RESOLUTION NO. 74-14311 A RESOLUTION OF THE CITY COUNCIL, CITY OF MIAMI BEACH, FLORIDA, PRO- TESTING AND DEPLORING DESTRUCTION OF ITS PUBLIC BATHING BEACHES WITHIN THE CITY OF MIAMI BEACH BY CURRENT DREDGING OPERATIONS CONNECTED WITH THE HARBOR OF MIAMI, AND, URGING THE INITIATION OF IMMEDIATE EMERGENCY CORRECTIVE MEASURES WHEREAS, the City Council of the City of Miami Beach is dismayed and appalled by the amount and extent of the damage and destruction, approaching, if not surpassing, dis- aster proportions, being perpetrated upon the Public Bathing Beach beginning at the North Jetty of Government Cut by the spewing thereon of incredible vast amounts of rock, refuse, shale, and spoil, from the dredging operations in progress in connection with the widening and deepening of the existing Channel and Turning Basins of the Miami Ship Harbor; and WHEREAS, repeated efforts by the City' s administra- tive staff to obtain action from appropriate agencies ending this continuing destruction of the City's Public Bathing Beaches and restoring the same to their original pristine state, have come to nought; and WHEREAS, it has become starkly obvious and tragically evident that unless the most vigorous, forceable corrective measures are taken immediately and forthwith, the destruction of this irreplaceable Public Bathing Beach will become totally, complete and irretrievable, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that Metropolitan Dade County, by virtue of its contractual covenant with the United States Army Corps of Engineers, as embodied in County Resolution No. R-1282-63, to hold and save the United States free of dama- ges due to construction and maintenance of said Harbor widening and dredging project; the Trustees of the Internal Improvement Fund by reason of their fiduciary and trust status with the people of this City and State in relation to the ownership and ultimate control of the said Public Beach; the Senators and the Representatives from the State of Florida, in the United States Congress by reason of their right of direction and control of the United States Army Corps of Engineers, are hereby indivi- dually and collectively called upon to exercise their powers, rights, and authority in the premises to forthwith bring this continuing and progressive destruction of the said Public Bathing Beach of the City of Miami Beach, Florida, to an im- mediate halt; to take forthwith all necessary steps to cause the prompt removal of said dangerous and destructive deposits of rock, shale, waste, and spoil from the said Beach forthwith, and to initiate instanter all necessary remedial measures to restore said Public Beach to its original natural state ; and OFFICE OF THE CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 BE IT FURTHER RESOLVED by the City Council of the City of Miami Beach, Florida, that this Resolution be and it is hereby passed and adopted as an immediate, imperative emergency measure; that copies hereof be transmitted to each of the hereinabove designated public officials and govern- mental bodies, and it is the sense of this Council that the actions called for by this Resolution should be undertaken and completed by the said responsible public officials and governmental agencies as measures requiring emergency action.
