LETTER FROM RICHARD MCKINNON, PRESIDENT OF CWA LOCAL
3178, DATED JUNE 14, 2002

We have been advised that you have received a letter from Mr. Richard McKinnon,
President CWA Local 3178 concerning a settlement proposal for the pending Class-Action
Lawsuit filed by plan participants of the General Employees Pension System.
As you are aware, the City of Miami Beach has recently entered into a three (3) year
agreement pursuant to collective bargaining that was conducted in accordance with Florida
Law. As part of the collective bargaining process, the pending litigation was recognized
and the contract provides:
"All current terms and conditions relating to the General Employees Retirement
System shall remain in effect until the resolution of the pending litigation Richard D.
McKinnon et.al. Vs. City of Miami Beach. At which time, the parties agree to re-open
this article" (Section 8.13 CWA Agreement).
By contacting the Mayor and Commissioners directly, Mr. McKinnon is bypassing the
pending legal proceeding and the union contract.
