A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING A
GRANT AWARD, IN AN AMOUNT NOT TO EXCEED $15,000,
TO POWER ACCESS, INC., A FLORIDA NON PROFIT
CORPORATION, TO PROVIDE FUNDING FOR A DISABILITY
AWARENESS EVENT; AND FURTHER APPROVING AND
AUTHORIZING THE CITY MANAGER, OR THE CITY
MANAGER'S DESIGNEE, TO APPROPRIATE FUNDS AND
TO EXECUTE ANY AND ALL DOCUMENTS OR
AGREEMENTS IN CONNECTION WITH THE GRANT.
WHEREAS, the City Administration requests approval of a grant award, in an
amount not to exceed $15,000, to Power Access, Inc., a Florida non profit corporation,
to provide funding for a disability awareness event, the details of which are as follows:
• Each year, the City receives funding from Miami -Dade County's Municipal
Parking Fines Program ( "Program ").
• The Program is authorized by Section 30 -447 of the Miami -Dade County
( "County ") Code. The Program generates funds from fines imposed for the
misuse of marked parking spaces for people with disabilities.
• The County Code stipulates that funds received from the Program are to be
distributed to the County and municipalities.
• The funds must be used to improve accessibility and equal opportunity for
qualified persons who have disabilities, and to conduct public awareness
programs in the municipalities, concerning persons who have disabilities.
• The Second South Beach Jazz Festival ( "Festival ") is a disability awareness
event that will begin on Friday January 8, 2018, and has the goal of raising public
awareness of persons who have disabilities.
• The Festival is organized by Power Access, Inc., a Florida non profit corporation,
and will feature talented musicians with disabilities.
• A primary goal of the Festival is to enable performers to be defined by ability
rather than disability.
• In past years, the City's Disability Access Committee ( "DAC ") has adopted
Resolutions recommending that the City provide funding to support disability
awareness events.
• This year, however, due to a lack of quorum, the DAC was unable to adopt a
recommendation for this year's Festival.
• The grant of City funds for the Festival is consistent with previous DAC
recommendations, and complies with the guidelines of the Program.
• The City Administration is waiving special event application and permit fees for
the Festival, consistent with the City's guidelines authorizing the waiver of special
event fees for nonprofit organizations.
• This project supports the key intended outcome to maximize the Miami Beach
brand as a world class destination.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, that the Mayor and City Commission
hereby approve a grant award in an amount not to exceed $15,000, to Power Access,
Inc., a Florida non profit corporation, to provide funding for a disability awareness event;
and further approve and authorize the City Manager, or the City Manager's designee, to
appropriate funds and to execute any and all documents or agreements in connection
with the grant.

Adopt the Resolution.
ANALYSIS
Each year, the City receives funding from Miami -Dade County's Municipal Parking Fines Program.
The Program is authorized by Section 30 -447 of the Miami -Dade County Code and funds are
generated from the misuse of marked spaces for people with disabilities. The County Code
stipulates that funds received from the program are to be distributed to the County and
municipalities. The funds must be used to improve accessibility and equal opportunity to qualified
persons who have disabilities and to conduct public awareness programs in the municipality
concerning persons who have disabilities.
The Second South Beach Jazz Festival is a Disability Awareness Event that will begin on Friday

Festival is organized by Power Access, Inc., a Florida 501(c)3 nonprofit entity and will feature
talented musicians with disabilities. A primary goal of the event is to enable performers to be defined
by ability rather than disability.
In past years, the Disability Access Committee (DAC) has passed Resolutions recommending that
the City provide funding to support the Disability Awareness Event. This year however, the DAC did
not have a quorum for several months, and was unable to approve the recommendation. The event
is in keeping with previous DAC approvals, and is in accordance with the guidelines of the Parking
Fines Program. In addition, the Administration is waiving the special event application and permit
fees through the standard Administrative process for nonprofits.

CONCLUSION
The Administration recommends that the Mayor and City Commission adopt the Resolution to award
the grant.
