitation
development of certain suites hotel units, as defined herein, and therefore, that the City Commission should
adopt said amendments on second reading.
