ORDINANCE NO. 99-3174 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA,AMENDING ORDINANCE NO. 789, THE CLASSIFIED EMPLOYEES SALARY ORDINANCE, BY ABOLISHING THE CLASSIFICATIONS OF CODE COMPLIANCE FIELD SUPERVISOR, PERSONNEL REPRESENTATIVE, RECREATION DRIVER/WORKER,AND STOREKEEPER/MECHANIC; ESTABLISHING THE CLASSIFICATIONS OF CODE COMPLIANCE ADMINISTRATOR, FLEET SERVICE REPRESENTATIVE, IRRIGATION SYSTEM SUPERVISOR, SENIOR ELECTRICAL INSPECTOR, AND SENIOR MECHANICAL INSPECTOR; CREATING A NEW GROUP V, BEING THOSE CLASSIFICATIONS WHICH WILL HAVE THE GOVERNMENT SUPERVISORS ASSOCIATION OF FLORIDA AS THE EXCLUSIVE BARGAINING REPRESENTATIVE; INCREASING BY 8% RETROACTIVELY AS OF OCTOBER 1, 1998, AND BY 3% ON MAY 10, 1999, THE MAXIMUM OF THE SALARY RANGE FOR EACH CLASSIFICATION REPRESENTED BY THE AMERICAN FEDERATION OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES (AFSCME) AND EACH CLASSIFICATION REMAINING IN GROUP VI, BEING OTHER CLASSIFICATIONS IN THE CLASSIFIED SERVICE NOT COVERED BY A BARGAINING UNIT; DELETING THE PROVISION THAT AFSCME CLASSIFICATIONS MAY RECEIVE COMPENSATION GREATER THAN THE MAXIMUM OF THE RANGE; PROVIDING FOR A REPEALER, SEVERABILITY, CODIFICATION, AND EFFECTIVE DATES. WHEREAS,there is a need to create certain classifications, abolish certain classifications, and change the salary ranges of certain classifications in order to ensure that the City has an employee classification and compensation system which is fair and equitable; and WHEREAS,there is also a need to increase by 8%retroactively as of October 1, 1998, and by 3% on May 10, 1999, the maximum salary of each classification represented by the AFSCME bargaining unit and each classification remaining in Group VI, being Other classifications in the classified service not covered by any bargaining unit, and to delete the provision that AFCME classifications may receive compensation greater than the maximum of the range in order to ensure that the City has an employee classification and compensation system which will achieve internal equity and external competitiveness. WHEREAS,by secret ballot, in an election conducted by the Public Employees Relations Commission (PERC) June 23,1998, through July 14, 1998, the employees in specific supervisory classifications, which were in the classified service of the City, but which were previously not represented by a collective bargaining unit, elected the Government Supervisors Association of Florida to be the exclusive bargaining representative of those employees pursuant to Section 447.307 (3) (b), Florida Statutes and according to Certification number 1205 issued by PERC on July 30, 1998. 9 NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA: SECTION 1: Section 1 of Ordinance No. 789 is amended to read as follows: GROUP I AMERICAN FEDERATION OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES BI-WEEKLY COMPENSATION JOB CLASSIFICATION JOB CLASS NO. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4: SEVERABILITY. If any section, subsection, clause, or provision of this ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 5: CODIFICATION. It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or re-lettered to accomplish such intention, and the word"ordinance"may be changed to "section", "article", or other appropriate word. SECTION 6: EFFECTIVE DATES. Section 1 will be effective retroactively as of October 1, 1998. Section 2 will be effective as of May 10, 1999. PASSED and ADOPTED this 3rd day of March , 1999. Kasdin and DATE: March 3, 1999 Members of the City Co mission FROM: Sergio Rodriguez 4P City Manager )/ SUBJECT: ORDINANCE AMENDING ORDINANCE NO. 789, THE CLASSIFIED SALARY ORDINANCE BY ABOLISHING THE CLASSIFICATIONS OF CODE COMPLIANCE FIELD SUPERVISOR, PERSONNEL REPRESENTATIVE, RECREATION DRIVER/WORKER, AND STOREKEEPER/MECHANIC; ESTABLISHING THE CLASSIFICATIONS OF CODE COMPLIANCE ADMINISTRATOR, FLEET SERVICE REPRESENTATIVE, IRRIGATION SYSTEM SUPERVISOR, SENIOR ELECTRICAL INSPECTOR,AND SENIOR MECHANICAL INSPECTOR;CREATING A NEW GROUP V, BEING THOSE CLASSIFICATIONS WHICH WILL HAVE THE GOVERNMENT SUPERVISORS ASSOCIATION OF FLORIDA AS THE EXCLUSIVE BARGAINING REPRESENTATIVE; INCREASING BY 8% RETROACTIVELY AS OF OCTOBER 1, 1998, AND BY 3% ON MAY 10, 1999,THE MAXIMUM OF THE SALARY RANGE FOR EACH CLASSIFICATION REPRESENTED BY THE AMERICAN FEDERATION OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES (AFSCME) AND EACH CLASSIFICATION REMAINING IN GROUP VI, BEING OTHER CLASSIFICATIONS IN THE CLASSIFIED SERVICE NOT COVERED BY A BARGAINING UNIT; DELETING THE PROVISION THAT AFSCME CLASSIFICATIONS MAY RECEIVE COMPENSATION GREATER THAN THE MAXIMUM OF THE RANGE ADMINISTRATION RECOMMENDATION-: Adopt the Ordinance. ANALYSIS: This Ordinance was approved on first reading at the February 17, 1999, Commission meeting. By establishing the classifications noted below, the Administration will provide appropriate titles and salary ranges for individuals performing the cited duties and facilitate implementation of the provisions of the 1998/99 budget and departmental reorganizations: Code Compliance Administrator($35,261 - 52,195) -responsible technical and supervisory work in the enforcement of various laws, codes and ordinances primarily relating to Code Compliance AGENDA ITEM 5 C. DATE 3:3-99 Fleet Service Representative ($20,615 - 32,984) - performs difficult technical and routine administrative work in the coordination of vehicle service Irrigation System Supervisor($24,341 -42,060)-specialized supervisory and technical work in the landscaping and maintenance of the City's properties Senior Electrical Inspector ($33,934 - 58,638) - highly responsible administrative, supervisory, and technical work enforcing compliance with laws, codes, and ordinances primarily in the electrical area of the building department Senior Mechanical Inspector ($33,934 - 58,638) - highly responsible administrative, supervisory, and technical work enforcing compliance with laws, codes, and ordinances primarily in the mechanical area of the building department The following classifications are being abolished as a result of departmental reorganization and/or because their duties are being performed by other classifications: Code Compliance Field Supervisor Personnel Representative Recreation Driver/Worker Storekeeper/Mechanic As was described in Letter to Commission 107-1998,the classifications listed below will form a new group within the Ordinance to be represented by the Government Supervisors Association of Florida. Previously,employees in these classifications were in the group"OTHER CLASSIFICATIONS IN THE CLASSIFIED SERVICE"and were not represented by any collective bargaining agent. Air Conditioning Supervisor Beach Patrol Operations Supervisor City Surveyor Communications Supervisor Crime Scene Supervisor Electrician Supervisor Electronics/Instruments Supervisor Fleet Operations Supervisor Maintenance Supervisor Metered Service Supervisor Paint Supervisor Park Operations Supervisor Parking Facilities Supervisor Parking Operations Supervisor Plumbing Supervisor Property Operations Supervisor Pumping Operations Supervisor Recreation Supervisor I Senior Building Inspector Senior Engineering Inspector Street Operations Supervisor Tennis Center Supervisor Warehouse Supervisor Water Field Operations Supervisor Water Service Representative The pay range changes addressed in this Ordinance relate to job classifications of positions represented by AFSCME as well as those occupied by non-union classified employees. This group of ranges was implemented in December 1995 pursuant to a consultant's pay study and have not been increased since that time. As many of these non-union positions supervise union represented classifications whose ranges have increased due to collective bargaining agreements, salary compression has resulted. External competitiveness and internal equity are dimensions we must consider in maintaining a proper pay plan. While the pay ranges adopted in 1995 satisfied those criteria, our current review reveals that external competitiveness and internal equity are now at odds with each other. An evaluation of external competitiveness indicates that the City is near or at average salary levels. Internal equity analysis indicates that managerial and supervisory salary ranges are too compressed with those of non-supervisory personnel. This recommendation strikes a balance between the two methods of salary comparison. Given these considerations, we are recommending that the maximum of the pay ranges for the classifications addressed be increased by 8% October 1, 1998, and 3% in May 1999, when the AFSCME collective bargaining agreement calls for a 3%salary adjustment. The recommendations made here relate only to pay ranges. By establishing five (5) new classifications, abolishing four(4) classifications, and increasing the maximum salary of each classification covered by AFSCME and of each classified classification not represented by any bargaining unit, this Ordinance will ensure that the City has an employee classification and compensation system which is fair and will provide a balance between internal equity and e ternal competitiveness.
