Ordinance 96-3063ORDINANCE NO. 96-3063 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE CHAPTER 2, SECTION 2-6, ENTITLED "ENUMERATION OF ORGANIZATIONAL UNITS"; SAID AMENDMENT PROVIDING FOR THE CREATION OF: THE OFFICE OF CHILDREN'S AFFAIRS; THE OFFICE OF INTERNAL AUDIT; THE ADMINISTRATION, OFF STREET PARKING, AND ON STREET PARKING DIVISIONS WITHIN THE PARKING DEPARTMENT; THE CRIMINAL INVESTIGATIONS AND TECHNICAL SERVICES DIVISIONS WITHIN THE DEPARTMENT OF POLICE; THE ENVIRONMENTAL RESOURCES MANAGEMENT DIVISION WITHIN THE DEPARTMENT OF PUBLIC WORKS; THE DEPARTMENT OF CODE COMPLIANCE; THE DEPARTMENT OF THE CONVENTION CENTER; THE DEPARTMENT OF THE BASS MUSEUM OF ART; PROVIDING FOR THE ELIMINATION OF: THE ADMINISTRATION DIVISION WITH IN THE DEPARTMENT OF GENERAL SERVICES; HOUSING AND COMMUNITY DEVELOPMENT DIVISION WITHIN THE DEPARTMENT OF DEVELOPMENT, DESIGN AND HISTORIC PRESERVATION; PROVIDING FOR THE NAME CHANGE OF: THE DEPARTMENT OF DEVELOPMENT, DESIGN AND HISTORIC PRESERVATION SERVICES TO DEVELOPMENT, DESIGN AND HISTORIC PRESERVATION; THE ECONOMIC DEVELOPMENT AND PLANNING, DESIGN AND HISTORIC PRESERVATION SERVICES DIVISIONS WITHIN THE DEPARTMENT OF DEVELOPMENT, DESIGN AND HISTORIC PRESERVATION TO ECONOMIC AND COMMUNITY DEVELOPMENT AND PLANNING, DESIGN AND HISTORIC PRESERVATION DIVISIONS; THE FIELD OPERATIONS DIVISION WITHIN THE DEPARTMENT OF POLICE TO PATROL DIVISION; THE PROCUREMENT/WAREHOUSE DIVISION WITHIN THE DEPARTMENT OF GENERAL SERVICES TO PROCUREMENT DIVISION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, there currently exists a need to make modifications to the existing Administrative structure of various organizational units and departments; and WHEREAS, the following changes reflect the current state of such units. NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION that the City of Miami Beach, Florida: SECTION 1: That Section 2-6 of Miami Beach City Code Chapter 2, entitled "Administration" is hereby amended to read as follows: Sec. 2-6. TO: Mayor Seymour Gelber and Members of the City Commission FROM: Jose Garcia -Pedrosa City Manager DATE:December 4, 1996 SUBJECT: An Ordinance of e Mayor and City Commission of the City of Miami Beach, Florida, Amending Miami Beach City Code Chapter 2, Section 2-6, Entitled "Enumeration of Organizational Units"; Repealing All Ordinances In Conflict Herewith; Providing For Severability; And Providing For Effective Date. RECOMMENDATION Approve the Ordinance amendment. BACKGROUND The Ordinance amendment was approved on first reading on November 20, 1996. The organization changes that are incorporated in the FY 1996-97 Adopted Budget reflect a decision making process which guided the development of the budget and a commitment to standards of excellence in delivering city services. The citywide reorganization announced on March 14, 1996 delineated the staff assignments necessary to fulfill this commitment. A formal organizational restructuring is now required to complete the implementation process. A summary of the recommendations and rationale follows: CREATION OF NEW ORGANIZATIONAL UNITS 1. The creation of the Office of Children's Affairs formally establishes support for the leadership role necessary to impact the issues and activities affecting children within the City of Miami Beach. 2. Formation of the Office of Internal Audit (formerly included in Office of Management and Budget) is sought to strengthen its organizational authority for the independent review of compliance with all applicable administrative and fiscal policies, procedures, regulations and laws. 3. The formation of Administration, On Street Parking, and Off Street Parking Divisions within the Department of Parking will increase management control and assist profit and loss evaluation of this fund. The formal creation of the Criminal Investigations and Technical Services Divisions within the Department of Police reflects an ongoing commitment to enhance accountability and management control within the department. 5. The formation of the Environmental Resources Management Division within the Department of Public Works will provide comprehensive environmental compliance, site restoration, hazardous materials storage and disposal services for all city facilities. 6. The formation of the Department of Code Compliance will result in a consistent and proactive approach to the administration of code enforcement activities. This function was formerly a division of the Building Services Department. 7. The inclusion of the Department of the Convention Center is necessary to correct an organizational funding anomaly which requires its inclusion. This department was previously not formally established. 8. Formation of the Department of the Bass Museum of Art will formally reflect its change from a division of the Department of Recreation, Culture and Parks to a separate function. ELIMINATION OF ORGANIZATIONAL UNITS 1. Elimination of the Administration Division within the General Services Department will result in cost savings incorporated in the FY 97 budget. 2. Elimination of the Housing and Community Development Division reflects the intradepartmental shift of responsibility for housing and community development activities. NAME CHANGES 1. The removal of "Services" from Development, Design and Historic Preservation Department, and the Planning, Design and Historic Preservation Division designations is a minor but appropriate revision of the mission of the department. The renaming of the Economic and Community Development Division reflects the intradepartmental shift of responsibility for community development and housing activities. 2. The renaming of the Field Operations Division to Patrol, again reflects an ongoing commitment to enhance accountability and management control within the department. 3. The renaming of the Procurement Division reflects the transfer of the Warehouse function to the Fleet Management Division to appropriately allocate these costs throughout all funds. Department Enumerations December 4, 1996 Page - 3 - CONCLUSION Based on the foregoing, the Administration recommends that the City Commission approve the attached Ordinance amendment. PROCEDURE Miami Beach City Code, Chapter 2 Section 2-6 provides for the enumeration of organizational units, administrative officers, agencies and their units.
