ORDINANCE NO. 98-3126
AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AMENDING ORDINANCE NUMBER 1613
RELATING TO THE GRANTING OF ANNUAL LEAVE, SICK LEAVE, AND
OTHER LEAVES; AMENDING SECTION 1 BY PROVIDING THAT THE TERM
IMMEDIATE FAMILY SHALL INCLUDE A DOMESTIC PARTNER;
PROVIDING FOR REPEALER; SEVERABILITY; AND AN EFFECTIVE DATE.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION I. Section (1 ) of Ordinance No. 1613 is amended to read as follows:
For the purpose of this ordinance Unclassified employees are hereby by defined
as all persons appointed to an unclassified position as enumerated in the
Compensation Plan for the offices and positions in the Unclassified Service. All
reference to employees in this ordinance refers to unclassified employees. For
purposes of this Ordinance, the term immediate family shall include an
employee's domestic partner as that term is defined in the City's Domestic
Partnership Ordinance.
SECTION 2. SEVERABILITY.
If any section, subsection, clause, or provision of this Ordinance is held invalid,
the remainder shall not be affected by such invalidity.
SECTION 3. REPEALER.
All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 4. EFFECTIVE DATE.
This Ordinance shall take effect on the 11th day of July , 1998.

RE: DOMESTIC PARTNERSHIP & BENEFITS
Please place the attached Domestic Partnership Ordinance on the June 17, 1998 agenda for
consideration by the City Commission. In addition, Ordinance No. 1335 and 1613 are included
for related amendments. The Ordinance recognizes the existence of domestic partnerships and
provides for employment benefits to domestic partners of City of Miami Beach employees.
The proposed Domestic Partnership Ordinance is consistent with the goals of the City's Human
Rights Ordinance and is in the best interest of the City and its employees. A time certain would
be appreciated for this item.
