2002-24856 Reso RESOLUTION NO. 2002-24856 A RESOLUTION OF THE MAYOR AND CITY COMMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING ON JUNE 19, 2002, TO CONSIDER A WAIVER OF THE LAND DEVELOPMENT REGULATIONS APPLICABLE TO THE FIRE STATION NO.4 PROJECT SITE, PURSUANT TO SECTION 142-425(d) OF THE CODE OF THE CITY OF MIAMI BEACH, IN ORDER TO ALLOW AN ENCROACHMENT INTO THE REQUIRED SETBACK FACING 69TH STREET, AND ELIMINATE THE PROVISION OF THE REQUIRED ON-SITE PARKING SPACES FOR THE FIRE STATION NO. 4 GENERAL OBLIGATION BOND PROJECT. WHEREAS, on November 2, 1999, the citizens of the City of Miami Beach approved the $92 Million General Obligation Bond, of which $1,925,525 was earmarked to supplement a previous appropriation of Community Development Block Grant (CDBG) funds, in the amount of $550,000, for the improvements to Fire Station No.4; and WHEREAS, on July 12, 2000, pursuant to Request for Qualifications (RFQ) No. 41-99/00, the City entered into a Professional Services Agreement with the architectural firm of MC Harry Associates, Inc., to develop design, construction documentation, specifications, and to provide construction administration for the project; and WHEREAS, the project's scope generally encompasses the following components: demolition of the 1960 addition which comprises the western (rear) portion of the historic structure, relocation of the designated historic Fire Station structure to a southwesterly location within the site, near the Indian Creek Waterway, structural stabilization of the same at the new location, exterior finish improvements and construction of a new state-of-the art Fire Station in a northerly location on the site. WHEREAS, additionally the project's program generally comprises the construction of the following components: a three (3) bay "back-in" apparatus facility, including new male and female restrooms, showers, locker rooms, dormitories, office space, day room, mechanical room, storage, kitchen/ dining room, gymnasium, alarm room/lobby, tank storage, and bunker gear; and WHEREAS, on March 20, 2002, the Mayor and City Commission designated the existing Fire Station No.4 an historic site; and WHEREAS, on March 22, 2002, MC Harry and Associates, Inc., presented a schematic design complying with the Administration's directives, and the project's programmatic requirements established by City staff; and WHEREAS, on April 9, 2002, the project's schematic design was presented to the Historic Preservation Board, and the project was positively reviewed and accepted by the Board's members, who made useful comments on the project's current concept; and WHEREAS, various site constraints impede the design's full compliance with the Land Development Regulations requirements applicable to the project site; and WHEREAS, Division IX, GU Government Use District - Section 142-425 entitled "Development regulations", paragraph (a) states that "the development regulations (setbacks, floor area ratio, signs, parking, etc.) in the GU Government Use District shall be the average of the requirements contained in the surrounding zoning districts as determined by the Planning and Zoning Director, which shall be approved by the City Commission"; and WHEREAS, the project site is surrounded by RM-2 Residential Multi Family District; and therefore, the setbacks requirements for the subject property are 20 feet for the front setback; 27 feet for the side setback; and 16.9 feet for the rear setback; and WHEREAS, the proposed Fire Station No.4 is encroaching 27 feet into the required north side setback, and authorization to allow such encroachment into the north side setback is sought; and WHEREAS, additionally, pursuant to Sections 130-31, and 130-32, Parking District No.1, thirty (30) on-site parking spaces are required for the site; and due to site constraints, twenty-two (22) spaces are being provided in the new design, and authorization to allow twenty-two (22) on-site parking spaces is sought; and WHEREAS, the Administration after reviewing other design options for the project, concurs with the consultants that the current scheme is the most feasible; and NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing shall be held on June 19, 2002, to consider a waiver of the Land Development Regulations applicable to the Fire Station No.4 project site, pursuant to section 142-425(d) of the Code of the City of Miami Beach, in order to allow an encroachment into the required setback facing 69th street, and reduce the required on-site parking spaces for the Fire Station No.4 General Obligation Bond Project, and the Administration is hereby authorized and directed to publish and distribute the appropriate public notice of said public hearing at which time all interested parties will be heard. 2 PASSED AND ADOPTED this 29th day of May ,2002. ~rf~ CITY CLERK ATTEST: APPROVED AS TO FORM & LANGUAGE & FOR EXECUTION ~ t;" - / J - en...-- DATED Resolution No. 2002-24856 T:\AGENDA\2002\MA Y2902\REGULAR\FS4WVRRESO.doc 3 CITY OF MIAMI BEACH COMMISSION ITEM SUMMARY m ~ Condensed Title: A Resolution of the Mayor and City Commission setting a public hearing on June 19,2002, in accordance with Section 142-425 (d) of the City Code, to consider a waiver of development regulations to allow an encroachment into the required setback facing 69th Street, and eliminate the provision of the required number of on-site parking spaces for the Fire Station No.4 Project. Issue: Should the Mayor and City Commission adopt the aforementioned Resolution setting a public hearing to consider a waiver of the Land Development Regulations applicable to the Fire Station No.4 Project? Item Summary/Recommendation: Pursuant to the proposed improvements to Fire Station No.4, and the designation of the property as an historic site, the Administration has established the programmatic requirements for the project. MC Harry Associates, the City's consultant, was instructed to develop the conceptual design in accordance with the established parameters defined by City staff. During the schematic design phase, as a result of site constraints, and to attain the programmatic goals set for the project, (such as the preservation of the historic structure as well as designing a state-of-the-art new Fire Station), it is necessary to request a waiver of the Land Development Regulations related to setback requirements facing 69th Street and, on- site parking requirements. After reviewing numerous options with the City's consultants and City staff for the development of the project's design, the Administration concurs that, the most feasible option will require that the aforementioned Land Development Regulations be waive~ by the Mayor and City Commission. Therefore~ the Administration recommends the adoption of the Resolution by the Mayor and City Commission. On July 12, 2000, pursuant to Request for Qualifications, (RFQ) No. 41-99/00, the City entered into a Professional Services Agreement with the architectural firm of MC Harry Associates, Inc., to develop design and construction documentation, specifications, and to provide construction administration for the project. Subsequently, the Capital Improvement Projects Office conducted a series of workshops and meetings with URS Corporation, the City's Parks and Facilities Program Manager, Fire Department personnel, Historic Preservation staff, MC Harry Associates, Inc., the project's architect, to establish the programmatic requirements of the project. Commissioner Luis R. Garcia Jr. also participated in this process. Various design options have been considered for the improvement of the site. In the interim, on March 20, 2002, the Mayor and City Commission designated the existing Fire Station NO.4 an historic site. Designed by the recognized local architect Robert Law Weed in 1937, the building is a distinctive landmark within the North Beach Community. The project's scope and program were established as follows: 1 Proiect scope: The project's scope generally encompasses the following components: . Demolition of the 1960 addition which is the western (rear) portion of the historic structure. . Relocation of the designated historic Fire Station structure to a westerly location within the site, near the Indian Creek Waterway, and structural stabilization of the same at the new location, and exterior finish improvements. . Construction of a new state-of-the art Fire Station in a northerly location on the site. Proiect proaram: The project's program generally comprises the construction of the following components: . A three (3) bay "back-in" apparatus facility, including new male and female restrooms, showers, locker rooms, and dormitories; office space, day room, mechanical room, storage, kitchenl dining room, gymnasium; alarm room/lobby; tank, and bunker gear storage. On March 22, 2002, MC Harry and Associates, Inc. presented a schematic design complying with the Administration's directives, and the project's programmatic requirements established by City staff (Attachment 1). The concept drawings presented by MC Harry Associates, Inc., include the relocation of the existing Fire Station structure that was designated historic by the Mayor and City Commission on March 20, 2002, to a southwesterly location within the site, nearthe Indian Creek Waterway. The neo-classical faCfade of the relocated building retains its easterly orientation, facing Indian Creek Drive. A preliminary review of the flood criteria requirements for the site indicates that the ground level of the relocated structure must be situated at an elevation above 8' NGVD (National Geodetic Vertical Datum). Consequently, the existing Pump Station will have a lesser impact on the historic building's sight line from Indian Creek Drive. The landscaping buffer, proposed around the Pump Station will also isolate, and camouflage this facility from the rest of the site. An open landscaped area connects the Police Substation parking lot in the south of the site, the relocated historic Fire Station in the west, and the new state-of-the art Fire Station to the north. It also connects the public walk, adjacent to the Indian Creek Seawall, to Indian Creek. The new Fire Station building's north taCfade aligns with the 69th Street edge of the right-of-way. On April 9, 2002, the schematic design presented to the Historic Preservation Board was positively reviewed and accepted by the Board's members, who made useful comments on the project's current concept. At this time, many constraints impede the designer to fully comply with all the Land Regulations requirements applicable to the project site: . The designation of the existing Fire Station as an historic site limits the options tor the development of the project. The current structure cannot be demolished, nor modified radically to meet the program requirements of the new project. . The relocation of the existing pump station and appurtenant underground utilities 2 currently in a prime location on the site, near Indian Creek Drive, would be very expensive, and is not funded. . Deed restrictions and FPL's underground wiring in the 69th Street right-of-way also limit the City's option to develop that site. . As a result of the concerns expressed by members of the City Commission regarding the proximity of the apartment complex in the south, and the nuisance impact of day-to-day operations and maneuvering of the emergency trucks to the residents, the Administration abandoned the idea of constructing the new building in a southerly location on the site. Therefore, to satisfy the above constraints, and meet the project programmatic needs, it is deemed necessary for the Administration to request that the following Land Development Regulations be waived by the Mayor and City Commission: Proposed setbacks modifications: (See Attachment 1) Division IX GU Government Use District - Section 142-425 entitled Development Regulations paragraph (a) states as follows: "The development regulations (setbacks, floor area ratio, signs, parking, etc.) in the GU Government Use District shall be the average of the requirements contained in the surrounding zoning districts as determined by the Planning and Zoning Director, which shall be approved by the City Commission." Police sub-station 12 12 Subtotal Total 30 22 Waiver of 8 parking spaces reaulred Pursuant to Sections 130-31, and 130-32, Parking District No.1, thirty (30) on-site parking spaces are required for the site. The existing Police Substation parking lot in the south, has currently eleven (11) parking spaces. The lot layout will be modified to accommodate an additional ten (10) spaces for a total of twenty-one (21). One (1) handicap parking space will also be added on-site in the proximity of 69th Street. Therefore, there is a deficit of eight (8) on-site parking spaces, for which the Administration requests that the Mayor and City Commission waive the Land Development requirements for on-site parking applicable to the Fire Station Project site. As part of Section 142-425, it is also requested that by this action the City Commission affirm the Planning Department Director's determination of the applicable setback requirements of the RM-2 for the subject site as described herein. The Administration recommends the adoption of the Resolution by the Mayor and City Commission.
