RESOLUTION NUMBER 97-22614
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, RETROACTIVELY AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE A GRANT EXTENSION FORM FOR THE
ARTIFICIAL REEF CONSTRUCTION GRANT AWARDED TO THE CITY BY THE
FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION,
WHEREAS, the Mayor and City Commission accepted a grant awarded to the City under the Florida
Department of Environmental Protection's (FDEP) Artificial Reef Construction Grant Program on November
1, 1995; and
WHEREAS, the grant provides for the construction and monitoring of a series of artificial reefs about
200 yards off-shore of the South Pointe Park beach; and
WHEREAS, the planned artificial reefs will be an important element of the City's coastal zone
management by providing important marine habitat and storm surge protection; and
WHEREAS, the planned artificial reefs will help augment local sportfishing and diving which are
important components of the City's tourism industry; and
WHEREAS, this project represents an important first step in the City's research program to develop
artificial reefs that will help prevent beach erosion; and
WHEREAS, the grant was scheduled to be completed by December 1, 1997; and
WHEREAS, the initiation ofthe grant project was delayed by bidding process delays; and
WHEREAS, the FDEP has extended the term of the grant from December 1, 1997 until June 30,
1998, in order to allow the City sufficient time in which to complete the project; and
WHEREAS, the delay in receiving the Grant Agreement Amendment Form from the FDEP
necessitated the attached Form being executed prior to obtaining City Commission approval.
NOW, THEREFORE, BE IT nUL Y RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the execution of the Extension Form for the Artificial
Reef Construction Grant awarded to the City by the FDEP is hereby retroactively approved,
Passed and Adopted this 17th day of December. 1997.

A WARDED TO THE CITY BY THE STATE OF FLORIDA DEPARTMENT OF
ENVIRONMENTAL PROTECTION,
ADMINISTRATION RECOMMENDATION:
Approve the resolution.
BACKGROUND:
On November 1, 1995, the Mayor and City Commission accepted a grant for artificial reef construction
from the Florida Department of Environmental Protection (FDEP).
The grant provides for the construction and monitoring of a series of artificial reefs about 200 yards off-
shore of the South Pointe Park beach. The planned reefs will provide important marine habitat and will
help augment the local sportfishing and diving which are important components of the City's tourism
industry.
The planned reefs also represent an important first step in the cooperative research effort between the
City, the Dade County Department of Environmental Resources Management, Nova University and
several area reef experts to develop artificial reefs that will help prevent beach erosion and lengthen our
beach renourishment cycle,
The grant was scheduled to be completed by December 1, 1997, Poor response to the advertised Request
for Bids (Bid No. 112-96/97), the subsequent revision of the bid specifications, and the re-bidding of the
project has caused the implementation of the grant project to be delayed. In light of the City's active
efforts to implement the grant project, the FDEP has agreed to extend the term of the grant in order to
allow the City sufficient time in which to complete the project.

The grant will be extended from December 1, 1997 until June 30, 1998. All other terms and conditions
of the grant agreement remain unchanged,
The project was re-bid on November 21, 1997 and the bid opening is scheduled for December 11, 1997.
A contract award recommendation will be submitted to the City Commission at the January 7, 1998
commission meeting. The bid specifications require the construction of the reefs to be completed within
90 days following the contract award and issuance of the Notice to Proceed by the City.
CONCLUSION:
The City Commission should hereby approve the attached Resolution retroactively authorizing the Mayor
and City Clerk to execute a Grant Agreement Extension Form extending the term of the City's Artificial
Reef Construction Grant.

Amendment NO.2
THIS AGREEMENT as entered into on the 29th day of February 1996 and amended on June
27th, 1997, between the Department of Environmental Protection (hereinafter referred to as the
"Department") and the Broward County Board of County Commissioners (Hereinafter referred to as the
"Contractor") is hereby amended as follows:
Amend paragraph 2, page 1, to read as follows:
2. This agreement shall become effective upon execution and end on June 30. 1998, In the event
the construction of the project is not complete by said date, the Department will have the right to cancel
its obligations of any and all financial assistance granted for the said project.
I~ all other respects, the Agreement of which this is an amendment, and attachments relative
thereto, shall remain in full force and effect.
