Ordinance 99-3168 ORDINANCE NO. 99-3168 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA AMENDING MIAMI BEACH CITY CODE CHAPTER 2 "ADMINISTRATION," ARTICLE III ENTITLED "AGENCIES, BOARDS AND COMMITTEES," SECTION 2-22(9) THEREOF BY PROVIDING FOR AUTOMATIC REMOVAL OF AN AGENCY, BOARD OR COMMITTEE MEMBER FAILING TO ATTEND 33% OF THE REGULARLY SCHEDULED MEETINGS PER CALENDAR YEAR, AS CALCULATED BY ROUNDING EITHER UP OR DOWN TO THE NEAREST WHOLE NUMBER; PROVIDING FOR CODIFICATION, REPEALER, SEVERABILITY, AND EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. AMENDMENT OF CITY CODE SECTION 2-22(9). That Miami Beach City Code Chapter 2 "Administration", Article III "Agencies, Boards and Committees", Section 2-22(9) thereof is hereby amended to read as follows: If any member of an agency, board or committee fails to attend three rcgularly schcdulcd mcctings per ycar or 33% per ycar of the regularly scheduled meetings per calendar year, whichcvcr is grcatcr, such member shall be automatically removed. To calculate the number of absences under the 33%formula. .4 or less rounds down to the next whole number and .5 or more rounds up to the next whole number. SECTION 2. CODIFICATION It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of the City of Miami Beach,Florida. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section", "article," or other appropriate word. SECTION 3. SEVERABILITY If any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction,then said holding shall in no way affect the validity of the remaining portions of this ordinance. SECTION 4. REPEALER All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 5. EFFECTIVE DATE This Ordinance shall take effect the 30th day of January , 1999. PASSED and ADOPTED this 20th day of January , 1999. BACKGROUND: At the commission meeting of December 2, 1998, the City Commission approved on first reading an ordinance providing for "the automatic removal of any agency, board or committee member failing to attend the greater of four or 33% of the regularly scheduled meetings per calendar year." The second reading of the ordinance was held on December 16, 1998. The item was opened and continued to the January 6th commission meeting with instructions to the Administration to develop additional language to equitably handle any agency, board, or committee which schedules less that twelve (12) regular meetings per calendar year. At the commission meeting of January 6th, the item was opened and continued to the January 20th meeting with instructions to clarify the 33% calculation and the rounding. CONCLUSION: The Administration recommends that the language"the automatic removal of any agency, board or committee member failing to attend the greater of four or 33% of the regularly scheduled meetings per calendar year." be amended.
