Resolution 3606 I RESOLUTION NO. 3606 WHEREAS M. B. Shanberg is the owner of the North 10 Feet of Lot 4, All of Lot 5, and the South 40 Feet of Lot 6, • Block 28, Fisher's First Subdivision of Alton Beach, as per Plat _ recorded in Plat Book 2 at Page 77 of the Public Records of Dade County, Florida, and desires to construct a bulkhead, built in accordance with City Standard plans to be approved by the City Engineer of said City and on a line to be established by him; and WHEREAS there is certain litigation pending now to determine the ownership and right of occupancy of that Ocean Frontage lying between the platted lots of said subdivision and the Atlantic Ocean; NOW, THEREFORE , BE IT RESOLVED that should said owner construct said bulkhead under the plans and conditions above set forth, and should said city acquire said Ocean Frontage for public purposes as a result of said litigation now pending, then and in that event said city hereby agrees to reimburse said owner for the cost of said bulkhead at the rate of *35.00 per lineal foot thereof; said reimbursement to be in three equal annual installments without interest, the first of which shall be within one year from the final determination of said litigation.
