Ordinance 2001-3291 ORDINANCE NO. 2001-3291 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA,AMENDING CHAPTER 106 OF THE MIAMI BEACH CITY CODE ENTITLED "TRAFFIC AND VEHICLES";AMENDING ARTICLE II THEREOF ENTITLED "METERED PARKING"; AMENDING DIVISION I THEREOF ENTITLED "GENERALLY"; AMENDING SECTIONS 106-55 (A) AND (K), THEREOF, RESPECTIVELY, AND CREATING A NEW SECTION "L"; ALL TO PROVIDE FOR PARKING RATE EXCEPTIONS FOR SPECIAL EVENT PARKING; FURTHER PROVIDING FOR REPEALER, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS,the City has established parking programs and regulations,rates,fees,and fines associated with on-street and off-street parking, both administratively and through action of the Mayor and City Commission; and WHEREAS, the City's Parking System has grown substantially over the last five years, both in services provided to the parking public and revenues derived from said services; and WHEREAS, it is in the best interest of the City to continually improve and update and therefore establish additional parking programs and regulations, rates, fees, and fines; and WHEREAS, the proposed amendments herein include the establishment of a flat parking rate for special event parking, as determined by the City Manager; and WHEREAS, the City's Parking and Transportation Committee concurs with the City's Parking Department and would also recommend the adoption of the proposed revisions. NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH FLORIDA, AS FOLLOWS: SECTION 1. Section 106-55 of the Miami Beach City Code, entitled "Traffic and Vehicles"; Article II thereof,entitled"Metered Parking";Division I thereof, entitled"Generally"; Sections 106- 55 (A)and(K),respectively, is hereby amended as follows, and a new Section 106-55 (L) is created as follows: Sec. 106-55 Parking Rates, Fees, and Penalties (A) Parking Meter Rates and Time Limits. 1. South Beach Parking Zone: All metered parking south of 23rd Street (Dade Boulevard), from Ocean Drive to the westernmost parking lane of Alton Road, between South Pointe Park and 17th Street; and from 17th Street to 21st Street r (Sunset Harbour Drive), from Alton Road to the westernmost parking areas along Purdy Avenue and to Biscayne Bay, shall be at the rate of $1.00 per hour. All metered parking in the South Beach Parking Zone shall be enforced from 9:00 a.m. until 12:00 midnight, seven(7) days per week. 2. All metered parking north of 23rd Street shall maintain a mixed-rate structure of $ .50 per hour for off-street and remote parking, and $1.00 per hour for on-street metered parking in the commercial corridors of 41st Street; 71st Street; and Normandy Drive. All metered parking north of 23rd Street shall be enforced from 9 8:00 a.m. until 6:00 p.m., seven(7) days per week. (K) Restricted Residential Parking Program: There are currently seven (7)restricted residential parking zones. These zones are created to protect the quality of life of the City's residents in areas where residential parking is severely impacted by competing uses. The zones are as follows: Zone 1 South Pointe Zonc 1 Ocean Drive Zone 2 Flamingo Park Zone 3 Michigan/Lenox Zone 4 Museum District Zone 5 Indian Crcck Zone 5 Art Deco District Zone 6 Mcridian/Convcntion Ccntcr Zone 6 Indian Creek/Collins Avenue Zone 7 Meridian Avenue Zone 8 Bonita Drive (L) Exceptions: 1. Special Event Parking: The City Manager may establish a flat rate for special event parking at municipal parking facilities directly servicing a special event. The City Manager may exercise this option for the amount of days of the special event including the day before and the day after the event. In addition,the Transportation and Parking Committee shall consider and make a recommendation upon the application of the proposed flat parking rate for each special event prior to implementation,but such recommendation shall not be binding upon the City Manager. At no time may the flat parking rate, at any facility,be more than 25%above the maximum daily parking rate for that facility or no more than$10.00 daily(7th Street Garage is exempted with a maximum daily rate of$14.00).A special event,must have,at a minimum, three(3)of the following conditions anticipated in order for the City Manager to exercise this option: a. A special event is defined as an event on public property sanctioned and permitted by the City's Office of Arts, Culture, and Entertainment and/or an event on private property deemed to anticipate the demand for City services set forth in subsection(b) - (d) below. b. A special event with an anticipated demand for parking that will saturate all parking within 1,500 feet of the event,as determined by the Parking Director. • c. A special event with an anticipated demand for parking that will require supplemental park and ride shuttle service, maps, brochures, and other informational materials and/or ancillary transportation/parking services. d. A special event with an anticipated demand for City services, including police, fire, and parking,that requires the declaration of a parking emergency by the Mayor and Commission through the passage of an enabling resolution. SECTION 2. INCLUSION IN THE CITY CODE. It is the intention of the Mayor and City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and be made part of the Code of Ordinances of the City of Miami Beach as amended; that the sections of this Ordinance may be renumbered or relettered to accomplish such intention; and that the word "ordinance"may be changed to "section"or other appropriate word. SECTION 3. REPEALER. All Ordinances or parts of Ordinances in conflict herewith are repealed. SECTION 4. SEVERABILITY. If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 5. EFFECTIVE DATE. ADMINISTRATION RECOMMENDATION: Approve the Ordinance on second and final reading. ANALYSIS: On October 18,2000,the Mayor and Commission adopted Ordinance No. 2000-3267 (Parking Rate Ordinance) establishing parking programs/regulations, rates, fees, and fines associated with municipal off-street and on-street parking. The Parking System is charged with providing parking services for a variety of special events citywide throughout the year. Events range in size and attendance requiring,in some cases, ancillary services including park and ride shuttles, informational letters, maps,brochures, etc. As these and other operational issues arise, it is critical to provide a structured rate for parking based on convenience options(valet-most convenient, self park-convenient,park and ride-less convenient) rather than demand. As a public sector service, it is our goal to provide clean, safe, and affordable parking. Demand is a direct factor in developing rates in the private sector; however, the public sector should maintain rates at or just below market. For instance, the Parking System has experienced parking shortages and significant increases in operational needs during special events. Specifically, the NMMA(National Marine Manufacturers Association) Boat Show is the largest single annual event occurring in the City of Miami Beach. The Parking System will be operating parking facilities throughout the City, in South, Middle, and AGENDA ITEM RS D DATE I-131-0 I North Beach, providing self-parking in the vicinity of the Convention Center, and park-and-ride facilities throughout the balance of the City. Last year, the Yacht Brokerage Show operated and funded a shuttle service providing park and ride services from municipal parking facilities in the Middle and North Beach areas. The Yacht Brokerage Show will again operate and fund this service. Shuttle operations, additional staffing, and security needs place an additional burden on the budget of the parking system. To this end,the Parking System will continue to manage the shuttle system for all of the Parking System's park and ride facilities; however, the NMMA Boat Show shall subsidize a portion of the cost of the shuttle system for municipal parking facilities south of 41st Street. This subsidy shall be, at a minimum, equal to or greater than the Yacht Brokerage Show's cost of shuttle operations. The cost of the NMMA shuttle operation is estimated at $16,800. The cost of the Yacht Brokerage Show shuttle system is estimated at $10,000. The Yacht Brokerage Show shall bear the full cost of the shuttle system. Until the recent passage of this Ordinance (October 18, 2000), the Parking System had administratively applied flat parking rates for special events. The establishment of this new Section in the Ordinance, entitled, "Exceptions"codifies established past practices and sets forth criteria and strict guidelines as to the implementation and application of special event parking rates. In addition,if the proposed amendments are approved,the abovementioned flat parking rate for the 2001 NMMA Boat Show and Yacht Brokerage Show would be instituted providing for increased service levels and establishing a parking rate structure based on options for convenience.
