On April 8, 2002, the City Commission approved the amendment to Glatting Jackson's
Agreement for West Avenue to add three EastlWest street treatments. As part of this
action, approval was also granted to complete the construction documents for BaX Road
immediately adjacent to the Grand Flamingo development (two blocks between 14 Street
and 16th Street). The developer of the Grand Flamingo is required to improve this portion
of Bay Road as part of its development approval order. Since Glatting, Jackson is the
neighborhood AlE for the West Avenue neighborhood, these improvements should be
done consistent with the West Avenue/Bay Road neighborhood plan.
The order maximizes the developer's financial contribution to the project at $300,000 but
the developer has agreed to complete the full project, which is currently estimated to cost
approximately $450,000. The City is responsible for developing construction documents to
provide to the developer and is working to fast track the work to enable the developer to
construct the improvements so that he can comply with the development order requirement
and obtain a certificate of occupancy by fall 2002.
The City's AlE firm for the project, Glatting Jackson Kercher Anglin Lopez Rinehart, has
developed a concept plan for the two blocks that has been approved by the CIP and
Planning Departments. However, implementation of the plan will require the City to
address numerous encroachments into the City right of way on the east side of the street.
The plan calls for utilizing the full right of way width that extends approximately ten feet
past the existing sidewalk.
Reclamation of the right of way will require the removal of a number of encroachments
including shrubs, trees, fences, planters, and concrete parking strips. Unpermitted
driveways will be removed in the right of way. Although permitted driveways leading to
garages will be retained, they will no longer be deep enough to park cars on without the
vehicles overhanging onto the new sidewalk. Existing unpermitted parking strips that allow
parking for approximately 12-15 cars will be removed. However, approximately 57 new on
street parallel parking spaces will be created. Each encroachment is described below.
Beyond affecting existing encroachments in the public right of way, planned construction
will place public improvements (sidewalk or planted areas) in close proximity to existing

dwellings. While we have a limited ability to modify the design, any changes will need to
be uniformly done within a block and may affect the final appearance and function of the
improvements. Construction of any level of street improvements will require reclamation of
some of the right of way area.
1425 Bay Road: A one-story house with a driveway leading to a closed off carport. Once
the improvements are constructed, there will be insufficient depth to park a car on the
driveway between the carport and the sidewalk. The driveway can be kept to access the
carport but parking will not be permitted, as the car will obstruct the sidewalk. In addition,
this house has a chain link fence, a hedge, and other plant material that will be removed.
1435 Bay Road: This is a one-story house with a driveway leading to a garage. Once the
improvements are constructed, there will be insufficient depth to park a car on the driveway
between the garage and the sidewalk. The driveway needs to be kept to access the
garage but parking will not be permitted, as the car will obstruct the sidewalk. In addition,
this house has a chain link fence, a hedge, and other plant material that will be removed.
1445 Bay Road: This is a one-story house with a permitted double driveway that has been
converted into parking spaces as the garage has been enclosed. There will not be room
to park between the sidewalk and the garage perpendicular to the street after
improvements are finished. There is a possibility that the owner can reorient the spaces on
the property parallel to the street and retain the driveway. Hedge and plant material will be
removed as well.
1485 Bay Road: Two-story apartment building. Two parking spaces are not currently
permitted. No curb cut will be included in design. Shrubs, trees, and hardscape will be
removed.
1501 Bay Road: Two-story apartment building. Three planters will be removed.
1517 Bay Road: Two-story building. Six parking spaces are currently permitted. With
improvements in place, there will be only 20 feet from sidewalk to edge of building,
including steps and walkway. Parking stops may be able to be moved close enough to the
building to allow the required length inside the sidewalk.
1521 Bay Road: One story building. Existing walk and plant material and unpermitted
parking strips will be removed.
1531 Bay Road: Two parking pull off areas not permitted. Concrete strips, plant material,
and walkways will be removed.

134115th Terrace: Two-one story buildings. Three unpermitted parking spaces are in the
right of way. Parking strips, walkway, plant material will be removed.
1410 16th Street: Hedge, and a small piece of entrance walk will be removed.
1580 Bay Road: Small piece of concrete walk will be removed.
The AlE consultant is moving forward with the construction drawings for the project. The
City has begun the process of contacting the property owners and working to have
encroachments removed. For each property the staff will attempt a personal meeting to
review the planned construction and any related impacts. Construction of the west side of
~J-start in July.
