AN ORDINANCE OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, AMENDING ORDINANCE NO. 1605 AS
AMENDED, WHICH ESTABLISHED POSITIONS IN THE
UNCLASSIFIED SERVICE AND SALARY RANGES FOR
UNCLASSIFIED EMPLOYEES, BY AMENDING THOSE
PROVISIONS RELATING TO THE EMPLOYEES OF THE
CITY ATTORNEY'S OFFICE AMENDING UPPER SALARY
RANGES FOR THE CITY ATTORNEY, CHIEF DEPUTY,
DEPUTY, AND FIRST ASSISTANT CITY ATTORNEYS ,
SENIOR ASSISTANT CITY ATTORNEYS AND ASSISTANT
CITY ATTORNEYS II, OFFICE MANAGER, LEGAL •
SECRETARIES, PARALEGALS AND RECEPTIONIST;
PROVIDING FOR REPEALER, SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS, the compensation system for Unclassified Employees in the City Attorney's
Office originated in Ordinance #1605, adopted September 28, 1966, and has continued with a
number of amendments, as reflected in the City Personnel Records; and
WHEREAS,accomplishment of the objective of simplification,facilitation of management
and efficency of compensation planning in the City Attorney's Office has been an ongoing process
due to the constant change and evolvement of compensation of professionals in government service
in the South Florida community; and
WHEREAS, in order to more fully ensure fairness and equity in compensation programs,
there is a need to change salary ranges to conform compensation to realistic competition in the
community as well as internally within the City; and
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. AMENDMENT TO SECTION 1 OF ORDINANCE NO. 1605.
That those provisions of Section 1, including Section 1 A and 1 B, of Ordinance No. 1605
of the City of Miami Beach, as amended by Ordinance#97-3096 and further amended by Ordinance
#98-3160 relating to the Office of City Attorney, are hereby further amended to read as follows:
SECTION 1. The following shall constitute the Compensation Plan for the offices and
positions in the Unclassified Service which are hereby created or recreated in accordance with the
following organization plan, and a schedule of rates of salaries by Ordinance No. 88-2611 effective
April 25, 1988 (commencement of nearest pay period to May 1, 1988) for said offices and positions
is hereby established. The City Manager is authorized to prescribe a compensation plan for offices
and positions in the Unclassified Service; provided that any office or position hereafter created or
recreated shall be authorized by an ordinance of the City Commission amending the Unclassified
Salary Ordinance, and said ordinance shall not be any budget ordinance of the City; to establish a
schedule of salaries thereof that are in accordance with the budget adopted by the City Commission
for that fiscal year; to provide for future cost of living increases for Unclassified Employees.
Notwithstanding any other provisions of this or any other legislation, commencing with the
1995/1996 fiscal year,all salary changes for all employees in the Office of the City Attorney, except
adjustments for cost of living established by the City Manager for Unclassified Employees, shall be
recommended by the City Attorney and referred to the Commission Oversight Committee on the
Office of the City Attorney before final budget approval by the City Commission. Employees of the
City Attorney's Office shall continue to be Members of the Retirement System for Unclassified
Employees and Elected Officials, that nothing herein amends those provisions, and that they shall
retain all rights and benefits thereunder. All benefits, in addition to salary, shall be in accord with

those for the unclassified executives in the City Manager's Office.

SECTION 3. REPEALER
All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 4. SEVERABILITY
If any section, subsection, clause or provision of this Ordinance is held to be invalid, the
remainder shall not be affected by such invalidity.
SECTION 5. EFFECTIVE DATE
This Ordinance shall take effect on the 23rd day of September , 2000.

SUBJECT: ORDINANCE AMENDING ORDINANCE NO. 1605 ADDRESSING THE
UNCLASSIFIED SERVICE AND PARTICULARLY THE PERSONNEL IN
THE OFFICE OF CITY ATTORNEY.
Attached is an Ordinance amending Ordinance#1605, addressing the non classified service
and particularly the personnel in the Office of City Attorney. This Ordinance will amend the
biweekly range of City Attorney Office Employees.
This Ordinance is necessary to address the normal merit and cost of living increases as well
as to make adjustments in compensation necessary to compete with salaries provided in like
positions throughout the legal community. A minor amendment has been made since first reading
with regard to the biweekly range in one classification.
This Ordinance was approved on first reading and I request it be adopted on second reading.
