ORDINANCE NO. 99-3165 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AMENDING CHAPTER 2 ENTITLED "ADMINISTRATION;" BY AMENDING ARTICLE • III ENTITLED "AGENCIES, BOARDS AND COMMITTEES;" BY AMENDING DIVISION 7 ENTITLED " FASHION, FILM, ENTERTAINMENT AND PRODUCTION COMMITTEE" BY CHANGING THE NAME OF THE COMMITTEE TO THE "PRODUCTION INDUSTRY COUNCIL", AMENDING THE PURPOSE OF THE COMMITTEE, AND DELETING THE REPRESENTATIVE FROM THE STATE ENTERTAINMENT COMMISSION AS A NONVOTING, EX-OFFICIO MEMBER; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Fashion, Film, Entertainment and Production Committee has unanimously recommended that its name be changed to the Production Industry Council in order to provide a simple, all inclusive name which uses standard industry terminology utilized in the entertainment, production and media industries and to amend the purpose of the Committee accordingly; and WHEREAS,the State Entertainment Commission is no longer in existence,therefore reference to such Commission, from which a non-voting ex-officio member on the Committee was included, should be deleted. NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AS FOLLOWS: SECTION 1. That Division 7 entitled "Fashion, Film, Entertainment and Production Committee" of Article III, Chapter 2 of the Miami Beach City Code is hereby amended as follows: DIVISION 7. FASHION, FILM, ENTERTAINMENT AND PRODUCTION COMMITTEE PRODUCTION INDUSTRY COUNCIL Sec. 2-71. Established; purpose; powers and duties; composition (a) Established. There is hereby established the fashion, film, cntcrtainmcnt and Production Industry Council whose purposes, power and duties, composition, membership qualification and general governing regulations are as set forth in this section. (b) Purpose. The purpose of the :--'i -, --, - - - - - - - -- Production Industry Council is to benefit the City of Miami Beach by encouraging the expansion and well-being of the entertainment, production and media industries and by making recommendations to the City Commission. (c) Powers and duties. The fashion, film, cntcrtainmcnt and production committee Production Industry Council shall have the following duties, functions, powers and responsibilities: (1) To serve in an advisory capacity to the city commission and the city administration,with respect to matters pertaining to the fashion, film,television and recording industries of the city. (d) Composition. The Committee Council shall be composed of 11 4-2 members, including nine voting members, appointed by the commission at-large: Representatives from the Metro Miami-Dade Office of Film, Television and Print, statc of - - - -- • - - -- -- - and the city film,television and print office shall be included as nonvoting, ex-officio members. 2 SECTION 2. CODIFICATION It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section", "article," or other appropriate word. SECTION 3. REPEALER All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4. SEVERABILITY If any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. SECTION 5. EFFECTIVE DATE This Ordinance shall take effect on the 30th day of January 1999. PASSED and ADOPTED this 20th day of January , 1999. ADMINISTRATION RECOMMENDATION Adopt the ordinance. BACKGROUND At the December 1, 1998 meeting of the Fashion, Film, Television and Recording committee two (2) items were unanimously recommended for City Commission approval. The first item is to change the name of the committee to the "Production Industry Council". It is believed that the name change will resolve the awkwardness of the current name. The proposed new name is simple, all-inclusive, and helps clarify what the Committee is all about by using standard industry terminology. Secondly, the Committee recommends that the City Commission accept the proposed "purpose" statement. The old purpose statement reads: "The purpose of the committee is to address the needs and concerns of the production industry by making recommendations to the city commission in order to encourage the expansion and well-being of the fashion, film, entertainment and production industries." AGENDA ITEM R ✓ A DATE 1-20- (9 • The proposed purpose statement is as follows: "The purpose of the Production Industry Council is to benefit the City of Miami Beach by encouraging the expansion and well-being of the entertainment, production and media industries and by making recommendation to the City Commission." This ordinance was approved on first reading at the January 6, 1999 commission meeting. Since the ex officio member "state entertainment commission" no longer exists, Commissioner Liebman requested that it be eliminated on second reading. This change is incorporated into the ordinance. CONCLUSION: Based on the recommendations of the Fashion, Film, Television and Recording committee, the Administration recommends that the City Commission adopt the ordinance.
