A RESOLUTION OF THE CITY OF MIAMI BEACH,
FLORIDA, VACATING A PORTION OF THE NORTH
SIDE OF LINCOLN ROAD ADJACENT TO THE PROP-
ERTY DESCRIBED IN THE SUCCEEDING
PARAGRAPH AND ILLUSTRATED ON THE ATTACHED
PLAT , AND GRANTING SUCH VACATED PORTION TO
THE EXOTIC GARDENS, INC.
A certain parcel of land lying and being in the City of
Miami Beach, County of Dade, State of Florida, described as fol-
lows, to wit:
From a concrete monument located at the intersection of
the West line of Jefferson Avenue and the North line of Lincoln
Road, as said monument is shown on a plat entitled "Amended Plat
of Golf Course Subdivision" , as same is recorded in Plat Book 6 ,
Page 26, of the Public Records of Dade County, Florida, more par-
ticularly described as being 1350 feet east and 270 feet north of
the Southwest corner of the NW of Section 314 , Township 53 South,
Range 14.2 East , run easterly along the North line of Lincoln Road a
distance of 994.1 feet to the point of beginning of the tract of
land herein described. From said point of beginning run northerly
along a line perpendicular to the last mentioned course a distance
of 105 feet to a point, then run easterly along a line parallel to
the North line of Lincoln Road a distance of 50 feet to a point ,
thence run southerly along a line perpendicular to the North line
of Lincoln Road a distance of 105 feet to a point , thence run wester-
ly along the North line of Lincoln Road a distance of 50 feet to a
point of beginning of the tract of land herein described, containing
0.12 acres more or less.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: THAT the portion of the North side of Lincoln Road im-
mediately adjacent to the above described tract of land
being 0,.12 of a foot in width immediately south and ad-
jacent to the above described property, be and the same
is hereby granted to THE EXOTIC GARDENS, INC. , subject to the pro-
viso hereinafter contained.
PROVIDED, however , that if the building now on said premises and
covering the above described land is ever moved, demolished, de-
stroyed by fire , or rebuilt , then the above vacation of said por-
tion of Lincoln Road and the grant of the use of the same shall im-
mediately be revoked, terminated, and absolutely voided without any
action on the part of the City Council of the City of Miami Beach,
Florida, and said lands above described shall again become a portion
of Lincoln Road for the public use.
