RESOLUTION REQUESTING, APPROVING AND AUTHORIZING
TEE MIAMI BEACH RAILWAY COMPANY TO TAKE UP AND
REMOVE ITS RAILS, TIES AND APPURTENANT EQUIPMENT
IN CONNECTION WITH ITS STREET RAILWAY ON SHERIDAN
AVENUE FROM THE INTERSECTION OF 28TH STREET TO
THE INTERSECTION OF PINE TREE DRIVE, MIAMI BEACH, ..
FLORIDA, WITH PERMISSION AND AUTHORITY TO REPLACE
SAID RAILS, TIES AND APPURTENANT EQUIPMENT, AND
SETTING FORTH PROVISIONS RELATING THERETO. •
WHEREAS, the City of Miami. Beach is paving, among other
streets, Sheridan Avenue from the intersection of 28th Street to
the intersection of Pine Tree Drive in that City, and
WHEREAS, The Miami Beach Railway Company has street
railway tracks located on that portion of Sheridan Avenue, which
ch
tracks, however, are not now in use because of the change from
street railway means and methods of transportation to motor
vehicles, in accordance with Resolution No. 1643, passed and
adopted by the City Council of Miami Beach on the 10th day of
August, 1927, pursuant to the provisions of Ordinance No. 205,
passed and adopted by the City Council of Miami Beach on the 9th
day of April, 1924, and
WHEREAS, The Miami Beach Railway Company has been
requested by the City to remove the street railway tracks, ties
and appurtenant equipment on Sheridan Avenue from the intersection
of 28th Street to the intersection of Pine Tree Drive, Miami Beach,
and
WHEREAS, The Miami Beach Railway Company is willing to
remove said tracks, ties and appurtenant equipment as provided in
this Resolution,
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF MIAMI BEACH,
FLORIDA, AS FOLLOWS:
Section 1. That the City Council does hereby request
and give its approval and authority to The Miami Beach Railway
Company to take up and remove the rails, ties and appurtenant
equipment in connection with its street railway on Sheridan
Avenue from the intersection of 28th Street to the intersection
of Pine Tree Drive, Miami Beach, Florida, which are not now in
use because of the change from street railway means and methods
of transportation to motor vehicles, in accordance with
Resolution No. 1643, passed and adopted by the City Council of
Miami Beach on the 10th day of August, 1927, pursuant to the
provisions of Ordinance No. 205, passed and adopted by the City
Council of Miami Beach on the 9th day of April, 1924.
Section 2. That the City Council does hereby give to
The Miami Beach Railway Company the express permission and
authority to replace said rails, ties and appurtenant equipment
at any time in the future that it should become necessary or
desirable, in the opinion of The Miami Beach Railway Company to
do so, in the operation of its transportation system in the City
of Miami Beach under its franchise known as Ordinance No. 205,
or otherwise, at the expense of the Miami Beach Railway Company.
Section 3. That if and when said rails, ties and
appurtenant equipment are replaced an Sheridan Avenue from
the intersection of 28th Street to the intersection of Pine Tree
Drive, The Miami Beach Railway Company may at its option replace
said tracks where now located or at such other location on said
Sheridan Avenue as it may desire, such new location to be subject,
however, to the approval of the City Council.
Section 4. That this Resolution shall be in force and
effect from and after its passage and adoption by the City
Council and its acceptance by The Miami Beach Railway Company.
Section 5. That none of the rights, privileges or
franchises granted to The Miami Beach Railway Company by
Ordinance No. 205, passed and adopted by the City Council of
Miami Beach on April 9th, 1924, are affected in any manner by the
passage of this Resolution or the acceptance thereof by The Miami
Beach Railway Company or the removal or replacement of said rails,

ties and appurtenant equipment from Sheridan Avenue from the
intersection of 28th Street to the intersection of Pine Tree
Drive, Miami Beach.
Section 6. This Resolution shall not repeal any part
of Ordinances No. 205 and No. 251 or any part of other ordinances
or resolutions in the City of Miami Beach concerning transportation.
