A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA,
PERMITTING THE ENCROACHMENT OF AN
OVERHANGING ROOF OF GATEWAY OVER AND
UPON A PORTION OF COLLINS AVENUE, SAID
GATEWAY SITUATED ON THE HEREINAFTER
DESCRIBED PROPERTY AS INDICATED BY AND
ILLUSTRATED ON THE ATTACHED BLUE PRINT
PREPARED FOR NATIONAL TITLE COMPANY BY
BISCAYNE ENGINEERING COMPANY, J. J.
BENNETT, REGISTERED ENGINEER.
North 10 feet of Lots 4 and 17, all of Lots 5 and 16, and
the South 4O feet of Lots 6 and 15, in Block 28 of Fisher's
lst Subdivision of Alton Beach, according to Plat Book 2, at
Page 77, Public Records of Dade County, Florida; also
Beginning at the S. E. corner of Lot 5 of Block 2$, thence
southerly along the East line of Block 28 to its intersection
with a line parallel to and 10 feet South of the South line
of said Lot 5 of Block 28, thence along the line parallel to
and 10 feet South of the South line of said Lot 5 of Block
28 produced eastwardly to the high water mark of the Atlantic
Ocean. Thence meandering said high water mark of the Atlantic
Ocean, in a northerly direction, to a point on said high water
mark of the Atlantic Ocean, at the intersection of said high
water mark and a line which is parallel to and 10 feet South
of the South line of Lot 7 of Block 28 of said Subdivision pro-
duced eastwardly, thence westerly along said line, which is
parallel to and 10 feet South of the South line of Lot 7 of
Block 20 of the said Subdivision produced, to a point at the
intersection of said line and the East line of said Block 28,
thence southerly along the East line of said Block 28 to the
point of beginning.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA:
Section 1: That the portion of Collins Avenue immediately west of
the above described property on which the existing roof of gateway
is shown to encroach, as indicated and illustrated on a plat prepared
for the National Title Company by Biscayne Engineering Company, J. J.
Bennett, Registered Engineer, copy of which is attached hereto and
made a part hereof, be and the same is hereby permitted, and, all right
to object to said encroachment as it presently exists, is hereby waived,
subject to the proviso hereinafter contained and set forth:
PROVIDED, however, that if the structure now situated on said premises
and covering the hereinabove described land is ever moved, demolished,
destroyed by fire or rebuilt then, and in that event, the permission
allowing the said encroachment to exist and the waiver of right to ob-
ject to said encroachment as it presently exists, shall be immediately
and automatically revoked, terminated and absolutely voided without any
action on the part of the City Council of the City of Miami Beach,
Florida, and said lands above described shall again become a portion of
Collins Avenue for the public use.
PROVIDED, further, that nothing herein contained shall be construed,
operate or apply to any or all claims, right, title or interest of the
City of Miami Beach and/or the public generally, in and to that portion
of the above described property adjacent to and immediately eastward of
Lots 4, 5 and 6 of said Block 28, as same is shown on plat thereof
recorded in Plat Book 2 at Page 77 of the Public Records of
Dade County, Florida.
