RESOLUTION NO. 2018 - 30141 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE NEIGHBORHOOD /COMMUNITY AFFAIRS COMMITTEE AT ITS DECEMBER 20, 2017 MEETING TO APPROVE THE ADOPT -A -BENCH PROGRAM APPLICATION FROM MAXIMILIAN CAMINO AND, PURSUANT TO SECTION 82- 504 OF THE CITY CODE, SETTING A PUBLIC HEARING FOR FEBRUARY 14, 2018 TO CONSIDER THE APPLICATION AND DIRECTING THE CITY CLERK TO PUBLISH THE APPROPRIATE PUBLIC NOTICE. WHEREAS, on November 9, 2016, the City Commission passed Resolution No. 2016- 29649 supporting the creation of an "Adopt -A -Bench Program" to provide the public an opportunity to adopt existing or new park benches for the commemoration of loved ones or special events, and to provide the Parks and Recreation Department an additional means to finance the beautification of City parks; and WHEREAS, the Parks and Recreation Department received an application for the Adopt -A -Bench Program from Maximilian Camino (the "Applicant ") in September 2017, as shown on Exhibit A; and WHEREAS, the Applicant selected an existing bench within South Pointe Park and requested the commemorative bench plaque read as follows: "Maximilian & Dimitri Camino" as shown in Exhibit B; and WHEREAS, pursuant to, Section 82- 504(a)(2)(a) of the City Code, for proposals establishing a monument or memorial, the person to be recognized must be in good standing in the community; and WHEREAS, the Neighborhood /Community Affairs Committee recommended approval of the Applicant's Adopt -A -Bench Program application and moved this item to the City Commission with its favorable recommendation; and WHEREAS, if an application is ultimately approved by the City Commission following a public hearing, participation in the Adopt -A -Bench Program requires a $10,000.00 adoption fee, to be paid in full by the donor within (30) days of application approval, and benches are made available for re- adoption after 10 years; and WHEREAS, the estimated cost for design, fabrication, and installation of the stainless - steel plaque is $300.00; and WHEREAS, pursuant to Section 82- 504(a)(6) of the City Code, a duly noticed public hearing is required prior to final approval of the Applicant's application and should be set for the February 14, 2018 City Commission meeting. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the Neighborhood /Community Affairs Committee at its December 20, 2017 meeting to approve Maximilian Camino's Adopt -A -Bench Program application and, pursuant to Section 82 -504 of the City Code, hereby set a public hearing for February 14, 2018 to consider the application and direct the City Clerk to publish the appropriate notice. RECOMMENDATION Mayor and City Commission to accept the recommendation of the Neighborhood /Community Affairs Committee from its December 20, 2017 meeting, approving the Maximillian Camino's Adopt -A -Bench Program application. ANALYSIS On November 9, 2016, the City Commission passed Resolution No. 2016 -29649 supporting the creation of an "Adopt -A -Bench Program" similar to the Central Park Conservancy's program in New York City. The program provides the public an opportunity to adopt park benches for the commemoration of loved ones or special events, and would be an additional means to finance the beautification of City parks. The Parks and Recreation Department received an application for Adopt -A -Bench Program (the "Program ") from Maximilian Camino (the "Applicant ") in September 2017 (Exhibit A). Pursuant to the City's existing policies and procedures for proposals establishing monuments /memorials, the application must be in compliance with Article VI, Section 82 -504 of the City Code, according to the following requirements: 1. Only the Mayor or a Member of City Commission may propose the establishment of a monument/memorial and submit the proposal as a request for referral to Committee. 2. Establishment of monument/memorial shall also be subject to the following: a. The person to be recognized on the monument/memorial is in good standing in the community. a. Any proposal for the establishment of a monument/memorial approved by the Committee shall not be transmitted to the City Commission without an accompanying analysis detailing the Page 284 of 923 estimated costs for design, fabrication, installation, and /or maintenance of the monument /memorial. At its October 31, 2017 meeting, the City Commission referred this item to the Neighborhood /Community Affairs Committee (NCAC) for its recommendation, pursuant to the process set forth in Section 82 -504 of the City Code. On December 20, 2017, NCAC approved the Applicant's Program application and moved this item to City Commission with favorable recommendation. The Applicant selected an existing bench within South Pointe Park and requested the commemorative bench plaque ( "the Plaque ") read as follows: "Maximilian & Dimitri Camino" (Exhibit B). The persons to be recognized on the Plaque are family members of the applicant. Since the proposed - location for the Plaque is on an existing bench, the Department will not have initial costs associated with the purchase and installation of a new bench. Ongoing maintenance includes a monthly pressure wash and repairs as needed, at an estimated annual cost of $216.00 including labor. The estimated cost for design, fabrication, and installation of a 3 "h x 10 "w stainless steel plaque is $300.00. Participation in the Program requires a $10,000.00 adoption fee, to be paid in full by the donor within (30) days of application approval. Under the Program, benches are made available for re- adoption after 10 years. In the event the bench needed to be replaced within the 10 -year adoption period, the estimated unit price of an aluminum backed Arcata Bench, one of the 3 standard bench designs found at South Pointe Park, is approximately $2,600.00. As required in Section 82 -504 (2)(a) of the City Code, the person to be recognized on the Plaque is in good standing in the community. The following are the established procedures and requirements for the Adopt -A -Bench Program, which are subject to change by the City: In order to participate in the Program, the attached application must be completed and submitted to the City of Miami Beach Parks and Recreation Department, 1701 Meridian Avenue, Suite 401, Miami Beach, FL 33139 or by email to adoptabench @miamibeachfi,gov, Donors may elect to adopt an existing park bench or propose the addition of a new bench within a City park, Participation in the Program requires a $10,000.00 adoption fee, to be paid in full by the donor within thirty (30) days of application approval. The adoption fee will cover the cost of new bench installation and maintenance, or the-maintenance of an existing bench, whichever is applicable, including the purchase, inscription, and installation of a commemorative plaque. Proceeds from the Adopt -A -Bench Program will be used to finance City park beautification efforts. Donors must acknowledge that the adopted bench is for the use of the general public at all times during park hours, and that the commemorative plaque is subject to approvai pursuant to Section 82 -504 of the City Code, • The City of Miami Beach is a duly incorporated municipality in the State of Florida exempt from federal taxation as a tax- exempt public corporation, Donations to the City of Miami Beach through the Adopt -A- Bench Program are defined as charitable contributions and are deductible as provided by federal law. Donors are responsible for consulting with a tax professional, Parks and Recreation Department standards will be used in the selection of bench and plaque options, If a new bench is to be installed, it shall replicate other benches at that park. Donors may not design their own bench /plaque, or have an external vendor supply a bench /plaque, Not all City park benches (or proposed sites) are eligible for participation in the program, + Park location and bench sites are subject to approval and availability, Bench and plaque options (design, color, material, inscription, etc,) shall be strictly limited to those predetermined by the Parks and Recreation Department, as described in the attached application, The plaque will remain affixed to the bench for a minimum of ten years, After ten years, the bench will be made available for re- adoption, provided that the Adopt -A -Bench Program is in existence, Prior to expiration of the ten -year period, the original donor may contact the City of Miami Beach Parks and Recreation Department to re -adopt the bench. If a donor does not re -adopt the bench by paying the re- adoption fee to the Parks and Recreation Department prior to the expiration of the ten year period, the bench will be eligible for adoption by another individual or entity. • The City reserves the right, in its sole discretion, to alter, relocate, permanently move, or replace a bench /plaque due to capital construction, landscape redesign, or other extenuating circumstances. During the ten-year donation period, a comparable location will be provided by the City. In the event of damage to the bench and /or plaque as a result of a natural disaster or vandalism, the City is not obligated to repair or replace the bench and /or plaque, Donors are encouraged to keep all contact information up -to -date with the Parks and Recreation Department. • The City reserves the right not to accept applications from entities whose business involves products and /or services which, at the City's sole discretion, are not considered appropriate in terms of affiliation with a public entity, particularly a parks and recreation system, and which would conflict with the City's brand or licensing agreements.
