Resolution 3501
RESOLUTION NO. 3501 WHEREAS, the City Council of the City of Miami Beach, Florida, upon its own initiative will consider the amending, supplementing, changing, modifying and/nor repealing of the regulations, restrictions, and/or boundaries as provided in Ordinance No. 289, commonly known as the Zoning Ordinance of Miami Beach, Florida, as hereinafter set forth, to-wit: That Section 1 of Ordinance No. 289, as amended, be amended by adding thereto after the definition of "Dwelling, Multiple-Family", the following item: "DWELLING, TWO-FAMILY: A detached building, divided horizontally or vertically and designed for or occupied by two single-family housekeeping units, contained entirely under one roof and having the ceiling structure of the lower unit the floor structure of the unit above. That Section 1 of Ordinance No. 289, as amended, be amended by adding thereto in the definition of "Apartment Hotel" , after sentence ending "which may furnish dining room service", the clause "for tenants only". That Section 2 of Ordinance No. 289, as amended, be amended by adding thereto in the paragraph entitled "Use Districts" , the following list in place of the list as now written: "1. RAA, RA, RB and RC Estate Districts. 2. RD Single-Family District. 3. RDD Modified Single-Family District. 4. RE Multiple-Family District 5. BAA, BAA, BA, BB, BC, BE, BF and BG Business Districts. " That Section 2 of Ordinance No. 289, as amended, be amended by substituting for the first paragraph under "Area Districts" the following: "Area Districts num- bered 1 to 31, inclusive. " That Section 5 of Ordinance No. 289, as amended, be amended by omitting sub-paragraph (1) and substituting therefore the following: "(1) Any use permitted in the RDD Modified Single- Family District." That Section 6 of Ordinance No. 289, as amended, be amended by omitting sub-paragraph (1) and substituting therefore the following: "(1) Any use permitted in the BAAA Business District. " That Section 8 of Ordinance No. 289, as amended, be amended by adding thereto in sub-paragraph (10) after the words "Accessory Uses", the words "for tenants only". That Section 15 of Ordinance No. 289, as amended, be amended by adding thereto in sub-paragraph (10) after the words "Accessory Uses" , the words "for tenants only". " (5A) "RDD" Modified Single-Family District, 6000 Sq. Ft. per family for single-family dwellings. 5000 Sq. Ft. per family for two-family dwellings" , and by adding thereto after sub-paragraph (6) item a, the following: "a.1 Two fanily dwellings shall provide a minimum area of not less than 2,800 Sq. Ft. of land area per family" , and by adding thereto in sub-paragraph (7) before the letters "BAA" , the letters "BAAA". That Section 17. of Ordinance No. 289, as amended, be amended by adding thereto in sub-section (b) after the words "RD Single Family District" , the following: "And the RDD Modified Single-Family District". and by adding thereto in sub-section (f) after the words "RD Single-Family District" , the following: "RDD Modified Single-Family District". That Section 1 of Ordinance No. 289, as amended, be amended by substituting for the present definition of gasoline and oil filling station, the following "Gasoline and oil filling station, a structure or place where gasoline or oil and greases are supplied and dispensed to the motor vehicle trade, but no repair work performed. " NOW, THEREFORE, BE IT RESOLVED, that a public hearing be called for the 6th day of May, 1936, at 10:00 o'clock .A. M. in the Council Chambers at the City Hall, Miami Beach, Florida, for the purpose as above set forth, BE IT FURTHER RESOLVED, that notice of the time, place and object of such hearing be published as is provided by said Ordinance No. 289.
