AN ORDINANCE AMENDING THE CITY OF MIAMI BEACH
CITY CODE CHAPTER 45, ENTITLED "WATER,"
AMENDING SECTION 45-4, ENTITLED "SCHEDULE OF
RATES AND TAPPING CHARGES," TO INCREASE THE
WATER SUPPLY SERVICE CHARGE IMPOSED BY THE
CITY FROM ONE DOLLAR AND FIFTY-ONE CENTS ($1.51)
PER THOUSAND GALLONS TO ONE DOLLAR AND
EIGHTY CENTS ($1.80) PER THOUSAND GALLONS AND
ADJUST THE SCHEDULE OF RATES FOR THE MINIMUM
MONTHLY WATER SERVICE CHARGE; FURTHER
AMENDING SECTION 45-20.2, ENTITLED "SANITARY
SEWER SERVICE CHARGE," TO INCREASE THE
SANITARY SEWER SERVICE CHARGE IMPOSED BY THE
CITY FROM THREE DOLLARS ($3.00) PER THOUSAND
GALLONS TO THREE DOLLARS AND FORTY-THREE
CENTS ($3.43) PER THOUSAND GALLONS; PROVIDING
FOR A REPEALER, SEVERABILITY AND AN EFFECTIVE
DATE.
WHEREAS, the City of Miami Beach pays the Miami -Dade Water and Sewer Department
a fee for the treatment of sewage; and
WHEREAS, the City of Miami Beach purchases potable water from the Miami -Dade
Water and Sewer Department for resale; and
WHEREAS, the Miami Dade Water and Sewer Department will be increasing the
wholesale volume sewer customer rate and the wholesale water supply service rate for the fiscal
year, beginning October 1, 1997; and
WHEREAS, it is necessary to pass these rate increases on to the consumers; and
WHEREAS, the rate increases provided herein also provide for the funding of the water
and sewer revenue bonds and the Department of Environmental Resource Management fee.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA as follows:
SECTION 1: Section 45-4 of Chapter 45, entitled "Water," of the Code of the City of
Miami Beach, Florida, is hereby amended to read as follows:
Sec. 45-4. Schedule of rates and tapping charges.
(a) Every water supply service shall have a monthly minimum service
charge on each service installed, varying with and based upon the size of
the service pipe required and installed in accordance with the rules of the
Public Works Department. This minimum charge shall be in accordance
with the following schedule and shall entitle the consumer to have supplied
through the meter the number of gallons of water set forth in the table.

There shall not be a rental charge on meters.
(b) For quantities of water supplied in excess of the amount set forth in
subsection (a) above based on the particular size of the service pipe, the water
rate shall be S-175-1-$1.80 per thousand gallons, which rate shall be prorated for
each hundred gallons in the event of increments of less than one thousand
gallons, for non -municipal consumers of water.
(c) The rates and charges provided in this Section shall be and become effective
and binding on October -54, 19967.
SECTION 2: Section 45-20.2 of Miami Beach City Code Chapter 45, entitled "Water," is hereby
amended to read as follows:
Sec. 45-20.2. Sanitary sewer service charge.
There is hereby imposed, upon all premises within the city connected to or using
the facilities of the city's sanitary sewer system, a monthly sanitary sewer service
charge. Such sanitary sewer service charge shall be in an amount equal to three
dollars and forty three cents per thousand gallons of water delivered to the
consumer, which charge shall be prorated for each hundred gallons in the event of
increments of less than one thousand gallons, as shown by the water bills rendered
in accordance with this chapter. The sanitary sewer service charge shall be and
become effective and binding on October -54, 19967. The amount of such sanitary
sewer service charge shall be shown as a separate item on such water bills and
shall be paid by the owner, tenant or occupant in possession of such premises at
the same time and in the same manner as is provided in this chapter for the
payment of water bills. Provided, however, that the customer may file (between
October 1 and September 30 of each year) an affidavit on the form prescribed by
the City, stating that water was used regularly for sprinkling or for other purposes
that did not enter the sanitary sewer system during the preceding fiscal year
(October 1 through September 30). Upon verification by a representative of the
City, the customer shall receive a credit equal to six percent of the total amount of
sanitary sewer service charges paid by the customer during the preceding year.
Further provided, that the provisions of this section shall not be applicable to any
water sold and delivered through separate meters measuring water delivered and
consumed solely for swimming pools, lawn sprinkler systems or other purposes not
requiring the use of sanitary sewer system facilities of the City.
SECTION 3. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 4. SEVERABILITY.
If any section, subsection, sentence, clause, phrase or portion of this Ordinance is, for any
reason, held invalid or unconstitutional, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the validity or constitutionality
of the remaining portions of this Ordinance.
SECTION 5. EFFECTIVE DATE.
This Ordinance shall take effect on the 4th day of October , 1997, which is
10 days after its adoption.

ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission adopt the attached ordinance to amend
Chapter 45, Section 45-4, to increase the rate for water supply service; and adjust the schedule of
rates for the minimum monthly service charge for water supply service and Section 45-20.2, to
increase the sanitary sewer service charge imposed by the City upon all premises connected to or
using the City's sanitary sewer system.
BACKGROUND
In mid June, 1997 the City was notified by the Miami -Dade Water and Sewer Department
(WASAD) of a proposed increase (subject to County Commission approval) in the wholesale water
supply rate and the volume sewer customer rate for the 1997/98 fiscal year. Following receipt of this
initial notification from the WASAD, the proposed 1997/98 budget for the City's Water and Sewer
Enterprise Fund was finalized and tentatively adopted by the City Commission on July 16, 1997.

In addition to the WASAD pass-through charge, the proposed budget contains rate increases for the
water and sanitary sewer service charges necessary which are to support the fund. In 1995, the City
issued $59 million of water and sewer revenue bonds to be used to pay for rehabilitation and upgrade
of the water and sewer systems. The proposed rate increase includes funding to pay the debt service
for this bond issue. The rate increase also includes a pass-through from the City for operation and
maintenance of the water and sanitary sewer systems and payment of the Dade County
Environmental Resource Management Department (DERM) fee levied to administer prevention of
pollution of the aquifer and to fund landfill closures.
The ordinance was adopted by the City Commission on first reading on September 10, 1997. The
proposed rate increases by the WASAD were adopted by the Dade County Commission following
the County's budget hearings on September 4th and September 16th. The proposed rate increases
by the City were considered by the Capital Improvements Finance Committee at the September 18,
1997 meeting. The Committee recommended that the City Commission adopt the proposed rates.
ANALYSIS
The proposed rate increases for water supply and sanitary sewer services are outlined below.
Water
The wholesale water supply rate to be charged will increase from $0.6688 per thousand gallons to
$0.7693 per thousand gallons. The new wholesale rate results in a $0.10 per 1,000 gallons or 15
percent increase to the consumer. In addition to the $0.10 pass-through rate increase, the proposed
rate increase of $0.29 includes a $0.15 increase to fund the debt service for the water and sewer
revenue bonds; a $0.03 increase for operating and maintenance of the system and a $0.01 increase
for the DERM fee. The proposed rate of $1.80 is less than the projected rate of $2.00 contained in
the rate study prepared to support the bond issue. The increase in the average monthly customer bill,
based on the proposed rate, is $4.35.
Sewer
The volume sewer customer rates would increase from an annualized average rate of $1.6253 per
thousand gallons to $1.6599 per thousand gallons. The result is an average increase of $0.04 per
thousand gallons or a two percent increase over the current wholesale rate. In addition to the $0.04
pass-through rate increase, the proposed rate increase of $0.43 includes a $0.32 increase to fund the
debt service for the water and sewer revenue bonds; a $0.05 increase for operating and maintenance
of the system and a $0.02 increase for the DERM fee. The proposed rate of $3.43 is less than the
projected rate of $4.30 contained in the rate study prepared to support the bond issue. The increase
in the average monthly customer bill, based on the proposed rate, is $6.45.

The average volume sewer rate consists of a dry season rate (November 1 to April 30) of $1.4755,
and a wet season rate (May 1 to October 31) of $1.8444. The wet season rate includes a twenty-five
percent infiltration/inflow surcharge to encourage reduction of stormwater and groundwater
infiltration and inflow into the sanitary sewer system. The City's Sanitary Sewer Infiltration and
Inflow Mitigation Program continues and it is estimated that the first 2 years of this program will
result in cost savings of $1.2 million by the City from sewage treatment fees paid to Dade County.
CONCLUSION:
The City Commission should adopt the attached ordinance to increase the water supply and sanitary
sewer erv.ce charges which is necessary to support the Water and Sewer Enterprise Fund.
