RESOLUTION NO. 95-21667
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA VACATING SIXTEENTH
STREET BETWEEN COLLINS AVENUE AND THE EROSION
CONTROL LINE AND ABANDONING ANY PUBLIC AND PRIVATE
UTILITIES AND EASEMENTS WITHIN THAT RIGHT-OF-WAY,
IN CONNECTION WITH THE LOEWS CONVENTION CENTER
HOTEL PROJECT.
WHEREAS,
includes the
project; and
the proposed Loews convention center hotel site
Sixteenth Street end as part of the development
WHEREAS, the closure of the Sixteenth Street End is necessary
for the development of the Loews Hotel; and
WHEREAS, the development of the Loews
public benefit by, among other things,
industry and the local economy; and
Hotel should serve the
improving the tourism
WHEREAS, prior to entering into a lease agreement with the
hotel developer, it is necessary for the right-of-way legally
described below to be vacated and any public and private utilities
and easements to be abandoned; and
WHEREAS, the Sixteenth Street End right-of-way is legally
described in Exhibit "A" attached hereto; and
WHEREAS, the City has received a title commitment regarding
the Sixteenth Street End; and
WHEREAS, the Mayor and City Commission held a public hearing
on July 26, 1995, and determined that the abandonment of any public
or private utility lines or easements and vacation of the above
referenced right-of-way would be in the public interest.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that (1) the Mayor
and City Commission hereby find and determine that it is in the
best interest of the general public's welfare to vacate the public
right-af-way legally described in Exhibit "A" attached hereto and
to abandon any public and private utilities and easements within
that right-af-way, and (2) the right-of-way legally described in
Exhibit "A" attached hereto is hereby vacated and any public and
private utilities and easements located within that right-of-way
are hereby abandoned.

METES AND BOUND DESCRIPTION OF PORTION OF 16TH STREET:
Commence at the Northwest corner of Lot 11, Block 56, recorded in
FISHER'S FIRST SUBDIVISION OF ALTON BEACH, Plat Book 2, Page 77,
Public Records of Dade County, Florida, said point being the POINT
OF BEGINNING; thence North 88000'49" East, along the North line of
said Block 56 and its Easterly extension for a distance of 576.20
feet to the point of intersection with the Erosion Control Line of
the Atlantic Ocean for a distance of 71.28 feet to the point of
intersection with the Easterly extension of the South line of Block
55 of the above mentioned FISHER'S FIRST SUBDIVISION OF ALTON
BEACH; thence South 88004'49" West, along the South line of said

A PUBLIC HEAR . TO CONSIDER A RESOLUTION OF THE MIAMI
BEACH CITY CO ISSION VACATING THE RIGHT-OF-WAY LOCATED
AT SIXTEENTH STREET BETWEEN COLLINS AVENUE AND THE
EROSION CONTROL LINE, AND ABANDONING ANY RELATED PUBLIC
AND PRIVATE UTILITIES AND EASEMENTS WITHIN SAID RIGHT-OF-
WAY, AS APPROPRIATE, FOR THE CONVENTION CENTER HOTEL
DEVELOPMENT PROJECT.
SUBJECf:
RECOMMENDATION
It is recommended that the City of Miami Beach approve a Resolution
authorizing the necessary actions to vacate Sixteenth Street
between Collins Avenue and the erosion control line (see attached
map, Exhibit "A"), and abandoning the existing public and private
utilities and easements within said right-of-way, as appropriate,
for the convention center hotel development project.
BACKGROUND
The Miami Beach Redevelopment Agency (the "Agency"), through the
efforts of the Hotel Negotiating Committee, has been negotiating
with Loews Hotel Corporation for the development of a convention
center hotel at the sites of the St. Moritz Hotel, the f,ormer
poinciana and Sands-New Yorker Hotels and the Sixteenth Street End,
collectively the "Site". Prior to the Agency executing an
agreement to dispose of the Site it is necessary for the right-of-
way to be vacated and any public and private utilities and
easements located therein to be abandoned, as appropriate. The
Sixteenth Street End is legally described as follows: METES AND
BOUND DESCRIPTION OF PORTION OF 16TH STREET: Commence at the
Northwest corner of Lot 11, Block 56, recorded in FISHER'S FIRST
SUBDIVISION OF ALTON BEACH, Plat Book 2, Page 77, Public Records of
Dade County, Florida, said point being the POINT OF BEGINNING;
thence North 88000'49" East, along the North line of said Block 56

ANALYSIS
The above described actions, including vacating of the right-of-way
and abandoning any public and private utilities and easements, as
appropriate, are required to be completed before entering into a
lease agreement with the hotel developer.
The Public Works Department has indicated that there are no utility
easements in the Sixteenth Street End. The City Attorney's Office
will review a title commitment regarding the presence or absence of
utility easements.
CONCLUSION
Vacating of the Sixteenth Street end is a public purpose that will
facilitate development of the convention center hotel project
proposed for the 5.4 acre site which extends to the north and south
of this right-of-way. The Administration recommends that the City
Commission authorize execution of the attached Resolution to
accomplish the purposes as described above.
