2002-24858 Reso RESOLUTION NO. 2002-24858 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING THE CITY OF MIAMI BEACH AS INTERMEDIARY FOR THE TEMPORARY OUTDOOR SCULPTURE PROJECT, AS ENDORSED BY THE MIAMI BEACH ART IN PUBLIC PLACES COMMITTEE, ENTITLED "FLAMINGOS ON THE BEACH," AT NO COST OR PROFIT TO THE CITY; ACCEPTING SPONSORSHIP DONATIONS OF UP TO $100,000, AND DISBURSING PAYMENTS TO THE FABRICATOR, KERN STUDIOS, NOT TO EXCEED $43,750; AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A LETTER OF -AGREEMENT WITH LAURA JAMIESON, AS PRINCIPAL OF SOUTH BEACH PUBLIC RELATIONS, FOR PROJECT ADMINISTRATION FEES NOT TO EXCEED $10,000, AND PROJECT EXPENDITURES NOT TO EXCEED $46,250. WHEREAS, a Miami-Dade County group of cultural tourism related entities created a temporary outdoor sculpture project, entitled "Flamingos in Paradise," based on the highly successful "Cows on Parade" event held in Chicago; and WHEREAS, the Miami-Dade County group project manager and the flamingo sculpture fabricator approached the City's Art in Public Places Committee with an offer to donate the juried artist portfolios with designs and the flamingo project website layout ifthe pro~ect could be realized in Miami Beach, in an attempt to save the project after September 11t. and , WHEREAS, in January 2002, with the idea of supporting the "Festival Season" cultural tourism incentives of the City, the Art in Public Places Committee recommended partnering with the Greater Miami Convention & Visitors Bureau, the Miami Beach Visitor & Convention Authority, the Miami Beach Cultural Arts Council, and the Miami Beach Chamber of Commerce, to implement a scaled down local version of the project entitled "Flamingos on the Beach;" and WHEREAS, due to the non-profit status of the City and the overriding financial condition of the project, requiring all funds to be raised through sponsorships and for no City dollars to be used, it was determined that the City would serve as intermediary and issue payments to only two vendors for all project expense disbursements; and WHEREAS, the Finance Department established specialty accounting codes forthe project and recommended that the Administration issue lump sum payments to both the fabricator and the project manager for preject administration costs, once sponsorship checks had cleared; and .~ WHEREAS, sponsorship expenditures will be disbursed to Kern Studios, not to exceed fees of $43,750, for project fabrication, and to Laura Jamieson, as principal of South Beach Public Relations, not to exceed $10,000, for project administration, and $46,250, for project expenses; and WHEREAS, this Citywide temporary outdoor sculpture project, "Flamingos on the Beach," will be launched on June 13, 2001, as part of the 2nd Thursday Cultural Arts Council programming and continue throughout the Festival Season. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission approve the temporary outdoor sculpture project, endorsed by the Art in Public Places Committee, entitled "Flamingos on the Beach," at no cost or profit to the City; authorize the City Manager or his designee to accept sponsorship donations of up to $100,000; and disburse payments to the fabricator, Kern Studios, not to exceed $43,750; and authorize the City Manager to execute a Letter of Agreement with Laura Jamieson, as principal of South Beach Public Relations, for project administration, not to exceed $10,000, and project expenditures, not to exceed $46,250. Well, Miami Beach is getting "Flamingos on the Beachl" I "Flamingos on the Beach" is an outdoor sculpture installation of larger- than-life flamingos that will be a major exhibition from May through October 2002. Flocks of these beautiful birds will be found in public areas throughout Miami Beach - painted, cOllaged, bejeweled and bedazzled - by artists from near and far. ~I What better way to promote tourism and support the artsl This will be a major component of the multi-million dollar "Festival Season" national advertising and marketing campaign to promote tourism in Miami Beach from May 9 through October 14, 2002. A detailed guide and map will be published and distributed nationwide as part of this cultural tourism effort. One-of-a-kind flamingos will be prominently located throughout Miami Beach, providing excellent publicity and promotion for companies and individuals. These high impact flocks of flamingos will provide local businesses the opportunity to create special events around their flamingos. ~il Flamingo sponsors may choose designs from a portfolio of over 400 artist renderings, or they may choose their own artist. Any flamingo design that was not juried into the project must be reviewed and accepted by the Flamingos on the Beach panel prior to implementation. kl Flamingos are available in two poses: wings folded or wings outstretched. Flamingo sponsorahips at $2000 per flamingo are tax deductable - and the sponsor keeps the flamingo at the end of the project. Sponsorship includes fees to the artist, installation, labor and transportation. Flamingos will be painted, coIlaged, or decorated in any number of ways. Flamingos may be sculpturally enhanced or changed. however, the structural integrity of the flamingo must not be compromised and the mechanisms for attaching the flamingo to its concrete base may not be obstructed. Flocks of flamingos will be on display in Miami Beach from May through October 2002. These artistically embellished eight-foot-tall birds will be perched in Miami Beach public locations as part of the Miami Beach "Festival Season." At the end of the exhibition period, any unclaimed birds will become the property of the Miami Beach Art in Public Places Program. i~ i A Flamingo Review Committee, comprised of art professionals, juried all proposals and rnateriaIa. Public accessibility, safety and Miami Beach weather conditions must be taken into consideration in the design and execution of the flamingos. Materials must be able to withstand climatic conditions and exposure by the public for up to one year. This is a fun and funky family oriented outdoor public art project. Any designs which include religious, political, or inappropriate references are not acceptable. Flamingos on the Beach Committee reserves final determination on placement of flamingos and on time period of exhibition. i 2. Laura Jamieson, as principal of South Beach Public Relations, will serve as project administrator throughout the "Flamingos on the Beach" project. Responsibilities shall include: . Coordination of flamingo delivery with Kern Studios, fabricators of the fiberglass flamingo sculptures . Compile marketing materials, including press kit, brochures, maps, etc. . Grant writing for VCA "Festival Season" support . Coordination of sales with sponsorship teams, including the Miami Beach Chamber of Commerce, the SunPost, the Market Company, Network Marketing, and others . Conduct weekly sales team meetings for reporting and motivation . Respond to public information requests, sponsorship and referrals . Ct:eate a database of artists . Artist relations, serving as liaison with 180+ accepted artists in the project . Transportation of sculptures to and from fabricator to artist studios and return for installation . Source a workspace so the public can view flamingo artists at work . Media relations-writing and distribution of a series of news releases . Arrange print, radio and television interviews for local and foreign news media, including European and Latin American tourism publications . The parties herein acknowledge and agree that this Letter Agreement contemplates the services to complete the project will be reimbursed on an installment basis; accordingly, project fees, as set forth above, will be billed on an interim basis with "flocks" of six (6)-twelve (12) flamingos, to make the project work most efficiently. In January 2002, with the idea of supporting the "Festival Season" cultural tourism incentives ofthe City, Miami Beach Art in Public Places, partnered with the Greater Miami Convention & Visitors Bureau, the Miami Beach Visitor & Convention Authority, the Miami Beach Cultural Arts Council, and the Miami Beach Chamber of Commerce, to implement a scaled down local version of the project, titled "Flamingos on the Beach." "Flamingos on the Beach" will be available for public viewing during the months of June through October 2002. The Greater Miami Convention & Visitors Bureau will provide a printed map ofthe flamingo locations and include the project in it's season marketing. The Chamber of Commerce will assist to solicit sponsorships, and the Cultural Arts Council will assist with project launching. All terms and conditions ofthe Flamingo Project were scaled down and the cost of sponsorship was reduced from $4,000 to $2,000. Due to the non-profit status of the project, it was determined that the City of Miami Beach will serve as intermediary and issue payment to only two vendors for all project expense disbursements. The overriding financial condition of the project was that all funds required were to be raised and no city dollars were to be used. The Finance Department established specialty accounting codes for the Project and recommended the City Administration issue lump sum payments to both the Fabricator and the Project Manager for Project Administration costs, once sponsorship checks had cleared. The Project Manager issues payments for all administrative expenses to include artist fees ($500 per flamingo), sponsorship expenses ($200 commission to sale of sponsorship), transportation is to include on site installation ($100 per flamingo round trip from warehouse to studio to site), identification plaque printing, marketing, promotion, and accounting fees to be determined. The Project Manager's fee for administration of this project will not exceed $10,000. The project fund balance of $125 per outside generated sponsorship, and $325 per inside generated sponsorship (AiPP, ACE, orVCA), will be utilized to create a project-generated public flock for display. For a project total goal of fifty (50) flamingos, the sponsorship income will not exceed $100,000. The sponsorship expenditures will be disbursed to Kern Studios, not to exceed fees of $43,750 for fabrication, and to Laura Jamieson & Associates, not to exceed $10,000 for project administration, and $46,250 for project expenditures.
