A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE
THIRD AMENDMENT TO THE POLlCE CONFISCATION
TRUST FUND BUDGET FOR FISCAL YEAR 2001/02, IN THE
AMOUNT OF $233,800 TO BE FUNDED FROM THE
PROCEEDS OF STATE ($216,800) AND FEDERAL-JUSTICE
($17,000) CONFISCATED FUNDS.
WHEREAS, Section 932.705, Florida Statutes, addresses the purpose and procedures to
be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and
WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need
for appropriation and expenditures exist and the appropriation and expenditure of forfeiture
funds is in compliance with Section 932.705, Florida Statutes; and federal guidelines; and
WHEREAS, such funds are available in the Police Confiscation Trust Fund.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby adopt the Third Amendment to the FY 2001/02 Police Confiscation Trust
Fund Budget for the City of Miami Beach, in the amount of $233,800, to be funded from the
proceeds of State ($216,800) and Federal-Justice ($17,000) Confiscation Funds as reflected in the
attached Exhibit "A".

LEAGUE SUMMER WORK PROGRAM. The Miami Beach
Police Athletic Explorers consist of young adults sharing a
common interest in law enforcement. The Explorers receive
"hands on experience" regarding law enforcement through
their many functions. These experiences include traffic control,
accident investigation, crime prevention, security, field
interrogations and arrest procedures.

COMMANDER AND EXECUTIVE LEADERSHIP,
ETHICS AND PROFESSIONALISM TRAINING

ADMINISTRATION RECOMMENDATION

Adopt the Resolution.
ANALYSIS
Florida Statute 932.705 provides for expenditures of forfeiture funds for law enforcement
purposes.
The Miami Beach Chief of Police, Don De Lucca has reviewed and identified the need for
the appropriation and has established that the expenditures of forfeiture funds are in
compliance with Section 932.705, Florida State Statutes and Federal guidelines. These
forfeiture funds have been deposited in the Police Confiscation Trust Fund. The City has
complied with all statutory procedures involved in the transaction of these funds.
The Administration requests authorization to adopt the Third Amendment to the operating
budget for the Police Confiscation Trust Fund for Fiscal Year 2001/02 and to appropriate
$233,800 ($216,800 from State and $17,000 from Federal-Justice Funds) to provide for
the expenditures listed in Exhibit "Alt.
