Resolution 2799 RESOLUTION NO. 2799
WHEREAS, the City of Miami Beach is the owner of improvement
liens of a book value of approximately $7k1 ,391.5g consisting of
approximately $526,255.50 principal and $215,136.08 accrued interest
and penalties, which liens were placed against approximately 1704
parcels of land to pay a portion of the cost of construction of
certain local improvements, and
WHEREAS, many of these liens exceed the value of the parcels of
land against which they are assessed, and
WHEREAS, many of these liens exceed the special benefits of the
improvements for which they were levied, and
WHEREAS, the majority of these improvements were made and the
liens levied during the years 1925, 1926 and 1927 when construction
costs were abnormally high, and the cost of said improvements, there—
fore , is now disproportionate to the special benefits to many of the
parcels of land affected, and
WHEREAS, it appears that because of excessive liens , a large
majority of these parcels are and have been for several years in
default in general City taxes and thereby tend to increase taxation
against other property in the City, and
WHEREAS, it would appear to be in the interests of owners of all
property in the city to adjust said liens so said liens will not
exceed the special benefits derived by virtue of the improvements
and thereby encourage the payment of liens and general taxes , and
WHEREAS, Chapter 16565 of the Special Acts of 1933 empowers
the City Council by resolution "to compromise , abate , adjust and
settle or reassess any and all liens for local improvements in the
City of Miami Beach, Florida, and any and all lien sale certificates
issued thereon, said compromise , abatement , adjustment , settlement
or reassessment to be in conformity with the special benefits of
the improvement to the property for which said lien was assessed."
NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that all improvement liens and/or lien sale
certificates owned by the City of Miami Beach applicable to lots or
parcels of land hereafter described, together with accrued interest
and/or penalties to date be, and they are hereby adjusted by apply
ing proportional adjustments to each lien and/or lien sale certifi.
Gate against each lot or parcel of land hereafter described so
that the aggregate of liens and/or lien sale certificates against
any]ot or parcel of land so described, together with accrued interest
and/or penalties to date , shall be as follows:
