7 RESOLUTION NO. 74-14360 A RESOLUTION REQUESTING TRUSTEES OF INTERNAL IMPROVEMENT FUND TO ISSUE TO THE CITY OF MIAMI BEACH CONSTRUCTION PERMIT FOR BREAKWATER FILL IN CONNECTION WITH CITY OF MIAMI BEACH MUNICIPAL MARINA, REQUIRED UNDER SECTION 253 . 124 , FLORIDA STATUTES . BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the Trustees of the Internal Improvement Fund be and they are hereby formally requested in accordance with Section 253 . 124 , Florida Statutes , to issue to the City of Miami Beacn an appropriate construction permit for the placing of fill necessary for the Breakwater required in connection with the proposed City of Miami Beach Municipal Marina intended to be constructed within the City of Miami Beach as more fully des- cribed in the application made for, in the name of, and on behalf of the City of Miami Beach, to the Trustees of the Internal Improvement Fund, under File No . 13-39-1462 of the said Trustees of the Internal Improvement Fund. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the said Trustees be duly advised and informed that said proposed Municipal Marina was expressly provided for by the provisions of Ordinance No. 1891 , the Comprehensive Zoning Ordinance of the City of Miami Beach, adopted on October 13, 1971, following numerous and extended Public Hear- ings, certified excerpts from said Ordinance being attached hereto and made a part hereof; that said projected Municipal Marina and the required filling for said Breakwater was fully and thoroughly considered at a Public Hearing duly called and held by the Planning Board of the City of Miami Beach on August 22, 1973 , pursuant to published notice of the holding of such Public Hearing, certified copy of said Public Notice and the minutes of said Public Hearing being attached hereto and made a part hereof; that the recommendation thereafter duly adopted by the said City of Miami Beach Planning Board, a certified copy of which is attached hereto and made a part hereof, was duly transmitted to the City Council of the City of Miami Beach: which latter body reviewed, approved, ratified, confirmed and adopted said recommendation at a duly held and con- vened public meeting of the City Council of the City of Miami Beach, Florida, held on September 5 , 1973 , and a certified extract of the minutes of said Council meeting being attached hereto and made a part hereof. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH , FLORIDA, that said Trustees be further advised that the electorate of the City of Miami Beach approved the construction and funding of said Municipal Marina at a bond election held on the 14th day of March, 1972 , by a vote of 10, 112 For and 7 ,009 Against; a copy of the ballot submitted to the electorate being attached hereto and made a part hereof, and that said bonds were duly validated by a decree of the Dade County Circuit Court on the 30th day of May, 1972 (and said bonds were duly sold on the 7th day of February, 1973) . BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that a copy of the Public Notice issued by the United States Corps of Engineers concerning this marina is attached hereto , and that the following excerpt therefrom be OFFICE OF THE CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 set forth herein as follows : "ENVIRONMENTAL CONSIDERATIONS: The following information has been furnished by the applicant: No significant habitation of bird and animal life presently exists on the proposed site. The channel is an area of low biological productivity. Lack of light penetration, strong currents, compacted sand bottom (devoid of any grass beds) , and unnatural shoreline have prevented any significant growth of biotic communities . The proposed outer break- waters could increase the biological productivity by providing a rock substrata that could be used by plants and animals . A report prepared by the University of Miami to investigate the effect of the proposed marina on tidal circulation of Biscayne Bay indicated that there would be very slight effects on circulation. " BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the Trustees of the Internal Improvement Fund be advised and informed that the requisite fill for the said Breakwater is presently available to the City, if immediately used, from dredging operations presently being conducted in connection with the dredging of the ship channel in Government Cut and the Harbor of the City of Miami ; and that if timely issuance of said permit is not accomplished, said dredging fill will not be available with a resultant additional cost to the City of Miami Beach of approximately Two Million Dollars ($2 ,000, 000 . 00) . BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that a certified copy of this resolution be transmitted immediately and forthwith to the Trustees of the Internal Improvement Fund at its next ensuing session, and be respectfully urged to take favorable action thereon with all deliberate dispatch. MEETING OF THE MIAMI BEACH PLANNING BOARD August 22, 1973 - 3:30 p.m. Cypress Room, Convention Hall South Present were John Forte, Chairman; Aaron Euster, Nat Fechtner, Edward Newman, Paul Ruthfield and Henry Wolff. Also present were Harold Toal , Robert David and Willian Dabrusin of the Planning & Zoning Department, Warren Feld, Marine Inspector and Walt Dozier of the Miami Beach Sun-Reporter. The Chairman called the meeting to order and announced that Items 3 and 4 on the agenda would be taken first (setting of public hearing dates) . Item No. 3 dealt with a proposed amendment to the Zoning Ordinance RE: minimum size for commercial swimming pools. Mr. Newman made the following motion: "The Planning Board shall set a public hearing regarding the minimum size for commercial swimming pools , to be heard on September 25, 1973, at 4:00 p.m. in the Cypress Room, Convention Hall South" . Mr. Fechtner seconded and the motion passed unanimously. Item No. 4 was to consider rezoning of the west side of Collins Avenue between 76th Street and 79th Street. Mr. Oka came forward as one of the owners of the property in question. He said 76th Street to 87th Terrace had always been zoned single family; about a year ago, the City came in and condemned the west side of Collins Avenue from 79th Street to 87th Terrace, to be used in conjunction with a public park directly across the street, but they did not take the three blocks south of it. He said these blocks are still single family; they border on an alley, to the west of the alley, the zoning is all multiple family and to the south of the three blocks the zoning is all multiple family; to the north will be the park. Mr. Oka stated that two Boards of the City have recommended that everything on the west side of Collins Avenue should be zoned multiple family-high density; in 1967 it was recommended to City Council and nothing was done. Then, he continued, in 1971 , during hearings on the new Zoning Ordinance, the Planning Board also made this recommendation and at the last minute it was killed by Council . He said Mr. O'Key had asked City Council not to change the zoning on those blocks in view of the City's creation of a park across the street. It was Mr. Oka's feeling that Mr. O'Key wished for the City to acquire these lots by condemnation , and that was why the zoning was left single family. Mr. Oka suggested that the Board acquaint them- selves with all of the records regarding this matter before the public hearing. Mr. Ruthfield asked Mr. Toal if there were any plans presently in City Hall to condemn these blocks? Mr. Toal answered that at the present time Mr. Sol Bennett, an appraiser for the City, is proceeding with negotiation and acquisition of the prnperties from 79th Street to 87th Terrace, with the exception of the block opposite the Holiday Inn, but Mr. Toal knew of nothing below 79th Street. Mr. Fechtner made the following motion: "The Planning Board shall set a public hearing to consider the rezoning of the west side of Collins Avenue between 76th Street and 79th Street, to be heard on October 24, 1973, at 3:30 p.m. in the Cypress Room, Con- vention Hall South". Mr. Newman seconded. The motion passed unanimously. Mr. Toal called the Board's attention to another application that had been filed by Southern Bell with the Planning Department for a Conditional Use for a parkinglot on 15th Street between Lenox and Michigan Avenues (Helene Apartments property) . He said Mr. James Wade, District Manager of Southern Bell , was in the audience. Mr. Wade explained that Southern Bell had picked up a 120 day option on the south side of 15th Street between Lenox and Michigan Avenues in an attempt to provide parking for its employees . He said that there was great difficulty with employees parking in the area and this Conditional Use would provide off-street parking for them. Mr. Ruthfield made the following motion: "The Planning Board shall set a public hearing to consider a Conditional Use (parking lot) on 15th Street between Lenox and Michigan Avenues , to be heard on September 25, 1973, at 4:30 p.m. in the Cypress Room, Con- vention Hall South" . Mr. Fechtner seconded and the motion passed unanimously. Planning Board -2- August 22, 1973 Mr. Forte next announced Item No. 1 - the continuation of the July 25 public hearing on a proposed Sailport on Normandy Shores . Mr. Toal stated that, after consulting with the City Manager, Mr. Frank Spence, he had written a recommendation regarding this matter (see attached) . Mr. Forte said that because this was a continuation of a public hearing, before the Board took Mr. Toal 's recommendation under advisement, they would hear from anyone who wished to speak. Mr. Ruthfield wished to make one comment: He stated that at the August 14 meeting held at the Normandy Isle Club House regarding the Sailport, he had advised residents that this item had contained a legal description of that area on the bond referendum ballot, and since that meet- ing he had gotten a copy of the exact wording on the ballot. Mr. Ruthfield said the information he had been given on August 14 was incorrect; that no specific location for the construction of a Sailport had been mentioned on the ballot. Mr. Forte asked if there was anyone in the audience who wished to be heard? The following persons appeared in opposition to the proposal : Mrs. Andrew Bekay, 2430 North Shore Terrace (presented petition to build tennis courts on this site) Mrs . Samuel Kann, 1145 North Shore Drive There being no one else who wished to be heard, Mr. Ruthfield made a motion to close the public hearing. Mr. Newman seconded. The motion passed unanimously. Mr. Newman made the following motion: "The Planning Board accepts the recommendation of the Planning & Zoning Department". Mr. Fechtner seconded and upon a call of the roll , the motion passed unanimously. Mr. Ruthfield wished to recommend to Mr. Toal another location that should be looked at that may solve some of the problems. He said the City of Miami Beach presently owns the lots at the end of DiLido Island which were supposedly, at one time, to be used as access to Pelican Island. He continued that during the last election it was passed that there could never be any dredge and fill operation in the Pelican Island area and there are natural barriers surrounding that 2-3 ft. depth on the Pelican Island property; this could possibly be made into a Sailport area. Mr. Ruthfield wished to call another matter to the Board's attention: that of the traffic problems on Arthur Godfrey Road. He said that several times the Planning Board, thru the Planning Department, has requested from the County some relief and help for traffic. He said that to date nothing has improved. Mr. Ruthfield continued that the season would be beginning soon, Tower 41 (northeast corner of Arthur Godfrey Road and Pine Tree Drive) was nearing completion, there was an increase in business on the street, more businesses have actually gone onto the street within the last year, and there has been a major remodeling job that had just been completed next to the Sheridan Theatre. He said the traffic was almost impossible now and would get worse. Mr. Ruthfield suggested that the Board again send a letter to the County requesting immediate help; if necessary a traffic patrol officer at peak hours . Mr. Ruthfield made the following motion: I "The Planning Board approves the sending of a letter to Eugene Simms of the Metro Traffic Engineering Department to try and get something accomplished as soon as possible". Mr. Newman seconded. Mr. Euster recalled that a committee had been appointed to 1 study this problem and questioned whether anything had been done on that. Mr. Ruth- field said that reports and requests for relief had been sent to Metro from time to time and have gone unanswered. Mr. Toal added that through the efforts of the committee the City has retained the services of the firm of Wilbur Smith & Associates who is doing studies of the Convention Center area and Arthur Godfrey Road. There being no further discussion, the secretary called the roll and the motion passed unanimously. Mr. Forte announced the 4 p.m. public hearing. The secretary gave proof of publi- N) cation calling a public hearing for the purpose of considering development of a City of Miami Beach Marina along the west side of Alton Road south of Fifth Street. (There was no correspondence) . Mr. Toal introduced Mr. John Greenleaf of the firm of Green- leaf/Telesca , who would present the plans to the Board. Mr. Greenleaf explained that Planning Board -3- August 22, 1973 his firm had been hired by the City of Miami Beach to design plans for a Marina in that area of land and water lying south of the MacArthur Causeway and north of the ship channel and to the water side of Alton Road. He said one of the first steps in undertaking this project was to survey the need for a Marina and it was found that there was a shortage of some 1 ,800 boat slips - these were slips requiring wet storage (boats larger than 26 ft. ) . He said that the post card survey also showed a need on Miami Beach for dry storage for 225-450 slips in addition to 360- 720 wet slips. Mr. Greenleaf stated that the master plan that had been drawn up of the Marina included a number of facilities off shore that would be directly related to it; such as 420 wet slips (within a breakwater) for boats from 26 ft. to 100+ ft. He said that fueling facilities would also be available. Mr. Greenleaf continued that the outside of the breakwater has been provided along the perimeter of the boat storage area to protect the boats in the Marina against both storm waves and boat wakes. He said the master plan included an area for charter boats at the north end of, the site; an area for "day" fishing boats ; a group of shops , principally oriented toward the fisherman (fish store, etc. ) ; two parking garages , one being a combination of boat storage facility and automobile storage facility; small boat launching area; customs facility for boats returning from out of the country; green open area shown on the master plan as a park (low income housing project) ; shopping center (speciality shops also oriented toward the fisherman, cruises , boats , etc.) ; small hotel ; facil- ities for live-aboard vessels ; two recreation buildings ; yacht club type of facility. Mr. Greenleaf also added that in the group of buildings at the north end of the project there were meeting rooms for groups who would use the Marina (Sea Scouts, Power Squadron) . He said the Marina was one-half mile from one end to another and a tram car system was proposed similar to that of Lincoln Road Mall . Mr. Greenleaf explained that the deepening of the Miami ship channel would provide rock spoil that could be used to build a breakwater at a great savings to the City. He said this would mean having the plans and schedules coincide with the time that this material would be available. Mr. Greenleaf showed the Board a timetable chart he had drawn up, showing the first of the year (1974) as the target for all approvals to construct the Marina and the date that the deepening of the ship channel would begin. He added that before the land development of the Marina, an intense look would be given to the development of the South Beach area. Going back to the time- table, Mr. Greenleaf noted that the actual construction was not planned until February, 1975. He said it was thought that the Marina would be City operated, in which various elements will be managed by private enterprise who will also provide the financing to build, operate and maintain the various structures (under the direction of a City s'. Marina Department) . Mr. Euster asked what would be done about waste matter, holding tanks , etc.? He said at present the ordinance does not permit live-aboards. Mr. Greenleaf answered that this matter was being taken into consideration and there was a Metro ordinance com- ing up on September 4 which would require that any boat that allowed persons to stay on board more than five days in any 30 days, provide sewer connections. Mr. Euster asked if holding tanks or chemical toilets would be used? Mr. Greenleaf said the concept permits a direct connection if the boat doesn ' t have a holding tank or permits emptying a holding tank if a boat does have one; it can work either way. He said the aim will be to prevent any discharge of sanitary waste in the Marina area. Mr. Fechtner asked by what method the boats would be transported from the storage garage to the water? Mr. Greenleaf answered that a fork lift would take the boat from the storage garage and launch it in the water and the reverse would be true. He added that the boat would have to go thru a washing system before it could be put back on the storage rack. Mr. Wolff asked how this proposed Marina compares with the Marina in Ft. Lauderdale? Mr. Greenleaf said that the Marina there has approximately 260 slips and this one proposed 420. Mr. Wolff asked how large a shopping center was proposed and what type of shops? Mr. Greenleaf explained that the plan showed two shopping centers ; one toward the north end and one toward the south end. He said it was necessary to take a look at just how much shopping space can be provided, how much should be provided, how much is economically feasible, what kinds of returns can be expected on it, is it going to be a "center" or is it going to be a series of small shops? He said these were things that went beyond the original study and would have to be thoroughly crystalized before the land plan could be developed. He said the estimates came up to $24 million for the total project and that figure will also have to be checked and the designation of space will have to be looked into because how many hops and what kind will have to be determined. Mr. Wolff questioned whether the shopping center would be small in order to service the needs of the Marina or large enough to service the needs of Planning Board -4- August 22, 1973 the whole community. Mr. Greenleaf said that the concept is that the center would be Marina-oriented; not looking to serve South Beach , necessarily. Mr. Fechtner questioned what was planned in the event that the low-income housing is not constructed on its proposed site? Mr. Greenleaf stated that the plan showed alot of landscaping in that area. Mr. Forte asked if there was anyone in the audience who wished to ask any questions regarding the proposed Marina. Mr. Oscar Levine, 1000 West Avenue, asked Mr. Green- leaf, of the figure of $24 million, what would the cost to the City be? Mr. Greenleaf said it would be approximately $1 .5 to $2 million total and financing could be found for all of the major elements with a "lease package" operation. He went on to explain that it was also entirely possible that the parking garages could be built by the City's Metered Parking Division. There being no other questions , Mr. Forte thanked Mr. Greenleaf on behalf of the Planning Board, for presenting this plan to them. Mr. Ruthfield made a motion to close the public hearing. Mr. Newman seconded and the motion passed unanimously. Related proposed land facilities include a community Yacht Club, a Fishermen's Village Shopping Center, a 400-car parking structure, boat storage facilities, and others. The land area of the proposed marina site is 17 acres. About 250,000 cubic yards of fill consisting of 1/4 - 4 lb. stones would be used for the breakwaters which would be obtained from the dredging of the Miami Harbor presently underway. About 5,000 cubic yards of larger stones (for purposes of providing fish habitat) would be placed on the outer face of the fill in the areas shown on the drawings accompanying this notice. 970 LF of new S.S. piling seawall would be constructed and 600 LF of existing seawall would be repaired. ENVIRONMENTAL CONSIDERATIONS: The following information has been furnished by the applicant: No significant habitation of bird and animal life presently exists on the proposed site. The channel is an area of low biological productivity. Lack of light penetration, strong currents, compacted sand bottom (devoid of any grass beds) , and unnatural shoreline have prevented any significant growth of biotic communities. The proposed outer breakwaters could increase the biological productivity by providing a rock substrata that could be used by plants and animals. A report prepared by the University of Miami to investigate the effect of the proposed marina on tidal circulation of Biscayne Bay indicated that there would be very slight effects on circulation. •• Permit 73-1022 8 March 1974 AUTHORIZATION FROM OTHER AGENCIES: TIITF: Permit applied for. The benefit which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered; among those are conservation, economics, aesthetics, general environmental concerns, historic values, fish and wildlife values, flood damage prevention, land use classification, navigation, recreation, water supply, water quality and, in general, the needs and welfare of the people. No permit will be granted unless its issuance is found to be in the public interest. Any person who has an interest which may be adversely affected by the issuance of this permit may request a public hearing. The request must be submitted in writing to the District Engineer within 30 days of the date of this notice and must clearly set forth the interest which may be adversely affected and the manner in which the interest may be adversely affected by the activity.
