97-22388 RESO RESOLUTION NO. 97-22388 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY 0 F' MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO CONSIDE}~ THE VACATION OF A PORTION OF AN ALLEY IN THE AMENDED PLAT Oi~ AQUARIUM SITE RESUBDIVISION IN FAVOR OF PIN-PON CORPORATIOl',., IN EXCHANGE FOR A NEW ALLEY ON LOT 15, IN THE SAM~ RESUBDIVISION WHEREAS, Pin-Pon Corporation, owns the property located at the northwest corner (f 5th Street and Alton Road, comprised of Lots 1-10 and 15-19 of the Amended Plat of AquariUl n Site Resubdivision, as recorded in Plat Book 21, Page 83, of the Public Records of Dade Count~ , Florida; and WHEREAS, a fifteen foot alley runs through Lots 1 through 4 and 15 through 19, '~it 1 existing utilities; and WHEREAS, Pin-Pon Corporation is requesting the vacation of this alley; and WHEREAS, the Mayor and City Commission, following guidelines set by the Land U5~ and Development Committee on July 19,1989 and preceding vacation requests, shall call fJr a public hearing to consider the abandonment/vacation of the aforementioned public right-of-wa) . BACKGROUND: On July 26, 1989, the Land Use and Development Committee set guidelines/criteria fo: considering right-of-way and easement vacation requests, and recommended a case-by-cas( consideration of these applications. As set forth in these criteria and requirements for aI application, the following items should be submitted with a request for vacation or abandonme nt o A minimum non - refundable application fee of $5,000.00 or the assessed land value. o A title binder, title commitment or attorney's opinion of title. D A statement by the applicant as to how the vacation is in the best interest of the gene ra public. o The City's and other utilities' rights and needs for a utility easement. Any relocation CCtst! should be assumed by the applicant. o A recent topographic survey by a registered surveyor of the applicant's property and the subject City property. o A plan showing the exact location and description of the subject City easement or right-of way, with the proposed improvements and use. o A map showing subject property and properties within a 375 foot radius. o A list of the property owners within the 375 foot radius, and their mailing addresses or gummed labels. o A certified letter stating the source and completeness of the above mentioned real propert) ownership list. 17 DATE C- '1 A~ 5-2~~ ..-.... ; ." .. They have completed the above application requirements and will t e obtaining appraisals to establish the value of the land being vacated and of the land proposed fc r dedication to the City. ANALYSIS: The applicant has submitted the application requirements together with a list of property ownel S within a radius of 375 feet who have to be notified of the scheduled public hearing. The applicant will be responsible for the cost of relocating all of the utilities that are presently i 1 this alley. CONCLUSION: The City Commission should set a time and date for a public hearing to consider this request an j application for the vacation of the alley as shown in the attached Exhibit" A", in favor of Pin-Po 1 Corporation.
