AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, REPEALING, IN ITS ENTIRETY,
CHAPTER 2, DIVISION 24, SECTIONS 2-190.81 THROUGH 2-190.84, OF
THE MIAMI BEACH CITY CODE, ENTITLED "TOURIST AND
CONVENTION CENTER EXPANSION AUTHORITY"; SAID REPEALER
HAVING THE EFFECT OF SUNSETTING THE AUTHORITY; PROVIDING
FOR SEVERABILITY; CODIFICATION; REPEALER; AND AN
EFFECTIVE DATE.
WHEREAS, the Miami Beach Tourist and Convention Center Expansion Authority
(TCCEA)was established pursuant to Ordinance No. 97-3086, and under the authority delegated to
the City pursuant to Section 212.057, Florida Statutes; and
WHEREAS, pursuant to the above-referenced Ordinance, TCCEA has the sole power to
approve the concept, location, and program and design of the Convention Center expansion and
improvements therein, and to administer and disburse the proceeds of the Miami-Dade County
Convention Development Tax and any other related source of revenue; and
WHEREAS, pursuant to the recommendation of the Administration, the Mayor and City
Commission herein acknowledge that the function and mission of TCCEA, and the primary
purpose(s) for which it was established, has been accomplished and completed; and
WHEREAS, the City is grateful for the support and advice provided by TCCEA board
members throughout the years, but, upon recommendation of the Administration, herein finds that
it is in the best interest to sunset TCCEA.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. REPEALER OF CHAPTER 2.DIVISION 24.SECTIONS 2-190.81 THROUGH
2-190.84. OF THE MIAMI BEACH CITY CODE. ENTITLED "TOURIST
AND CONVENTION CENTER EXPANSION AUTHORITY."
1. That Miami Beach City Code Chapter 2, Division 24, Sections 2-190.81 through 2-
190.84, entitled "Tourist and Convention Center Expansion Authority" is hereby repealed in its
entirety.
SECTION 2. SEVERABILITY.
If any section, subsection,clause or provision of this Ordinance is held invalid,the remainder
shall not be affected by such invalidity.
SECTION 3. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is
hereby ordained that the provisions of this ordinance shall become and be made a part of the Code
of the City of Miami Beach,Florida. The sections of this ordinance may be renumbered or relettered
to accomplish such intention, and the word "ordinance" may be changed to "section", "article," or
other appropriate word.
SECTION 4. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 5. EFFECTIVE DATE.
This Ordinance shall take effect on the 3rd day of July 1999.

ADMINISTRATION RECOMMENDATION:
Adopt the Ordinance.
BACKGROUND
The Tourist and Convention Center Expansion Authority (TCCEA)was originally formed to handle
and oversee the construction and expansion of the Miami Beach Convention Center and to administer
all funds that were set aside for the capital upkeep and maintenance of the facility from the
Convention Center Development Tax, as prescribed by Florida Statute and the Miami Beach City
Code.
The construction and expansion of the facility is complete and the funds that were set aside for capital
upkeep and maintenance have been expended. Therefore, the primary functions and charge to the
Tourist and Convention Center Expansion Authority (TCCEA) as described by the State Statute and
the Miami Beach City Code have been completed.
In addition to TCCEA, the Convention Center Advisory Board (CCAB) provides recommendations
to the Administration and City Commission, however, the mission of this board does not overlap with
those of TCCEA. The Convention Center Advisory Board's mission as established and set forth in
the Agencies, Board and Committees Ordinance is to act in an advisory capacity to the City
Commission on matters regarding the operation of the Convention Center to ensure the highest
quality in management and operation by the management group of both the Miami Beach Convention
Center and the Jackie Gleason Theater of the Performing Arts; to monitor and consult on the
relationship of the Greater Miami and the Beaches Convention and Visitors Bureau with the Miami
Beach Convention Center; and to ensure the highest quality of maintenance of the facilities.

ANALYSIS
Since May 1998, the TCCEA board began meeting every other month. The board is supposed to
have 11 members, but, over the past year, the membership base has been decreased due to the
removal of members based on lack of attendance or resignation. At this time there are only(6) active
members, making(4)members in attendance a quorum. The actual attendance numbers for the past
year are as follows:

The construction and expansion of the Miami Beach Convention Center was completed in 1991. The
funds set aside for the capital purchases, upkeep and maintenance of the Miami Beach Convention
Center have been completely dispersed and used for that purpose. Based on the Interlocal Agreement
that was negotiated and approved by the City Commission on July 3, 1996, the funds of$35 million
reflected in the Interlocal Agreement that were transferred from the County to the City, have been
obligated by the Administration and City Commission to be dispersed and used through fiscal year
2002. Beginning in 2003 the County, based on the Interlocal Agreement, will begin to fund "repair
and replacement" costs of the Miami Beach Convention Center at a rate of approximately $1.1 million
per year. TCCEA does not have any authority under the state statute to obligate or disperse these
funds.
In their June 1999 meeting the (4) members present voted unanimously to remain in existence and
to request new duties and responsibilities from the City Commission and City Administration.
This Ordinance sunsetting TCCEA was approved on first reading on June 9, 1999, and is now
presented to the City Commission for second and final reading.
CONCLUSION
The Administration recommends that the City Commission sunset TCCEA to September 30, 2002
and establish a Capital Projects Oversight Committee with primary duties and responsibilities to
include the monitoring and oversight of the $35 million of the capital projects plan.
