TO TAKE TESTIMONY REGARDING THE NORTH SHORE PUBLIC AREA REVITALIZATION DISTRICT NUMBER 1, ESTABLISHED BY CITY OF KIAKI BEACH RESOLUTION NO. 90-19917 : PROVIDING THAT AT SUCH TIME, THE KIAKI BEACH CITY COHKISSION WILL HEAR AND RECEIVE OBJECTIONS OF ALL INTERESTED PERSONS CONCERNING THE CONPIRKATION 01' SAID RESOLUTION, IN ACCORDANCE WITH SECTIONS 29 AND 30 01' THE CITY CHARTER OF THE CITY 01' KIAKI BEACH, FLORIDA. BE IT RESOLVED BY THE CITY COHKISSION 01' THE CITY 01' KIAKI BEACH, FLORIDA, THAT Whereas, By City of Miami Beach Resolution No. 90-199Q adopted on February 21, 1990, the city commission ordered the establishment of the North Shore Public Area Revitalization District Number 1 (hereinafter "NSPAR-l"), in order to fund a physical improvement project for the area~ and Whereas, Section 30 (f) of the city Charter of the city of Miami Beach requires that the City Clerk shall publish in a newspaper of general circulation in the City of Miami Beach, a notice stating that at a meeting of the City Commission on a certain date and hour, the City commission will hear objections of all interested persons to the confirmation of Resolution No. 90-19917 authorizing the establishment of the "NSPAR-l" ~ and Whereas, a description of the proposed improvement is provided in "Exhibit A" attached to this Resolution, with the location thereof provided by the map "Exhibit B" and legal description "Exhibit C" also attached to this Resolution~ and Whereas, the plans specifications and estimate of costs thereof will be on file in the office of the city clerk~ and Whereas, Section 30 (g) of the City Charter of the City of Miami Beach requires that at the City commission meeting named in the aforementioned notice, the commission shall receive objections of interested persons, and may act upon the objections~ and Whereas, Section 30 (i) of the City Charter of the City of Miami Beach requires that at said City commission meeting, all objections to any improvement resolution on the grounds that it contains items which cannot be properly charged to the property owners or that it is, for any default or defect, in the passage or character of the resolution or estimate, void or voidable, in whole or in part, or that it exceeds the power of the legislative body of the municipality, shall be made in writing, in person or by attorney, and filed with the city clerk at or before the time or adjourned time of such hearing. Any objections against the making of an improvement not so made shall be considered as waived~ and if any objection shall be made and overruled or shall not be sustained, the confirmation of the resolution shall be the final adjudication of the issues presented, unless proper steps shall be taken in a court of competent jurisdiction to secure relief within ten days.
