A RESOLUTION OF THE CHAIRMAN AND MEMBERS OF THE
MIAMI BEACH REDEVELOPMENT AGENCY APPROPRIATING
$171,000 FROM SOUTH POINTE TAX INCREMENT FUNDS,
FOR THE CONSTRUCTION COSTS OF A TEMPORARY
PEDESTRIAN BAYWALK LOCATED AT THE PORTION OF THE
ALASKA PARCEL DESCRIBED IN THE TEMPORARY
BAYWALK ACCESS EASEMENT GRANTED FOR SAID
PROJECT.
WHEREAS, on August 22, 2001, the Planning Board issued an Order
approving the construction of the temporary parking lot at the Alaska site with a
condition stating a setback of 75 feet from the water's edge, except at the base
of the boat basin, where the setback of 25 feet shall be permitted; and
WHEREAS, no vehicles shall be permitted to be parked within the
required setbacks, and
WHEREAS, in connection with the Planning Board's approval, the
applicant proffered a temporary baywalk easement subject to certain
conditions; and
WHEREAS, the proposed Alaskan Parcel Temporary Baywalk Extension
will connect the existing baywalk at South Pointe Park to the recently
constructed baywalk adjacent to the Murano project development; and
WHEREAS, the proposed Alaska Parcel Temporary Baywalk Extension
shall be approximately five-hundred (500) feet in length; it will be located
adjacent to the existing perimeter fence of the Alaska Parcel temporary parking
facility; it will consist of a twelve - eighteen (12 - 18) foot wide sidewalk
constructed of gray colored concrete; it will be located approximately ten (10) to
fifty (50) feet from the existing edge of water; and it is intended for pedestrian
traffic only and is protected from vehicular traffic by bollards at either end; and
WHEREAS, in order to proceed with the requirements of the Planning
Board and subsequent construction, it is necessary and recommended that the
Board appropriate $171,000 from the South Pointe Tax Increment Funds to
construct a temporary baywalk on the Alaska Parcel.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CHAIRMAN
AND MEMBERS OF THE MIAMI BEACH REDEVELOPMENT AGENCY, the
Chairman and Members of the Miami Beach Redevelopment Agency appropriate
$171,000 from South Pointe Tax Increment Funds, for the construction costs of a
temporary pedestrian baywalk located at the portion of the Alaska parcel
described in the temporary baywalk access easement granted for said project.

AN~LYSIS:
I n November 1995, the City of Miami Beach, the Miami Beach Redevelopment Agency and
the Portofino Group entered into a Development Agreement which was terminated in June
1997. In October 1998, the parties entered into a Settlement Agreement that transferred
the deed to SSDI-North (which was held in escrow) to West Side Partners, Limited and
sets forth the obligations of the parties with respect to the Development of SSDI-North and
SSDI-South parcels.
As part of the Settlement Agreement between the City of Miami Beach, the Miami Beach
Redevelopment Agency and West Side Partners Limited, it was contemplated that West
Side Partners would develop the SSDI-North parcel in two stages. The Developer, The
Related Companies (TRG), which purchased the property from West Side Partners,
commenced the development of the SSDI-North parcel in September 2001.
Construction on SSDI-North consists of two high rise towers and related amenities as
approved and reflected in the concept plan, modified by Resolution No. 2001-24349
adopted by the City Commission on April 18, 2001. Construction sequence requirements
dictate that construction initiate along the southerly portion of SSDI-North which must be
completed before the northerly portion is developed. In connection with this construction,
several pre-construction activities are occurring on SSDI-North and adjacent properties to
support the proposed Murano Grande construction activities.

The City/RDA have certain obligations pursuant to the Settlement Agreement for the pre-
construction activities. The Agreement contemplated that the City and its Lessee, the
Miami Beach Marina, would be granted, via a Parking License Agreement, parking spaces
on the Portofino Parcels (Alaska, Goodman, Hinson, "Block 51" Parcels) to replace the
same number of parking spaces no longer available on SSDI-North, due to construction.
The Parking License was executed among West Side Partners, the Alaska, Goodman and
Hinson Parcel property owners, the City of Miami Beach, and the RDA. Portofino is also
locating approximately 34 spaces on Block 51 , which fronts Commerce Street. This parcel
has been included in a Supplemental Agreement approved by the RDA Board on July 18,
2001.
To this end, the City built the substitute parking, which consists of the following:
Alaska Parcel: 268 parking spaces .
Block 51 - Lots 5-9: 34 parking spaces
SSDI-North: North Lot: 115 parking spaces
Total: 414 parking spaces.
Access to the Alaska parcel parking lot is provided by three means:
· pedestrian access via the public baywalk which will require a temporary, non-
exclusive, public walkway through the City's Federal Triangle, connecting to and
adjacent to the Alaska Parcel.
· vehicular access via a new curb-cut and roadway through the Goodman and Hinson
parcels and the City's Federal Triangle. This access will lie on the western property
line of Goodman and Hinson and the eastern property line of the Federal Triangle.
A Revocable License Agreement will be presented on July 18, together with a
restrictive covenant in lieu of Unity of Title, granting said access and indemnifying
the City.
· vehicular access will also be provided through the Washington Avenue Extension
on the eastern frontage of the Alaska Parcel.
In connection with this parking license and the parking lots constructed south of South
Pointe Drive, the City Code requires a conditional use approval by the Planning Board and
a minimum temporary lot improvements and standards, i.e. paving, lighting, landscaping
and drainage and does not allow gravel lots.

After the Planning Board action, on October 17, 2001, the Mayor and City Commission
requested and received an opinion of probable cost for shoreline stabilization and baywalk
installation. Hazen and Sawyer, the City's construction manager on the implementation of
the Portofino settlement items, provided an opinion of cost estimated at $2.7 million. The
$2.7 million probable cost was comprised of approximately $1.7 million for shoreline
stabilization and approximately $1 million for a permanent baywalk.
In May 2002, the Administration provided a status report to the Planning Board. It was
reported that since the easement proffered by the property owner is temporary in nature
and as it is private property, it was not recommended the City/RDA perform the shoreline
stabilization and baywalk improvements due to the estimated cost of $2.7 million. The
Planning Board recommended the City engage an Engineer to determine if the Shoreline
Stabilization, which represented the bulk of the $2.7 million estimate, would be required
and develop a more limited scope.
Alaska Parcel Temporary Bavwalk Extension. Proiect Scope
As a result, a revised estimate was provided, removing the shoreline stabilization element.
The proposed Temporary Baywalk Extension will connect the existing baywalk at South
Pointe Park to the recently constructed baywalk adjacent to the Murano project
development. The proposed temporary baywalk extension will consist of a twelve -
eighteen (12 -18) foot wide sidewalk constructed of gray colored concrete. The proposed
temporary baywalk extension shall be approximately five-hundred (500) feet in length and
will be located adjacent to the existing perimeter fence of the Alaska Parcel temporary
parking facility. The temporary baywalk will be located approximately ten (10) to fifty (50)
feet from the existing edge of water. The baywalk is intended for pedestrian traffic only
and is protected from vehicular traffic by bollards at either end.
In addition to the above features the baywalk also includes the following:
. Landscaping along the waterside edge to discourage users from leaving the
concrete surface and wandering to the shoreline and I or dilapidated seawall.
. I rrigation system
. Lighting
. Stabilization of the existing seawall at the slip.
. Sign age
This baywalk is intended to function temporarily until such time that the actual baywalk is
constructed, which is anticipated when the property owner develops its property.
