Ordinance 2001-3288 ORDINANCE NO. 2001-3288 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA,AMENDING ORDINANCE NO. 789, • THE CLASSIFIED EMPLOYEES' SALARY ORDINANCE, FOR THE CLASSIFICATIONS IN GROUP V, BEING THOSE CLASSIFICATIONS COVERED BY THE GOVERNMENT SUPERVISORS ASSOCIATION OF FLORIDA,IN ACCORDANCE WITH THE NEGOTIATED AGREEMENT, CHANGING THE MINIMUM OF THE RANGES TO REFLECT THE CURRENT CLASSIFICATION AND PAY SYSTEM, RETROACTIVELY, EFFECTIVE WITH THE FIRST PAY PERIOD ENDING IN OCTOBER 2000; INCREASING THE MINIMUM AND MAXIMUM OF THE RANGES IN 2001 AND 2002 IN ACCORDANCE WITH THE CLASSIFICATION AND PAY SYSTEM; INCREASING THE SALARY OF EACH EMPLOYEE, RETROACTIVELY, BY 2% EFFECTIVE THE FIRST PAY PERIOD ENDING IN OCTOBER 2000; INCREASING THE SALARY OF EACH EMPLOYEE ACCORDING TO THE CONSUMER PRICE INDEX-U (ALL URBAN CONSUMERS) IN 2001 AND 2002 EFFECTIVE WITH THE FIRST PAY PERIOD ENDING IN OCTOBER 2001 AND OCTOBER 2002, RESPECTIVELY; WITH NO EMPLOYEE TO EXCEED THE MAXIMUM OF THE NEW RANGE AT ANY TIME; PROVIDING FOR A REPEALER, SEVERABILITY, CODIFICATION AND EFFECTIVE DATES. WHEREAS, on December 4, 2000, after seven sessions, negotiators for the City and the Government Supervisors Association of Florida, OPEIU Local 100, (GSA), successfully concluded negotiations for a three year collective bargaining agreement; WHEREAS, the City desires to implement the provisions of the agreement. NOW,THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That retroactively,effective the first pay period ending in October 2000,the minimum of the ranges to reflect the current classification and pay system. This is approximately 14.3% increase to the minimums. These are the same changes that were made to the Unclassified system in May 2000, as follows: GRADE MIN. MAX. 15 $45,805 $ 73,450 14 $42,157 $ 67,596 13 $38,797 $ 62,209 12 $35,704 $ 57,249 11 $32,858 $ 52,686 10 $30,239 $ 48,486 9 $27,829 $ 44,623 8 $25,611 $ 41,066 7 $23,569 $37,792 6 $21,691 $34,780 Specifically,Government Supervisors Association of Florida represent the following classifications, in the following pay grades: Grade 6 - Tennis Center Supervisor Grade 8 - Water Service Representative Grade 9 - Parking Facilities Supervisor Grade 10 - Paint Supervisor Grade 11 -Maintenance Supervisor, Recreation Supervisor Grade 12 - Air Conditioning Supervisor, Electrician Supervisor, Meter Services Supervisor, Park Operations Supervisor, Parking Operations Supervisor, Plumbing Supervisor, Street Lighting Operations Supervisor, Warehouse Supervisor, Street Operations Supervisor, Electronics/Instrumentation Supervisor Grade 13 -Fleet Operations Supervisor, Property Management Operations Supervisor, Water Field Operations Supervisor, Communications Supervisor, Sewer Field Operations Supervisor, Pumping Operations Supervisor Grade 14 - Crime Scene Supervisor, Senior Engineering Inspector, Senior Building Inspector Grade 15 - Beach Patrol Operations Supervisor, City Surveyor SECTION 2: Increasing the minimum and maximum of the ranges in 2001 and 2002 in accordance with the classification and pay system, the Consumer Price Index-U (CPI-U)used for the increase will be the twelve month period ending on June 10, 2001, and June 30, 2002, (with a minimum of 2% to a maximum of 4%), respectively. This will further be defined by the Bureau of Labor Statistics,Department of Labor, as the All Urban Consumers (not seasonally adjusted, area: United States City-average, all items.) SECTION 3: Increasing the salary of each employee, retroactively, by 2% effective the first pay period ending in October 2000. Increasing the salary of each employee according to the Consumer Price Index-U (all urban consumers) in 2001 and 2002 (with a minimum of 2% to a maximum of 4%)effective with the first pay period ending in October 2001 and October 2002, respectively; with no employee to exceed the maximum of the new range at any time; providing for a repealer, severability, codification and effective dates. SECTION 3: REPEALER. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4: SEVERABILITY. If any section, subsection, clause, or provision of this ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 5: CODIFICATION. It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or re-lettered to accomplish such intention, and the word"ordinance"may be changed to "section", "article", or other appropriate word. SECTION 6: EFFECTIVE DATES. Section 1 will be effective retroactively, effective the first pay period ending in October 2000. Section 2 will be effective in accordance with the Classification and Pay System in 2001 and 2002. Section 3 will be effective retroactively, by 2% effective the first pay period ending in October 2000. Increasing the salary of each employee according to the Consumer Price Index-U (all urban consumers) in 2001 and 2002 effective with the first pay period ending in October 2001 and October 2002, respectively. The City ratified the collective bargaining agreement with the General Supervisors Association on December 22, 2000. The First Reading was also held on December 22, 2000. This ordinance implements the salary changes in the Collective Bargaining Agreement. Section 1 of the ordinance increases the minimums of the salary ranges by 14.3%,the same changes as the Unclassified system in May 2000. In addition,this includes placing the classifications in the proper pay grades. Section 2 of the ordinance increases the minimum and maximums of the ranges by the CPI-U (Consumer Price Index - Urban, consumers U.S. City average, all items) in 2001 and 2002 with a minimum of 2% to a maximum of 4%. Section 3 of the ordinance increases the salary of each employee by 2% effective first pay period in October 2000. In 2001 and 2002,the salaries will be increased by CPI-U (Consumer Price Index - Urban) a minimum of 2%to a maximum of 4%. CONCLUSION: The Administration recommends that the Mayor and City Commission adopt the Ordinance,in order to implement the salary range amendments included in the collective bargaining agreement negotiated between the City of Miami Beach and GSA.
