AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AMENDING THE LAND DEVELOPMENT
REGULATIONS OF THE CODE OF THE CITY OF MIAMI BEACH, BY
AMENDING CHAPTER 138, ENTITLED "SIGNS", BY AMENDING ARTICLE
V, ENTITLED "SIGN REGULATIONS BY DISTRICT", BY AMENDING
SECTION 138-172 TO CLARIFY AND EXPAND THE REQUIREMENTS FOR
SIGNAGE ON BUILDINGS FRONTING LINCOLN ROAD,AND BY CREATING
SECTION 138-173 TO ESTABLISH A LINCOLN ROAD SIGNAGE DISTRICT;
PROVIDING FOR INCLUSION IN THE CITY CODE; PROVIDING FOR
REPEALER, SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS,the City of Miami Beach endeavors to recall its unique social and architectural
history, as well as further the dynamic character and attraction of Lincoln Road through the use of
signage; and
WHEREAS, the City of Miami Beach desires to expand existing requirements and
procedures for approving signage in historic districts; and
WHEREAS,the creation of a Lincoln Road Signage District is for the purpose of promoting
the creation of unique, artistic and well designed graphic signage; and
WHEREAS, the City of Miami Beach Historic Preservation Board is the primary vehicle
for assuring this artistic and design integrity; and
WHEREAS, the City of Miami Beach Historic Preservation Board strongly endorses the
proposed amendments to the Signage Section of the Code; and
WHEREAS, the amendments set forth below are necessary to accomplish all of the above
objectives.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. That Chapter 138, Article V, entitled "Sign Regulations by Districts", of the Land
Development Regulations of the Code of the City of Miami Beach, Florida is hereby amended as
follows:

Section 138-173. Lincoln Road Signage District
For those properties fronting on Lincoln Road, and located in between the west side of Collins
Avenue and the east side of Washington Avenue, the following shall apply:
Flat wall, projecting or other building signs, which exceed the number and overall square
footage permitted under Sec. 138-172, may be permitted, subject to the issuance of a Certificate of
Appropriateness from the Historic Preservation Board. The total square footage, quantity,placement,
design and illumination of such signage shall be at the discretion of the Historic Preservation Board,
and may include,but shall not be limited to,the following:
(1) Continuous electrical animation in the form of stationary or flashing borders, writing,
emblems or other figures.
(2) Stationary or flashing sign surface area serving as a field or background.
(b) In evaluating signage applications for a Certificate of Appropriateness, the Historic
Preservation Board shall consider the following:

(1) The quality of materials utilized for the sign and their appropriateness to the architecture as
well as the historic and design integrity of the structure.
(2) The overall design. graphics and artistry associated with a proposed sign and its relationship
to the historic and design integrity of the structure.
(3) The design detail, animation and non-text graphics proposed for the proposed sign(s).
(4) The illumination, surface colors and finishes, width, depth, and overall dimensions of the
proposed sign(s).
(5) Original, historic signage associated with the building and/or property.
(c) The Historic Preservation Board may, at its discretion, place restrictions on the hours of
operation for any sign approved under this subsection.
(d) Signage must relate to the specific occupant(s) of the property.
(e) The Historic Preservation Board, at its discretion, may require partial rehabilitation or
restoration of a facade or storefront where new signage under this section is proposed.
Secs. 138-173174--138-200. Reserved.
SECTION 2. INCLUSION IN THE CITY CODE. It is the intention of the City Commission, and
it is hereby ordained that the provisions of this ordinance shall become and be made part of the Code
of the City of Miami Beach as amended; that the sections of this ordinance may be renumbered or
relettered to accomplish such intention; and that the word "ordinance" may be changed to "section"
or other appropriate word.
SECTION 3. REPEALER. That all Ordinances or parts of Ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 4. SEVERABILITY. If any section, subsection, clause or provision of this Ordinance
is held invalid, the remainder shall not be affected by such invalidity.
SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect ten days following adoption.

SUBJECT: Ordinance- Creation of a Lincoln Road Signage District.
An Ordinance of the Mayor and City Commission of the City of Miami Beach,
Florida,Amending the Land Development Regulations of the Code of the City
of Miami Beach, by Amending Chapter 138, Entitled "Signs", by Amending
Article V,Entitled "Sign Regulations by District", by Amending Section 138-
172 to Clarify and Expand the Requirements for Signage on Buildings
Fronting Lincoln Road, and by Creating Section 138-173 to Establish a
Lincoln Road Signage District; Providing for Inclusion in the City Code;
Providing for Repealer, Severability and an Effective Date.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission, on second reading, approve the
proposed amending Ordinance.
ANALYSIS
An application for an amendment to the Land Development Regulations of the City Code for the
creation of a Lincoln Road Signage District was sponsored by the Historic Preservation Board at
the request of Planning Department staff on October 10, 2000.
The properties fronting Lincoln Road,between Collins and Washington Avenues,have very large,
blank facades that were designed to accommodate large, graphic signage. Indeed, historic
documentation from the 1940's and 1950's shows large, well designed graphic signs which
established the previous"bright"character of this stretch of Lincoln Road,which, during its heyday
exuded excitement, activity and a special sense of place.
The proposed amendment is intended to encourage and allow for the re-introduction of this
"bright"character of Lincoln Road through"architectural"signage which has an historic precedent.
The amendment is not intended to allow general advertising or create a mirror image of Times
Square in New York City, as Miami Beach has its own unique architectural and urban fabric.
Further,the requirement of Historic Preservation Board approval for all signage will go a long way
in assuring high quality,well designed,building signage which establishes an architectural identity.
At its October 24, 2000 meeting,the Planning Board voted to recommend approval of the proposed
Ordinance. The Ordinance amendment was reviewed favorably by the Historic Preservation Board
on October 10, 2000 and on November 14, 2000. Q

On November 29, 2000, the City Commission approved the proposed Ordinance on first reading .
The Commission requested that the Ordinance be slightly modified, to include language pertaining
to the potential rehabilitation and restoration of the structures where new signage is proposed. The
Commission also requested that the proposed Ordinance be presented to the Lincoln Road Marketing
Council.
On December 7, 2000 and December 13, 2000 Planning Department staff presented the proposed
Ordinance to the Lincoln Road Marketing Council. At that time, the organization expressed some
reservations relative to the creation of a Lincoln Road Signage District. In light of a lack of
consensus from the Lincoln Road Marketing Council on the creation of a Lincoln Road Signage
District, on December 20, 2000 the City Commission continued the proposed Ordinance to a date
certain of February 21,2001 in order for a Lincoln Road"Visioning"Workshop, coordinated by the
Lincoln Road Marketing Council, to take place prior to final adoption of the proposed amending
Ordinance.
At the January 17, 2001 meeting of the Lincoln Road Marketing Council, it was determined that a
"Visioning"Workshop would not be able to be organized prior to February 21, 2001. Additionally,
property owners and representatives of property owners on the 200 and 300 block of Lincoln Road
appeared before the Marketing Council to express their strong support for the proposed Ordinance.
In light of these viewpoints, the Lincoln Road Marketing Council adopted a Resolution to support
the adoption of the proposed Ordinance creating a Lincoln Road Signage District. As part of this
Resolution, the Lincoln Road Marketing Coupcil recommended that the proposed signage be
permitted to wrap those portions of buildings on Collins Avenue and Washington Avenue which also
have frontage on Lincoln Road.
Based on the foregoing analysis,the Administration recommends that the Commission approve, on
second reading, the proposed amending ordinance to Chapter 138, Entitled "Signs" of the Land
DevelopmentRegulations of the Code of the City of Miami Beach.♦♦
