CONSOLIDATED PLAN FOR FY 2013 -2017, AND TO REALLOCATE SAID
FUNDS TO THE MADELEINE VILLAGE APARTMENTS REHABILITATION
PROJECT; AND FURTHER AUTHORIZING THE CITY MANAGER TO SUBMIT
THE REVISED ACTION PLAN TO HUD.
WHEREAS, the City is an entitlement recipient of HUD formula grant programs as follows:
Community Development Block Grant (CDBG) funds, and HOME Investments Partnership
(HOME) funds; and
WHEREAS, CDBG funds are used to provide vital public services, housing activities and
improvement to public facilities and HOME funds are used for affordable housing activities
including multi - family rentals; and
WHEREAS, the City expects to continue to receive entitlement funds from these grant
programs to operate the City's housing and community development activities; and
WHEREAS, the. Action Plan for federal funds is a requirement under HUD's formula grant
programs, which include the CDBG and HOME programs and delineates the specific projects
and activities funded by each year's HUD allocation; and
WHEREAS, the five -year Consolidated Plan is augmented and refined by the City's annual
submission of the one -year Action Plan; and
WHEREAS, CDBG and HOME stipulate that funds be expended within guidelines as
delineated in 24 CFR Part 570 and 24 CFR Part 92; and
WHEREAS, the Action Plan for federal funds is a requirement under HUD's formula grant
programs, which include the CDBG and HOME programs; and
WHEREAS, the Action Plan is monitored throughout the year to ensure compliance with
federal regulations and progress towards the National Objective and a Substantial Amendment
is processed if necessary; and
WHEREAS, City staff reconciled its CD'BG and HOME funds in anticipation of preparing its
FY 17/18 Consolidated Annual Performance and Evaluation Report (CAPER) as well as to
ensure that all non - committed funds are properly committed and expended to comply with
expenditure and timeliness rules; and
WHEREAS, the City seeks to recapture unexpended funds from the following various
projects previously approved by the City Commission and reallocate said funds to the
Madeleine Village Apartments, a City -owned affordable housing project, located at 7861 -7871
Crespi Blvd, which is in need of rehabilitation; and
WHEREAS, on July 18, 2013, via Resolution No. 2013- 28292, the City Commission
approved the FY 13/14 Action Plan that awarded HOME funds to: 1) the London House
Apartments rehabilitation project and 2) Carrfour Supportive Housing, Inc's Harding Village
Apartments rehabilitation project; and
WHEREAS, the City recommends the recapture of the following HOME funds for FY 13/14
and to reallocate said funds to the Madeleine Village Apartments rehabilitation project to ensure
compliance with the expenditure deadline of September 30, 2018: 1) the London House
Apartments rehabilitation project funds, in the amount of $234,715.97, due to the completion of
the project; 2) Carrfour Supportive Housing, Inc's Harding Village Apartments rehabilitation
project, in the amount of $110,979, due to the completion of the project and expiration of the
agreement; and
WHEREAS, the City allocated $1,600,902.91 in FY 16/17 CDBG /HOME funds to the Lottie
Apartments rehabilitation project via Resolution No. 2017- 29803, which was later reduced to
$1,179,200 pursuant to an amendment to the contract with Azulejo, Inc, the contractor for the
Lottie Apartments rehabilitation project, in that the funded project cannot exceed the 50%
threshold of the appraised resale value, leaving a difference of $421,702.90; and
WHEREAS, the City recommends the recapture of the $421,702.90 and to reallocate said
funds to the Madeleine Village Apartments rehabilitation project to ensure compliance with
expenditure deadlines of October 2019; and
WHEREAS, on June 8, 2016, via Resolution No. 2016 - 29420, the City Commission
approved the FY 16/17 Action Plan that awarded CDBG funds to: 1) various public services;
and 2) the expenditure of City administrative costs to monitor the CDBG projects; and
WHEREAS, the City recommends the recapture of the following CDBG funds for FY 16/17
and to reallocate said funds to the Madeleine Village Apartments rehabilitation project to ensure
compliance with expenditure deadlines of October 2019; 1) the funds for various public services,
in the amount of $52,983.01, in that said funds were not fully expended for that fiscal year; and
2) the expenditure of City administrative costs to monitor the CDBG projects, in the amount of
$29,752.03, in that said funds were not fully expended for that fiscal year; and
WHEREAS, on July 13, 2011, via Resolution No. 2011- 27694, the City Commission
approved the FY 11/12 Action Plan that awarded CDBG funds to: 1) the North Beach Facade
Improvement Program and 2) authorized the expenditure of administrative costs for use by the
City to monitor the CDBG projects; and
WHEREAS, the City recommends the recapture of the following funds for FY 11/12 and to
reallocate said funds to the Madeleine Village Apartments rehabilitation project: 1) the North
Beach Facade Improvement Program, in the amount of $8 ;686.76, due to the completion of the
project; and 2) the administrative costs, in the amount of $300.00, in order to meet the
expenditure deadline of September 2018; and
WHEREAS, on May 11, 2016, via Resolution No. 2016-29383, the City Commission
approved the amendment to the FY 15/16 Action Plan that authorized the allocation of CDBG
monies to administrative funds for use by the City to monitor the CDBG projects; and
WHEREAS, the City recommends the recapture of $245.00 from FY 15/16 and to reallocate
said funds to the Madeleine Village Apartments rehabilitation project to ensure compliance with
the expenditure deadline of September 2018; and
WHEREAS, the resulting HOME and CDBG funds recapture will be incorporated into the
City's various Action Plans, 2008 through 2012 Consolidated Plan and 2013 through 2017
Consolidated Plan; and
WHEREAS, as per the Citizen Participation Plan, a change of use triggers a Substantial
Amendment; and
WHEREAS, the City provided a thirty (30) day public comment period, from May 5, 2017 to
June 5, 2017, and a public meeting on May 16, 2017 to advertise the CDBG and HOME funding
allocation to the Madeleine Village Apartments for FY 17/18; and
WHEREAS, the City Manager is the designated agent for all HUD formula grants and
executes the grant applications, grant agreements, and other applicable HUD documents on
behalf of the City,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby
authorize the City Manager to recapture $234,715.97 of Home Investment Partnership
(HOME) funds previously allocated to London House Apartments rehabilitation project
(London House) pursuant to the Action Plan for FY 13/14 and the five -Year Consolidated
Plan for FY 2013-2017, and to reallocate said funds to the Madeleine Village Apartments
rehabilitation project; (2) authorize the City Manager to recapture $110,980.85 of HOME
funds previously allocated to Carrfour Supportive Housing for the Harding Village
Apartments rehabilitation project, pursuant to the Action Plan for FY 11/12 and the Five -
Year Consolidated Plan for FY 2013 -2017, and to reallocate said funds to the Madeleine
Village Apartments rehabilitation project; (3) authorize the City Manager to recapture
$421,702.31 of Community Development Block Grant (CDBG) funds previously allocated to
the Lottie Apartments rehabilitation project (Lottie) pursuant to the Action Plan for FY 16/17
and the Five -Year Consolidated Plan for FY 2013 -2017, and to reallocate said funds to the
Madeleine Village Apartments rehabilitation project; (4) authorizing the City Manager to
recapture $29,572.03 of CDBG funds previously allocated to the administrative costs
pursuant to the Action Plan for FY 16/17 and the Five -Year Consolidated Plan for FY 2013-
2017, and to reallocate said funds to the Madeleine Village Apartments rehabilitation project;
(5) authorize the City Manager to recapture $52,983.01 of CDBG funds previously allocated
to the various public services pursuant to the Action Plan for FY 16/17 and the Five -Year
Consolidated Plan for FY 2013 2017 and -to- reallocate- said - funds -to- the -Madeleine Village
Apartments rehabilitation project; (6) authorize the City Manager to recapture $8,686.76 of
CDBG funds previously allocated to the North Beach Fagade Improvement project pursuant
to the Action Plan for FY 11/12 and the Five Year Consolidated Plan for FY 2008 - 2012, and
to reallocate said funds to the Madeleine Village Apartments rehabilitation project; (7)
authorize the City Manager to recapture $300.00 of CDBG funds previously allocated to
administrative costs pursuant to the Action Plan for FY 11/12 and the Five Year
Consolidated Plan for FY 2008 -2012, and to reallocate said funds to the Madeleine Village
Apartments rehabilitation project; (8) authorize the City Manager to recapture $245.00 of
CDBG funds previously allocated to administrative costs pursuant to the Action Plan for FY
15/16 and the five year Consolidated Plan for FY 2013-2017, and to reallocate said funds to
the Madeleine Village Apartments rehabilitation project; and further authorize the City
Manager to submit the revised action plan to HUD.

Approve the resolution.
ANALYSIS
The City is an entitlement community designated by the U.S, Department of Housing and Urban
Development (HUD) and as determined by the decennial census information on population growth
lag, age of housing stock, and poverty. As an entitlement community, the City receives an annual
allocation under HUD funding through the Community Development Block Grant (CDBG) and
HOME Investments Partnership (HOME) programs. HUD requires entitlement jurisdictions to submit
a Five -Year Consolidated Plan, which establishes the strategic framework upon which the City
utilizes its funds. The Consolidated Plan is augmented and refined by the. City's annual submission
of a One -Year Action Plan, which delineates the specific projects and activities funded by each
year's HUD allocation.
HUD further requires its entitlement jurisdictions to ensure that funded activities are carried out in the
defined project scope and within the timeframe allowed. The City's Action Plan is monitored
throughout the year to ensure compliance with Federal regulations and progress towards the
National Objective, which requires providing persons of low- and moderate- incomes with decent
housing, a suitable living environment and /or expanded economic opportunities.
From time to time, it may be necessary for the City to process a "Substantial Amendment" to the
Five -Year Consolidated Plan or the One -Year Action Plan to allow for the funding of new activities,
modification of existing activities, or other program administrative actions. The City issued a 30 -day
notice of public comment welcoming public input to the proposed substantial amendments delineated
herein. The public comment period was from May 5, 2017 through June 5, 2017 with a public
meeting on May 16, 2017. No comments have been received to date.
From time -to -time, it is necessary for the City to process a "Substantial Amendment" to the Five -
Year Consolidated Plan or the Annual Action Plans to allow for the funding of new activities,
modification of existing activities, or other program administrative actions. The City is required by
HUD [24 CFR 91.505 (b)] to identify the criteria to be used in determining if a proposed action will be
considered a "substantial amendment ", as follows:
• Addition of a new activity or project not previously described in the Consolidated or Annual Action
Plan;
• Deletion of an activity or project previously described in the Consolidated or Annual Action Plan;
• Change in the purpose, scope, location or beneficiaries of an activity or project previously described
in the Consolidated or Annual Action Plan;
• Change in the use of funds from one eligible activity or project to another previously described in
Consolidated or Annual Action Plan; and /or
• A cumulative change in the use of funds from an eligible activity to another eligible activity that

decreases an activity's funding by 10% or more or increases an activity's funding by 10% or more
during the fiscal year.
Any proposed amendment that is considered a substantial amendment is subject to the Citizen
Participation process; requires formal action by the City Commission; and requires approval by HUD.
Furthermore, a thirty (30) day public notice is required to provide the opportunity for the public to
review and comment on the proposed substantial amendments. The City will consider all comments
or views received from the public concerning proposed substantial amendments in accordance with
24 CFR 91.105 (c) (3). A summary of these comments and views shall be attached to the substantial
amendment submitted to HUD.
The Administration has reconciled its CDBG and HOME funds in anticipation of preparing its FY
17/18 Consolidated Annual Performance and Evaluation Report (CAPER) as well as to ensure that
all non - committed funds are properly committed and expended to comply with expenditure and
timeliness rules.
he following actions are sought.
1. The City allocated FY 13/14 funds in the amount of $1,603,419 to the London House Apartments
rehabilitation project via Resolution No. 2013- 28292. The London House Apartments were fully
leased in January 2017 and the final draws were processed in July 2017. The City plans to
recapture and subsequently reallocate the unexpended funds in the amount of $234,715.96 to the
Madeleine Village Apartments rehabilitation project to comply with the expenditure deadline of
September 30, 2018.
The Madeleine Village Apartments is a City -owned property that requires rehabilitation. The project
will entail the rehabilitation of four single -story buildings and the repair of the seawall adjacent to the
property.
2, The City allocated FY 13/14 funds to the Carrfour Supportive Housing, Inc. Harding Village
Apartments rehabilitation project in two separate agreements:
• $92,885 from Community Housing Development Organization (CHDO) funds with an expiration
date of April 30, 2017. HUD requires that 15% of all annual allocations are distributed to eligible
CHDOs within the jurisdiction. Every year, a CHDO must recertify their eligibility to develop
affordable housing projects. Carrfour Supportive Housing, Inc. has not renewed its CHDO
designation since 2016. They have no active agreements or active projects. The City was able to
convert the unexpended funds in the amount of $26,738 to avoid recapture by HUD. These funds
have an expiration date of September 30, 2018.
• $228,667 from FY 13/14 entitlement funds with an expiration date of April 30, 2017. Carrfour did not
request any extensions to the agreement. The City is proposing to reallocate unexpended funds in
the amount of $84,241.00. These funds have an expiration date of September 30, 2018.
3. The City allocated $1,600,902.91 in CDBG and HOME funds to the Lottie Apartments
rehabilitation project via Resolution no. 2017 - 29803. After the bid was awarded to Azulejo, Inc., the
project budget was reduced to $1,179,200 to cover professional services, site work, tenant relocation
costs and construction costs that could not exceed 50% of the total replacement cost of the property.
The City is seeking to reallocate unexpended funds in the amount of $421,702.31 to the Madeleine
Village Apartments rehabilitation project to comply with the deadline of September 30, 2018.
4. The City allocated FY 16/17 funds for administrative costs in the amount of $166,939 via
Resolution no. 2016 - 29420. The City is proposing to reallocate the unexpended funds in the amount
of $29,752.03 to the Madeleine Village Apartments rehabilitation project to comply with the
commitment deadline of October 1, 2019.

5. The City allocated FY 16/17 funds in the amount of $125,205 to various public services. The City
is proposing to reallocate the unexpended funds in the amount of $52,983.01 to the Madeleine
Village Apartments rehabilitation project to comply with the expiration deadline of October 1, 2019.
6. The City allocated FY 11/12 funds in the amount of $120,000 to the North Beach Facade Program
via Resolution No. 2011 - 27694. The City is proposing to reallocate the unexpended funds in the
amount of $8,686.76 to the Madeleine Village Apartments rehabilitation project to comply with the
expiration deadline of September 30, 2018.
7. The City allocated FY 11/12 funds in the amount of $314,482 for administrative costs via
Resolution No. 2011 - 27694. The City is proposing to reallocate the unexpended funds in the amount
of $300 to the Madeleine Village Apartments rehabilitation project to comply with the expiration
deadline of September 30, 2018.
8. The City allocated FY 15/16 funds in the amount of $171,643 for administrative costs via
Resolution No. 2011 - 27694. The City is proposing to reallocate the unexpended funds in the amount
of $245 to the Madeleine Village Apartments rehabilitation project to comply with the expiration
