AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE CHAPTER
39, ENTITLED "STREETS, SIDEWALKS AND PUBLIC FACILITIES",
AMENDING ARTICLE V, ENTITLED "NAMING OF PUBLIC FACILITIES
AND STREETS; AMENDING SECTION 39-26 BY PROVIDING AN
EXEMPTION TO THE PROHIBITION AGAINST NAMING STREETS AND
PUBLIC FACILITIES FOR LIVING PERSONS TO ALLOW FOR NAMING
AFTER LIVING PERSONS WHO ARE OVER ONE HUNDRED (100) YEARS
OF AGE; PROVIDING FOR SEVERABILITY; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Miami Beach City Code Section 39-26 prohibits the
naming of streets or public facilities for living persons; and
WHEREAS, the Mayor and City Commission of the City of Miami
Beach believe that the deeds and accomplishments of persons over
one hundred years of age have been sufficiently established to
allow for a determination that these accomplishments merit the
naming of a street or public facility for such persons .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA:
SECTION 1 .
That Section 39-26 of Article V, entitled "Naming of Public
Facilities and Streets" of Miami Beach City Code Chapter 39,
entitled "Streets, Sidewalks and Public Facilities" is hereby
amended to read as follows :

Sec. 39-26 . Review and recommendation committee.
The committee shall establish selection criteria which,
when approved by the city commission, shall govern its name
selection process .
Whenever a name is needed for a new public facility or
street or whenever there is a proposal to rename an existing
public facility or street within or owned by the City of Miami
Beach, said naming or renaming shall first be considered and
reviewed by the committee designated by the city commission
according to the following procedures :
(a) Any person, organization, association, corporation
or other entity including a member of the city commission or
the administration of the city may propose a name for a new
public facility or street or may propose renaming an existing
public facility or street at any time by submitting a proposed
name to the committee .
(b) With a reasonable time after receipt of said
proposal the committee shall meet to consider and review
proposals for the naming or renaming of said public facility
or street . Notice of the meeting shall be given to all
persons or entities which have proposed names for the public
facility or street under construction.

(c) After reviewing the proposal in accordance with the
established selection criteria the committee shall transmit a
written recommendation to the city commission regarding the

proposal; the recommendation may also include any names
proposed by the committee .
(d) Notwithstanding any other provision of this
ordinance, streets and public facilities shall not be named
for living persons, unless such persons are over one hundred
(100) years of age; provided however, that this provision
shall not apply to streets and public facilities named or
renamed prior to the cffcctivc datc of thi3 ordinancc. June
29 , 1991 .
SECTION 2 . SEVERABILITY.
If any section, subsection, clause or provision of this
Ordinance is held invalid, the remainder shall not be affected by
such invalidity.
SECTION 3 . REPEALER.
That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.

SECTION 4 . EFFECTIVE DATE.
This Ordinance shall take effect on the 1st day of

ADMINISTRATION RECOMMENDATION:
The Administration recommends the Mayor and City Commission adopt
the attached Ordinance Amendment, on second reading, to exempt
persons over 100 years of age from the existing City Code
prohibiting the naming of a street, sidewalk and/or public facility
after a living person over 100 years of age .
BACKGROUND:
On June 7, 1995, the City Commission approved the first reading of
this proposed amendment . Miami Beach Code, Section 39-26 ,
prohibits naming of streets, sidewalks or public facilities for
living persons . In recognition of deeds and accomplishments of
persons over 100 years of age who have distinguished themselves as
exceptional citizens through their contributions to the betterment
of our community, a committee shall be convened to review and
recommend the naming of streets, sidewalks and/or public facilities
in their name .
ANALYSIS :
The City of Miami Beach Community Affairs Committee met to discuss
this proposed amendment and voted to approve the recommendation to
the full City Commission. The proposed amendment will establish a
Review and Recommendation Committee, which will establish selection
criteria and make recommendations regarding the proposed naming of
a City streets, sidewalks or public facilities after a living
person over 100 years of age .

CONCLUSION:
The Administration recommends that the Ordinance Amendment,
authorizing the proposed changes to the existing City Code, be
approved by the City Commission on second reading.
