AN ORDINANCE OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA AMENDING
MIAMI BEACH CITY CODE CHAPTER 20, ENTITLED
"BUSINESS LICENSES" , AMENDING SECTION 20-4,
ENTITLED "PRO RATA PAYMENTS; REFUND; EXISTING
LICENSE" BY PROVIDING THAT BUSINESSES
ESTABLISHED AFTER JULY 1ST SHALL PAY ONE-
FOURTH OF THE REQUIRED ANNUAL LICENSE FEE WHEN
OBTAINING AN OCCUPATIONAL LICENSE FOR THE
REMAINING PORTION OF THE LICENSE YEAR;
PROVIDING FOR A REPEALER, SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS, Occupational Licenses must be renewed on October 1st
of each year; and
WHEREAS, Miami Beach City Code Section 20-4 provides for a
prorated fee of one-half the required yearly fee for businesses
established after May 1st of a license year; and
WHEREAS, the Mayor and City Commission believe that the
license fee should be further prorated for businesses established
after July 1, 1995 .
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. AMENDMENT OF SUBSECTION 20-4 .
That Subsection 20-4 of Miami Beach City Code Chapter 20,
entitled "Business Licenses" is hereby amended as follows :
Sec. 20-4 . PRO RATA PAYMENT; REFUND; EXISTING LICENSE
All Licenses shall be payable on or before the first day
of October of each year. No License shall be issued for
any fractional portion of the year; provided, however,
that those Persons operating Businesses or occupations
covered by this Chapter who establish permanent places of
Business in the City after May 1 may obtain a License for
the remaining portion of the fiscal year upon the payment
of one-half of the License fee required by this article
and those establishing such Businesses after July 1 shall
pay only one-fourth of the required License fee . No
refund of fees shall be granted.
SECTION 3. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 4. SEVERABILITY.
If any section,subsection,clause or provision of this Ordinance is held invalid,the remainder
shall not be affected by such invalidity.
SECTION 5. EFFECTIVE DATE.
This Ordinance shall take effect on the 4th day of November , 1995.

SUBJECT: AMENDMENT TO BUSINESS LICENSE ORDINANCE PROVIDING FOR
PRORATION OF LICENSE FEE FOR APPLICATION SUBMITTED AFTER
JULY 1ST OF THE LICENSE YEAR
Commissioner David Pearlson requested the attached Ordinance
which amends the City' s Business License Ordinance, Chapter 20 of
the City Code, to provide that new businesses applying for an
occupational license at a given location only after July 1st of a
license year shall pay one-fourth of the fee normally charged for
the entire license year. Business licenses are issued on October
1st of each year_ .. Currently, the ordinance provides only for a
one-half fee proration for applicants seeking a license after May
1st of the license year. This would allow for a further reduction
(to one-fourth the normal fee) for businesses applying when only
one-fourth of the license year remains .
