AN ORDINANCE OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, AMENDING ORDINANCE NO. 1605 AS •
AMENDED, WHICH ESTABLISHED POSITIONS IN THE
UNCLASSIFIED SERVICE AND SALARY RANGES FOR
UNCLASSIFIED EMPLOYEES, BY AMENDING THOSE
PROVISIONS RELATING TO THE EMPLOYEES OF THE
CITY ATTORNEY'S OFFICE BY ABOLISHING THE
DISTINCTION BETWEEN PERSONS EMPLOYED BEFORE
AND AFTER OCTOBER 1, 1992; ABOLISHING THE STEP
SYSTEM; AMENDING SALARY RANGES FOR THE CITY
ATTORNEY, CHIEF DEPUTY, DEPUTY, AND FIRST
ASSISTANT CITY ATTORNEYS,SENIOR ASSISTANT CITY
ATTORNEYS AND ASSISTANT CITY ATTORNEYS II,
OFFICE MANAGER, LEGAL SECRETARIES,
PARALEGALS AND RECEPTIONIST; PROVIDING FOR
REPEALER, SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, the compensation system for Unclassified Employees in the City Attorney's
Office originated in Ordinance #1605, adopted September 28, 1966, and has continued with a
number of amendments, as reflected in the City Personnel Records, with reference to factors no
longer relevant, such as a distinction in compensation between employees engaged before and after
October 1, 1992 and a"Step System", neither of which have any purpose except to complicate the
work of the Human Resources Department of the City; and
WHEREAS,in order to simplify and facilitate management and efficiency of compensation
planning in the City Attorney's Office and more fully ensure fairness and equity in compensation
programs, there is a need to repeal those portions of the existing Ordinance#1605 which establish
two separate categories based upon date of employment, abolish certain classifications, change the
titles of certain classifications and change salary ranges to conform compensation to realistic
competition in the community as well as internally within the City and abolish the "Step System".
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. AMENDMENT TO SECTION 1 OF ORDINANCE NO. 1605.
That those provisions of Section 1, including Section 1 A and 1 B, of Ordinance No. 1605
of the City of Miami Beach, as amended by Ordinance#97-3096 and further amended by Ordinance
#98-3160 relating to the Office of City Attorney, are hereby further amended to read as follows:
SECTION 1. The following shall constitute the Compensation Plan for the offices and
positions in the Unclassified Service which are hereby created or recreated in accordance with the
following organization plan, and a schedule of rates of salaries by Ordinance No. 88-2611 effective
April 25, 1988 (commencement of nearest pay period to May 1, 1988) for said offices and positions
is hereby established. The City Manager is authorized to prescribe a compensation plan for offices
and positions in the Unclassified Service; provided that any office or position hereafter created or
recreated shall be authorized by an ordinance of the City Commission amending the Unclassified
Salary Ordinance, and said ordinance shall not-be any budget ordinance of the City; to establish a
schedule of salaries thereof that are in accordance with the budget adopted by the City Commission
for that fiscal year; to provide for future cost of living increases for these positions in accoidallce
with and at the saiiie time as such negotiated incleases ale plovided to iiieillhe's of the Miami Beach
Employees Benevolent Association Unclassified Employees.Notwithstanding any other provisions
of this or any other legislation, commencing with the 1995/1996 fiscal year, all salary changes for
all employees in the Office of the City Attorney, except adjustments for cost of living established
by the City Manager for Unclassified Employees,shall be recommended by the City Attorney and
referred to the Commission Oversight Committee on the Office of the City Attorney before final

budget approval by the City Commission. Employees of the City Attorney's Office shall continue
to be Members of the Retirement System for Unclassified Employees and Elected Officials, that
nothing herein amends those provisions, and that they shall retain all rights and benefits thereunder.
All benefits, in addition to salary, shall be in accord with those for the unclassified executives in the
City Manager's Office.
SECTION 2. AMENDMENT OF ION 1 A OF O DINANCE NO. 1605.

follows.

SECTION 3.
The step system as relates to the City Attorney's office is hereby abolished.
SECTION 4. REPEALER
All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed.
SECTION__5 SEVERABILITY
If any section, subsection, clause or provision of this Ordinance is held to be invalid, the
remainder shall not be affected by such invalidity.
SECTION 6. EFFECTIVE DATE

SUBJECT: COMPENSATION PLAN FOR THE CITY ATTORNEY'S OFFICE
In addressing the proposed budget for the City Attorney's Office for the coming year, as well as
consideration of internal reorganization in this office, I have reviewed, or attempted to review, the
history of compensation of employees in the Unclassified Service in the City,particularly as relates
to the City Attorney's Office.Unclassified Employees' Compensation Plan originated in Ordinance
#1605 adopted October 28, 1966 and has been the subject of numerous amendments since that time.
At this time, some of the problems include:
a) There are two compensation plans in the Ordinance: One for employees whose
employment commenced prior to October 1, 1992 and one for those who started
afterwards (the two tier system). Due to the passage of time and the many
amendments in the Compensation Plan throughout the years that distinction has
become virtually meaningless,but it still clutters the Code.
b) Employees' salaries are subject to a "step" program that also is virtually
meaningless, except for the difficulty it imposes upon those people in Human
Resources whose job it is to make out the bi-weekly pay checks of all employees.

As part of the overall organizational review of the Unclassified Employees of the City Attorney's
Office,I wish to abolish any reference in the Ordinance to date of employment and a"step" system.
In fact,I would like to join with the Administration in adopting the process recently approved by the
Commission,when it enacted Ordinance#99-3175. In so doing, I propose assignment of minimum
and maximum compensation ranges similar to those established for other City Unclassified
Personnel, who are most closely comparable to those in the City Attorney's Office.
The proposed Ordinance,which is addressed by this memorandum,will initiate the changes I have
referred to above and effectively bring the City Attorney's Compensation Plan in line with the rest
of the Unclassified Employees in the City.
Since the proposal simply sets salary ranges, its adoption has no present fiscal impact.
This Ordinance was approved on first reading on June 9, 1999.
