2002-3377 Ordinance ." , ORDINANCE NO. 2002-3377 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 2 OF THE MIAMI BEACH CITY CODE, ENTITLED "ADMINISTRATION," BY AMENDING ARTICLE VII THEREOF, ENTITLED "STANDARDS OF CONDUCT," BY AMENDING DIVISION 4, ENTITLED "PROCUREMENT," BY AMENDING SECTION 2-486, ENTITLED "CONE OF SILENCE"; SAID AMENDMENT PROVIDING FOR THE CREATION OF A NEW SUBSECTION 2-486(d) AFFIRMATIVELY STATING THAT THE REQUIREMENTS OF SECTION 2-11.1(t) OF THE CODE OF MIAMI- DADE COUNTY, FLORIDA (THE COUNTY'S CONE OF SILENCE ORDINANCE) SHALL NOT APPLY TO THE CITY OF MIAMI BEACH, FLORIDA; PROVIDING FURTHER FOR REPEALER; SEVERABILITY; CODIFICATION; AND AN EFFECTIVE DATE; AND INSTRUCTING THE CITY CLERK, FOLLOWING THE EFFECTIVE DATE OF THIS ORDINANCE, TO TRANSMIT A COPY OF SAME TO THE MIAMI-DADE COUNTY COMMISSION ON ETHICS. WHEREAS, in 1999, the Miami-Dade County Commission approved an amendment to Section 2-11.1 of the Code of Miami-Dade County, establishing Section 2-11.1(t) therein, the County's "Cone of Silence" Ordinance, which was established on all County competitive selection processes, including requests for proposals (RFP's), requests for qualifications (RFQ's), and bids for the provision of goods and services, and audit and independent private sector inspector general (IPSIG) contracts, to protect the integrity of the procurement process by shielding it from undue influences prior to the recommendation of contract award; and WHEREAS, on January 6, 1999, pursuant to the request of Commissioner Jose Smith, the City of Miami Beach adopted Ordinance No, 99-3164, which established the City's "Cone of Silence" Ordinance for the City's competitive bidding processes; the City's Cone of Silence Ordinance, as adopted, is substantially similar to Miami-Dade County's Ordinance; and WHEREAS, on January 29, 2002, the Miami-Dade County Commission approved certain amendments to its Cone of Silence Ordinance, with an effective date of February 8, 2002; and WHEREAS, at the City Commission meeting on June 19, 2002, the County's amendments were proposed by the City Administration and City Attorney's Office for incorporation as an amendment to the City's Cone of Silence Ordinance; and WHEREAS, after extensive discussion, it was deemed that the City's adoption and incorporation of the County's amendments to the City of Miami Beach's Cone of Silence Ordinance would not be in the best interest of the City; and WHEREAS, the issue was referred to the City's Community Affairs Committee, with a specific request that the City Attorney's Office contact the Miami-Dade County Commission on .. Ethics to determine whether the County's recent amendments to its Cone of Silence Ordinance were binding upon the City of Miami Beach, or whether the City could choose to "opt out" of same; and WHEREAS, following discussions with Robert Meyers, Executive Director, Miami-Dade County Commission on Ethics, the City was advised that a recent amendment to the County's Cone of Silence Ordinance, which became effective on or about October 5, 2001, provided that the requirements of the County's Cone of Silence Ordinance (Section 2-11.l(t) of the County Code) shall not apply to any municipality in Miami-Dade County that has adopted an ordinance providing that the Cone of Silence shall not apply to that municipality, and that any municipality that so "opts out" of the requirements of Section 2-11.l(t) shall provide the County's Ethics Commission with a copy of said ordinance; and WHEREAS, this "opt out" provision was not available at the time of adoption of the City's Cone of Silence Ordinance in 1999; and WHEREAS, accordingly, the City Manager and City Attorney's Office herein conclude that the Mayor and City Commission may now, by enactment of this ordinance, "opt out" of the requirements of the County's Cone of Silence Ordinance; and WHEREAS, notwithstanding the Mayor and City Commission's determination herein to "opt out" of the requirements of the County's Cone of Silence Ordinance, it is further recommended by the City Manager and City Attorney's Office that the Mayor and City Commission herein reaffirm, readopt, and continue to hold valid as law in the City of Miami Beach, the provisions of the City's Cone of Silence Ordinance, as codified in Article VII, Division 4, Section 2-486 of the Miami Beach City Code; and WHEREAS, while herein determining that it is in the best interest of the City of Miami Beach to "opt out" of the requirements of the County's Cone of Silence Ordinance, the Mayor and City Commission herein still express a clear intent and policy to maintain the City's Cone of Silence Ordinance, as codified in Article VII, Division 4, Section 2-486 ofthe Miami Beach City Code, and reserve the right to make any and all future amendments thereto, as they deem necessary and advisable, NOW THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA as follows: SECTION 1. SECTION 2-486 ofDMSION 4 OF ARTICLE VII, OF CHAPTER 2 OF THE MIAMI BEACH CITY CODE is hereby amended to create a new subsection entitled: Subsection 2-486(d) as follows: .. ~ Article VII. CODIFICATION It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this Ordinance shall become and be made part of the Code of the City of Miami Beach, Florida, The sections of this Ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article," or other appropriate word. SECTION 3. REPEALER All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4. SEVERABILITY If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 5. EFFECTIVE DATE This Ordinance shall take effect on the 10th day of August, 2002, which is ten (10) days after adoption. Upon the effective date of this Ordinance, the City Clerk shall provide the Miami-Dade County Commission on Ethics with a certified copy of this Ordinance. After extensive discussion, the Mayor and City Commission deemed that adoption and incorporation by the City of the County's amendments would not be in the best interest of the City, The question was asked of the City Attorney's Office, and the issue referred to the Community Affairs Committee, as to whether the County's recent amendments to its Cone of Silence Ordinance were binding upon the City of Miami Beach, or whether the City could choose to "opt out" of same; thereby effectively keeping the City's Cone of Silence Ordinance intact, and leaving the Mayor and City Commission free to incorporate amendments to the City Ordinance in the future, as deemed in the best interest of the City. Following the Community Affairs Committee meeting, the City Attorney's Office had discussions with Mr. Robert Meyers, Executive Director, Miami-Dade County Commission on Ethics. Mr. Meyers advised the City Attorney's Office that another recent amendment to the County's Cone of Silence Ordinance, which became effective on or about October 5, 2001 (and which the City was heretofore unaware of), provided that the requirements of the County's Cone of Silence shall not apply to any municipality in Miami-Dade County that has adopted an ordinance providing that the Cone of Silence shall not apply to that municipality. Therefore, as of October 5, 2001, a municipality could effectively "opt out" from being bound by the County's Cone of Silence Ordinance by adopting an ordinance to that effect. Accordingly, at the Mayor and City Commission's directive following the June 19,2002 City Commission meeting, and pursuant to the research compiled by the City Attorney's Office, the City Manager and City Attorney's Office herein conclude that the City may now, by enactment of the attached Ordinance, "opt out" of the requirements of the County's Cone of Silence Ordinance. Notwithstanding the City's decision to "opt out" of the County's Cone of Silence Ordinance, the City Manager and City Attorney's Office would further recommend that the Mayor and City Commission reaffirm and readopt and continue to hold as binding law in the City of Miami Beach, the City's Cone of Silence Ordinance, as currently codified in Article VIT, Division 4, Section 2-486 of the Miami Beach City Code, This Ordinance does not, and would not, include any of the recent proposed amendments to the County's Cone of Silence Ordinance that the City Commission had heretofore determined would not be in the best interest ofthe City, It is therefore recommended that the Mayor and City Commission adopt the attached Ordinance on first reading.
