COMPREHENSIVE ZONING ORDINANCE NO. 89-2665 BY
REZONING ALL PROPERTIES LOCATED ON THE WEST
SIDE OF COLLINS AVENUE BETWEEN 75TH AND 76TH
STREETS, COLLECTIVELY HAVING THE LEGAL
DESCRIPTION OF LOTS 1-3, BLOCK 24,OF THE
CORRECTED PLAT OF ALTOS DEL MAR, NUMBER 1 •
SUBDIVISION, AS RECORDED IN PLAT BOOK 31, PAGE
40 OF THE PUBLIC RECORDS OF DADE COUNTY,
FLORIDA, FROM THE CURRENT RM-2, RESIDENTIAL
MULTI FAMILY, MEDIUM INTENSITY ZONING DISTRICT
CLASSIFICATION TO RM-1, RESIDENTIAL MULTI
FAMILY, LOW INTENSITY; AMENDING THE AFFECTED
PORTIONS OF THE CITY' S ZONING DISTRICT MAP TO
CORRESPOND WITH THESE CHANGES; PROVIDING FOR A
REPEALER AND AN EFFECTIVE DATE.
WHEREAS, the City of Miami Beach has undertaken a
comprehensive review to study development regulations in several
areas within the Municipality; and
WHEREAS, amending the zoning of the properties on the west
side of Collins Avenue between 75th and 76th Streets is necessary
to insure that development of those properties will be compatible
with development in the Altos Del Mar Local Historic District
immediately to the east and with the low-rise development which
currently exists throughout the surrounding area .
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1 . AMENDMENT OF ZONING DISTRICTS AND MAP OF
COMPREHENSIVE ZONING ORDINANCE.
That the Mayor and City Commission hereby amend the Zoning
Districts and Zoning District Map of City of Miami Beach contained
in Comprehensive Zoning Ordinance No. 89-2665 by changing the
zoning district classification of all properties located on the
west side of Collins Avenue between 75th and 76th Streets and
collectively having the legal description of Lots 1-3 , Block 24 , of
the corrected plat of Altos Del Mar, Number 1 Subdivision, as
recorded in Plat Book 31, at page 40 of the Public Records of Dade
County, Florida, from the current RM-2 , Residential Multi Family,
Medium Intensity to RM-1, Residential Multi Family, Low Intensity.
SECTION 2 . REPEALER.
All ordinances or parts of ordinances in conflict herewith be
and the same are hereby repealed.

SECTION 3 . EFFECTIVE DATE.
This Ordinance shall take effect on the 25th day of
February 1995 .

RECOMMENDATION
The Administration recommends that the City Commission adopt on
first reading the attached Ordinance to amend Zoning Ordinance No.
89-2665.
Pursuant to Subsection 14-3 .A. 1 of the current Zoning Ordinance,
immediately following the conclusion of today' s public hearing, the
Commission may adopt the proposed amendment without the requirement
of a second reading and public hearing.

BACKGROUND
The Planning Board is requesting the City Commission approve the
attached amending ordinance to down-zone the properties on the west
side of Collins Avenue between 75th and 76th Streets from the
current RM-2 Residential Multi Family, Medium Intensity zoning
district classification to RM-1 Residential Multi Family, Low
Intensity zoning district classification.
The Planning Board held a public hearing on October 25, 1994 , and
voted 5-1, (one abstention) , to down-zone those properties on the
west side of Collins Avenue between 76th and 79th Streets (Trammel
Site" ) , from RM-2, (Residential Multi Family Medium Intensity) to
RM-i, (Residential Multi Family Low Intensity) , to guide new
development in a manner which is more compatible with the
surrounding neighborhood. (It should be noted that on December 21,
1994 the City Commission adopted the amending ordinance to down-
zone the "Trammel Site" from RM-2 to RM-1) .
In addition to the above recommendation, the Board also recommended
that this rezoning, from RM-2 to RM-1, be expanded south to include
the three (3) lots fronting along the west side of Collins Avenue
(to the alley) contained in Block 24, between 75th and 76th
Streets, (see attached map on page 4) . With the inclusion of this
block within the RM-1 Zoning District, the residential low-rise
development pattern would continue along Collins Avenue from the
commercial area to the south between 73rd and 75th Streets, north
through the Altos Del Mar Historic District and the properties
between 76th and 79th Streets and through the proposed new low-rise
development opposite North Shore Open Space Park to the northern
City limits.
This down-zoning recommendation is partly based on the
comprehensive - review of the area which is outlined in the
"Development Plan and Design Guidelines For The North Beach
Neighborhood", which is authored by Andres Duany & Elizabeth
Plater-Zyberk, Architects and Urban Planners, and the University of
Miami School of Architecture. This plan proposes new low-rise
residential development along the west side of Collins Avenue
opposite North Shore Open Space Park (NSOSP) from 79th to 86th
Street which is three (3) blocks north of the subject property.
Currently this area contains parking lots for the NSOSP and is the
subject of a pending Comprehensive Plan amendment proposing low-
density, low-rise residential development. The plan supports
height restrictions and down-zoning for the North Beach area.

At the Planning Board public hearing on December 20, 1994, the
Board voted 5-0, (one abstention and one recusal due to a conflict
of interest) , to recommend the down-zoning from RM-2 to RM-1, for
the three (3) lots fronting along the west side of Collins Avenue
contained in Block 24 , (between 75th and 76th Streets) , the subject
before the City Commission today.
ANALYSIS
The rezoning of the property, from RM-2 , (Residential Multi Family
Medium Intensity) to RM-1, (Residential Multi Family Low
Intensity) , would limit development of those properties on the west
side of Collins Avenue (to the alley) between 75th and 76th Streets •
to a scale which would be more compatible with the existing
development in the generally low-rise residential and commercial
development which currently exists to the north, south and west of
the subject area. The existing zoning for these areas is RM-1 to
the north, RM-2 to the west and CD-2 to the south. To the east of
Block 24 , is a public library (one story building) and an at-grade
parking lot with access to the Atlantic Ocean and beachfront, (See
the map on pgae 4) . Immediately north of the subject property on
the west side of Collins Avenue are the three blocks, also known as
the "Trammel Site" ; said property was down-zoned from RM-2 to RM-1
by the City Commission on 12/21/94, as described above.
As the Commission is aware, the RM-1 Zoning District maintains a
fifty (50) ft. height restriction, (except in the Architectural
District where the maximum permitted height is forty (40) feet) , to
maintain the low-rise development pattern within these districts.
The down zoning of this property, from RM-2 to RM-i, would guide
development of these properties on the west side of Collins Avenue
between 75th and 76th Streets in a manner that would be consistent
in scale and compatible with the type of development which is
proposed north -of Block 24 within the pending Comprehensive Plan
amendment and with the existing built environment to the south and
west of the subject area.
CONCLUSION
Based on the foregoing, the Administration recommends that the City
Commission adopt the attached amending Ordinance to down-zone Block
24 located on the west side of Collins Avenue from 75th to 76th
Streets from RM-2, (Residential Multi Family Medium Intensity) to
RM-1, (Residential Multi Family Low Intensity) . A second reading
is not required.
