Ordinance 95-2971 ORDINANCE NO: 95-2971 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE CHAPTER 2, SECTION 2-6, ENTITLED "ENUMERATION OF ORGANIZATIONAL UNITS" PROVIDING FOR THE CREATION OF: THE CONSTRUCTION MANAGEMENT DIVISION WITHIN THE DEPARTMENT OF GENERAL SERVICES; PROVIDING FOR THE NAME CHANGE OF: PROPERTY MAINTENANCE, MECHANICAL MAINTENANCE, AND PURCHASING DIVISIONS WITHIN THE DEPARTMENT OF GENERAL SERVICES TO PROPERTY MANAGEMENT, FLEET MANAGEMENT AND PROCUREMENT;REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,there currently exists various organizational units and departments in the City, and there is a need to make modifications to the existing Administrative structure; and WHEREAS,the following changes reflect the current state of such units. NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION that the City of Miami Beach, Florida: SECTION 1: That Section 2-6 of the Miami Beach City Code Chapter 2, entitled "Administration" is hereby amended to read as follows: Sec. 2-6. RECOMMENDATION The Administration recommends that the City Commission adopt on the second reading,the attached Ordinance amending Miami Beach City Code Chapter 2 Section 2-6, entitled "Enumeration of organizational units" providing for the creation of the Construction Management Division providing for the name change of Property Maintenance, Mechanical Maintenance and Purchasing within the Department of General Services to Property Management, Fleet Management and Procurement,respectively. (See Exhibit "A") BACKGROUND The Ordiance was approved on the first reading January 4, 1995. Due to the number of construction projects currently in progress or proposed in the near future, a construction management function was included in the General Services Administration Division for the FY 94/95 Adopted Budget. Funding for this function is provided from direct allocation charges to capital projects and as a result does not impact the General Fund. AGENDA ITEM F -3 DATE 18-95 • 3 The increased importance and focus of the capital projects function require separate accountability. As a result, it is proposed that the capital projects function be transferred from the Administrative Division to a newly created Construction Management Division within the General Services Department. This organizational change has no budgetary impact. The Construction Management Division, within the General Services Department,would be responsible for the management and control of building construction projects, environmental issues and real estate as follows: A. Building Construction: • Authorize and monitor the work of Architectural/Engineering Consultants and Contractors engaged in the design and construction of City buildings, parks and other facilities. Water, sewer,roads and drainage projects will remain under the responsibility of the Public Works Department,which is comprised of the Administration, Engineering, and Streets and Streetlights Divisions in the General Fund and the Water, Sewer, and Storm Water Divisions in the Enterprise Fund. ► GSA Projects - direct and lead planning,design, construction management, renovation and warranty administration activities. • Establish, manage and controLproject budgets and schedules to deliver quality facilities on time and within budget. ► Non-GSA Projects -provide support and consultation, as requested by the responsible Department, during all project phases or as specifically requested. • Major projects included in the FY 94/95 Capital Budget for which funding will be available and which will be initiated, advanced or completed during FY 94/95 are: ► Bass Museum of Arts Renovation and Expansion- $ 8.0 million • Ocean Front Auditorium Renovation- $ 1.5 million ► Garden Center Renovation and Dade Canal Improvements - $ 2.0 million • City Hall Renovation- $400,000 ► Seawall Restoration- funding undetermined • Additionally, the recently approved $15.0 million Parks Bond Issue will encompass approximately 25 projects at various sites, from renovations and miscellaneous improvements to additions and new construction. • Other carryover projects presently at different stages of development include: • Ballet Valet Garage • 13th Street Garage Expansion • 10th Street Garage 3 • Other carryover projects... (con't) • Convention Center Garage Renovation ► Flamingo Park Parking Lot ► Police Building Garage Expansion ► North Shore Park Improvements B. Environmental: • Administer environmental issues as they relate to City facilities, structures and real estate to ensure compliance with federal, state and local regulations. • Monitor proposed environmental legislation and evaluate impact on established City programs and standards to ensure timely compliance with new environmental regulations. Current environmental issues include underground tanks, asbestos surveys and removal,real estate audits, subsurface contamination assessments and cleanup, and regulatory reporting and compliance. C. Real Estate: • Coordinate the acquisition and sale of real estate, other than Redevelopment Agency projects where support and assistance will be provided. • The advantages to establishing a Construction Management Division include: • Standardization of Policies and Procedures. • Eliminate Duplicate Efforts. • Ability to Incorporate "Lessons Learned" in future projects. • Provide consistent approach to the administration of Architectural,Engineering and Construction contracts. • Streamline project development processes and handling of routine matters. • Centralized budget and schedule control. • Coordinated handling of environmental and other regulatory issues. • Coordinated real estate activities. The change of names to three Divisions,within the General Services Department,will provide for more acceptable and recognizable names and will be consistent with City, County and State designations as follows: • Property Maintenance Division to Property Management Division • Mechanical Maintenance Division to Fleet Management Division • Purchasing Division to Procurement Division PROCEDURE Miami Beach City Code, Chapter 2 Section 2-6 provides for the enumeration of organizational units, administrative officers, agencies and their units.
